OF THE COUNCIL OF THE CITY OF FORT COLLINS
AMENDING SECTION 4 OF ORDINANCE NO. 179, 1993, FOR
THE PURPOSE OF CONTINUING THE EFFECTIVE DATE OF
SAID ORDINANCE UNTIL SEPTEMBER 15, 1995
WHEREAS, on December 21, 1993, the Council of the City of Fort Collins enacted
Emergency Ordinance No. 179, 1993 ("Ordinance No. 179"), which increased certain minimum lot
area requirements for one-family and two-family dwellings in the N-C-M Neighborhood
Conservation Medium Density Zoning District; and
WHEREAS, Section 4 of Ordinance No. 179 provided that said ordinance would continue
in effect until December 31, 1994, or until supplemental "design criteria" are adopted by the City
Council for implementation of the plans, whichever shall first occur; and
WHEREAS, by Ordinance No. 180, 1994, the Council extended the effective date of
Ordinance No. 179, 1993, to May 31, 1995; and
WHEREAS, by Ordinance No. 56, 1995, the Council extended the effective date of
Ordinance No. 179, 1993, to June 30, 1995; and
WHEREAS, the above-referenced design criteria have been prepared for Council's
consideration at its regular meeting on June 6, 1995; and
WHEREAS, certain Councilmembers reside or own properties in areas which would be
regulated by said design criteria; and
WHEREAS, said Councilmembers have determined that it is in the best interest of the City
that the Council Ethics Review Committee render an advisory opinion upon the question of whether
their ownership or occupancy of said properties creates a conflict of interest which prevents them
from participating in the Council deliberations regarding said design criteria; and
WHEREAS, the Council Ethics Review Committee has not yet been able to schedule a
meeting to render such an opinion; and
WHEREAS, the Council believes that it would also be in the City's best interests to review
and discuss the proposed design criteria at a Council study session prior to taking formal action with
regard tothe same; and-
WHEREAS, the Council has determined that the provisions of Ordinance No. 179, 1993,
should remain in effect through September 15, 1995, in order to afford adequate time for the meeting
of the Council Ethics Review Committee and the study session; and
WHEREAS, the purpose of this Ordinance is to amend Section 4 of Ordinance No. 179,
1993, to continue its effect until September 15, 1995.
NOW,THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT
COLLINS that Section 4 of Ordinance No. 179 be and hereby is amended to read as follows:
Section 4. That this Ordinance shall continue in effect through the 15th day
of September, 1995, or until supplemental "design criteria" are adopted by the City
Council for implementation of the Plans, whichever shall first occur, at which time
the amendment enacted pursuant hereto shall become null and void and the language
of Section 29-167 of the Code shall read in its entirety as it did immediately prior to
this amendment.
