OF THE COUNCIL OF THE CITY OF FORT COLLINS
VACATING AN EASEMENT AT 1501 SOUTH SHIELDS STREET
WHEREAS,the Council of the City of Fort Collins has received a request from the owners
of certain real property located at 1501 South Shields Street to vacate a 16.5 foot wide sidewalk and
bike path easement (the "Easement"); and
WHEREAS, the Choices '95 Project - Shields Street Improvements - Prospect Road to
Shields Street has eliminated the need for this Easement; and
WHEREAS, the Agreement of Purchase and Sale of Real Property between Harold and
Phyllis Worth and the City of Fort Collins requires the vacation of the Easement by May 1, 1995 or
the payment of$2,000 to them if the Easement is not vacated by this date; and
WHEREAS, appropriate City Departments have been contacted and report no objection to
the proposed vacation; and
WHEREAS, there will be no cost to the City to vacate the Easement; and
WHEREAS, the interests of the residents of the City of Fort Collins will not be prejudiced
or injured by the vacation of said Easement.
NOW,THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT
COLLINS that the Easement, as more particularly described on Exhibit "A" on file in the office of
the City Clerk, and incorporated herein by this reference,be, and the same hereby is, vacated, abated,
and abolished.
