OF THE COUNCIL OF THE CITY OF FORT COLLINS
VACATING THAT PORTION OF THE SUMMER STREET
RIGHT-OF-WAY WHICH WAS DEDICATED WITH THE
LAKE STREET TOWNHOME P.U.D. PLAT
WHEREAS, on June 5, 1979, the Council of the City of Fort Collins approved the plat
entitled "Lake Street Townhome P.U.D." (the "P.U.D.); and
WHEREAS, the P.U.D. has never been developed and the portion of Summer Street shown
on the P.U.D. Plat has never been constructed; and
WHEREAS, the Owner has requested that the City abandon the P.U.D. and vacate the
platted right-of-way for Summer Street on the property; and
WHEREAS, on May 22, 1995 the Planning and Zoning Board approved the abandonment
of the P.U.D; and
WHEREAS, it is no longer necessary or desirable to retain the right-of-way for Summer
Street as dedicated on the P.U.D. Plat and more particularly described on Exhibit "A," attached
hereto and incorporated herewith by this reference; and
WHEREAS,pertinent City agencies,private utility companies,and the Poudre Fire Authority
have been contacted and report no objection to the proposed vacation.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT
COLLINS that the portion of the Summer Street right-of-way which was dedicated to the City on
the plat entitled "Lake Street Townhome P.U.D." and more particularly described on Exhibit "A,"
be, and the same hereby is, vacated, abated and abolished.

Collins, County of Larimer, State of Colorado being more particularly described as follows:
BEGINNING at the Northwest comer of Tract "B" of said Lake Street Townhome P.U.D.; thence
South 00°05'30" East 30.06 feet to the beginning of tangent curve concave to the Northeast having
a central angle of 59°54'30" and a radius of 48.26 feet; thence Southeasterly along the arc of said
curve 50.46 feet-to the begimming of a-reverse-curvr_concave-tatht-West having a central angle of
90°00'00" and a radius of 125.00 feet; thence Southerly along the arc of said curve 196.35 feet to
the beginning of a compound curve having a central angle of 54' 24'18" and a radius of 93.69 feet;
thence tangent from said curve South 84°24'18" West 164.42 feet to the West line of said Lake
Street Townhome P.U.D.; thence along said West line North 60.00 feet; thence departing said West
