HomeMy WebLinkAbout081 - 06/07/1994 - AUTHORIZING A NON-EXCLUSIVE EASEMENT FOR A DOMESTIC WATERLINE TO FORT COLLINS LOVELAND WATER DISTRIC ORDINANCE NO. 81, 1994 OF THE COUNCIL OF THE CITY OF FORT COLLINS AUTHORIZING THE CITY TO GRANT A NON-EXCLUSIVE EASEMENT FOR A DOMESTIC WATERLINE TO FORT COLLINS-LOVELAND WATER DISTRICT, A POLITICAL SUBDIVISION OF THE STATE OF COLORADO WHEREAS, the City of Fort Collins is the owner of the South Side Service Center PUD in Larimer County, Colorado; and WHEREAS, the Fort Collins-Loveland Water District, a political subdivision of the State of Colorado, wishes to acquire a non-exclusive easement interest in the property described in Exhibit "A", attached hereto and incorporated herein by this reference ("the Property") , to construct, operate, maintain, repair and replace a domestic waterline; and WHEREAS, Section 23-111 of the City Code provides that the City Council is authorized to sell , convey or otherwise dispose of real property owned by the City, provided the Council first finds by ordinance that any sale or disposition of real property owned by the City is in the best interest of the City; and WHEREAS, the easement will allow the District to install a second source of water and extend the District's existing waterline in a manner which will provide additional protection of the water supply to the City's Transfort facility. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS as follows: Section 1. That the above-described sale and conveyance of an easement interest in the Property is in the best interest of the City of Fort Collins. Section 2. That the Council finds that the sale of this easement will not materially impair the viability of any water or utility system of the City and will be for the benefit of the citizens of the City. Section 3. That the Mayor is authorized to execute a Grant of Easement conveying a non-exclusive easement interest for a waterline to Fort Collins- Loveland Water District, a Political Subdivision of the State of Colorado, over, on, and under the real property described on Exhibit "A" . Mayor ATTEST: City Clerk EXHIBIT "A" A thirty foot (30' ) wide utility easement situate in the Southeast 1/4 of Section 12, Township 6 North, Range 69 west of the 6th P.M. , City of Fort Collins, County of Larimer, State of Colorado, which considering the South line of the said Southeast 1/4 as bearing S 88 degrees 27 minutes 40 seconds E and with all bearings contained herein relative thereto, the centerline of said easement begins at a point which bears N 00 degrees 12 minutes 16 seconds E 1050.01 feet along the West line of the said Southeast 1/4 and again S 88 degrees 27 minutes 40 seconds E 743.92 feet from the South 1/4 corner of said Section 12 and run thence N 00 degrees 00 minutes 00 seconds E 429.84; thence N 18 degrees 30 minutes 00 seconds E 412.56 feet; thence N 00 degrees 00 minutes 00 seconds E 172.50 feet to the end of said easement.
