HomeMy WebLinkAbout108 - 08/15/1995 - GRANTING AN EASEMENT FOR DRAINAGE SLOPE AND ROAD SUPPORT TO COLORADO DEPARTMENT OF TRANSPORTATION ORDINANCE NO. 108, 1995 OF THE COUNCIL OF THE CITY OF FORT COLLINS AUTHORIZING THE CITY TO GRANT AN EASEMENT FOR DRAINAGE, SLOPE AND ROAD SUPPORT TO THE COLORADO DEPARTMENT OF TRANSPORTATION WHEREAS, the City of Fort Collins is the owner of a 16,804 square foot parcel of land located adjacent to the northeast corner of the North College Avenue Bridge in Larimer County, Colorado; and WHEREAS, the Colorado Department of Transportation wishes to acquire an easement interest in the property as described in Exhibit "A", attached hereto and incorporated herein by this reference, to construct, operate, maintain, repair-and replace a-drainage pipe, highway slope and subjacent road support for the new North College Bridge; WHEREAS, Section 23-11 1 of the City Code provides that the City Council is authorized to sell, convey or otherwise dispose of real property owned by the City, provided the Council first finds by ordinance that any sale or disposition of real property owned by the City is in the best interest of the City of Fort Collins. NOW,THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS as follows: Section 1. That the above-described sale and conveyance of an easement interest in the Property is in the best interest of the City of Fort Collins. Section 2. That the Council finds that the sale of this easement will be for the benefit of the citizens of the City. Section 3. That the Mayor is authorized to execute an Easement Agreement conveying an easement interest for a drainage pipe, highway slope and subjacent road support for the new North College Avenue Bridge over, on, and under the real property described on Exhibit "A". Introduced, considered favorably on first reading, and ordered published this 1st day of August, A.D. 1995 and to be presented for final passage on t th ay of Augu 1995. ayor ATTEST: )LL)Aj\ . na City Clerk Passed and adopted on final reading this 15th day of Aug D. 1995. ayor ATTEST: City Clerk EXHIBIT "A" A permanent easement No. PE-6 of the Department of Transportation, State of Colorado, Project No. BR-CXBR 287-3 (63) containing 493 square feet, more or less, in the NW 1/4 of Section 12 , Township 7 North, Range 69 West, of the Sixth Principal Meridian, in Larimer County, Colorado, said easement being more particularly described as follows: Commencing at the NW corner of Section 12 , T7N, R69W, of the 6th P.M. ; Thence S 0 degrees 06 minutes 47 seconds W. , along the west line of the NW 1/4 of Section 12, a distance of 218 . 66 feet; Thence S 89 degrees 40 minutes 52 seconds E. , a distance of 74 .42 feet to the TRUE POINT OF BEGINNING; 1. Thence S 17 degrees 54 minutes 35 seconds E. , a distance of 62 . 12 feet to the south Property Line of that parcel of land described in Book 2033 , page 0303 . 2 . Thence N 66 degrees 36 minutes 13 Seconds W. , along the south Property Line of said parcel, a distance of 21. 12 feet; 3 . Thence N 0 degrees 19 minutes 08 seconds E. , a distance of 50. 72 feet, more or less, to the TRUE POINT OF BEGINNING. The above described Permanent Easement contains 493 square feet, more or less. Basis of Bearings: All bearings are based on a line connecting the NW corner of Section 12 , T7N, R69W, 6th P.M. (2" dia. CDOH Brass Cap) and the W 1/4 corner of Section 12, (3" dia. Brass Cap LS #17497) as bearing S 0 degrees 06 minutes 47 seconds W.
