HomeMy WebLinkAbout090 - 06/21/1994 - AMENDING CITY CODE SO AS TO REVISE AND EXTEND THE REVIEW PROCESS FOR PLANNED UNIT DEVELOPMENTS AND S ORDINANCE NO. 90, 1994 OF THE COUNCIL OF THE CITY OF FORT COLLINS AMENDING CHAPTER 29 OF THE CODE OF THE CITY SO AS TO REVISE AND EXTEND THE REVIEW PROCESS FOR PLANNED UNIT DEVELOPMENTS AND SUBDIVISIONS WHEREAS, the Council of the City of Fort Collins has determined that it is necessary in the interest of the protection of the public welfare that the review process for planned unit developments and standard subdivisions be extended; and WHEREAS, the Council has further determined that certain other changes should be made to Section 29-643(e)(16) . NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS that Chapter 29 of the Code of the City be amended as follows: Section 1 . That the "Review Process Flow Chart" as contained in Section 29-526 of the Code of the City be repealed and readopted to read as shown on Exhibit "A," attached hereto and incorporated herein by this reference. Section 2. That Section 29-526(F) (4) (a) be amended to read as follows: (a) Upon completion of the conceptual review meeting and after the recommendation of the Director of Planning has been made, an application for preliminary plan review may be filed with the Planning Department. If the project is to be developed over time in two (2) or more separate preliminary plan submittals, an overall development plan shall also be required. Applications for approval shall be submitted in accordance with the filing dea -s-dlne set forth in the schedulp- established by the Planning Director pursuant to Section 29- 528 of the Code (hereafter "the Schedule") . After the Director of Planning has reviewed the application and is satisfied that sufficient information has been submitted to permit the Planning and Zoning Board to reach a decision as to whether or not the applicable criteria of this section are met by the proposal , the matter will be placed on the agenda for the appropriate meeting of the Planning and Zoning Board as established in the Schedule. Section 3. That Section 29-526(F) (5) (a) of the Code of the City be amended to read as follows: (a) Application for a final plan may be made only after approval by the Planning- and Zoning Board of a preliminary plan except, however, for good cause shown, the director of Planning may detemrine if application for final plan may be made concurrently with the preliminary plan. Applications for approval shall be submitted in accordance with the filing deadlines set forth in the schedule established by the Planning Director pursuant to Section 29-528 of the Code (hereafter "the Schedule") . After the Director of Planning has reviewed the application and is satisfied that sufficient information has been submitted to permit the Planning and Zoning Board to reach a decision as to whether or not the applicable criteria of this section are met by the proposal , the matter will be placed on the agenda for the appropriate meeting of the Planning and Zoning Board as established in the Schedule. Section 4. That the Code of the City is hereby amended by the addition of a new Section 29-528 to read as follows: Sec. 29-528. Submittal and hearing schedule for planned unit developments. On or before the first day of each calendar year, the Planning Director shall establish, post and file with the City Clerk a schedule showing the regular monthly meeting dates of the Planning and Zoning Board for the ensuing year and the corresponding filing dea li-ney for-the submittals of applications for approval of overall development plans, preliminary plans and final plans, which filing deadlines shall provide for a minimum of nine (9) weeks and a maximum of ten (10) weeks between the filing of a complete application and the hearing at which the application shall be considered. Section 5. That the Code of the City is hereby amended by the addition of a new Section 29-628 to read as follows: Sec. 29-628. Submittal and hearing schedule for subdivisions. Section 6. That Section 29-642(b) (3) of the Code of the City is hereby amended to read as follows: Sec. 29-642. Preliminary plat review. (3) Applications for approval shall be submitted in accordance with the filing deadlines set forth in the schedule established by the Planning Director pursuant to Section 29-628 of the Code (hereafter "the Schedule") . After the Director of Planning has determined that the application is complete, the matter will placed on the agenda for the appropriate meeting of the Planning and Zoning Ro_ard- as established- in- the Schedule.- At such meeting, the board- shall review the preliminary plat and take final action, either 2 approving, approving with conditions, disapproving or postponing for future consideration. Section 7. That Section 29-643(c) of the Code of the City is hereby amended to read as follows: Sec. 29-643. Final plat review. (c) Applications for approval shall be submitted in accordance with the filing deadlines set forth in the schedule established by the Planning Director pursuant to Section 29-628 of the Code (hereafter "the Schedule") . After the Director of Planning has determined that the application is complete, the matter will placed on the agenda for the earliest meeting of the Planning and Zoning Board as established in the Schedule. At such meeting, the board shall review the final plat and take final action, either approving, approving with conditions, disapproving or postponing for future consideration. Section 8. That Section 29-643(e) (16) of the Code of the City is hereby amended to read as follows: Sec. 29-643. Final plat review. (e) (16) Certification by an attorney licensed to practice law in the State of Colorado that the "owners and proprietors" as defined in Section 31-23-111, C.R.S. , have executed and acknowledged the plat in accordance with Section 31- 23-104, C.R.S.
