OF THE COUNCIL OF THE CITY OF FORT COLLINS
AUTHORIZING THE CITY TO CONVEY A HOUSE TO THE
FORT COLLINS HOUSING AUTHORITY
WHEREAS, the City of Fort Collins is the owner of a ten acre undeveloped
park site adjacent to McGraw Elementary School in Fort Collins; and
WHEREAS, there is a house located on the park site that needs to be
destroyed or removed in order for the site to be developed into a park; and
WHEREAS, no other City department has expressed an interest in or use for
the farm house; and
WHEREAS, the Fort Collins Housing Authority ("the Housing Authority") has
inspected the farm house and has informed the City it would like the farm house
to provide affordable housing in the City of Fort Collins; and
WHEREAS, by Resolution 92-155, the Council has determined that the
provision of affordable housing serves a valuable public purpose for the citizens
of the City; and
WHEREAS, Section 23-111 of the City Code provides that the City Council is
authorized to sell , convey or otherwise dispose of real property owned by the
City, which is defined by the ordinance to include buildings upon property owned
by the City, provided the Council first finds by ordinance that any sale or
disposition of the real property owned by the City is in the best interests of
the City; and
WHEREAS, the proposed relocation of the farm house has been approved by the
City according to the procedures prescribed in Chapter 14, Article IV of the City
Code, pertaining to the demolition or relocation of historic buildings.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS
as follows:
Section 1. That it is in the best interests of the City of Fort Collins
to convey the farm house located on the ten (10) acre undeveloped City park site
located adjacent to McGraw Elementary School in Fort Collins, to the Housing
Authority to be used by the Housing Authority to provide affordable housing in
the Fort Collins community.
Section 2. That the Mayor is authorized to execute all documents necessary
to convey the farm house to the Housing Authority in consideration of the Housing
Authority removing the farm house from City property at the expense of the
Housing Authority and in consideration of the Housing Authority using the farm
house to provide affordable housing in the Fort Collins community.
