HomeMy WebLinkAbout030 - 06/06/1995 - AMENDING CITY CODE RELATING TO PARKING PRIVILEGES FOR PERSONS WITH DISABILITIES UNDER MODEL TRAFFIC ORDINANCE NO. 30, 1995 OF THE COUNCIL OF THE CITY OF FORT COLLINS- AMENDING SECTIONS OF THE CODE OF THE CITY OF FORT COLLINS RELATING TO PARKING PRIVILEGES FOR PERSONS WITH DISABILITIES UNDER THE "MODEL TRAFFIC CODE FOR COLORADO MUNICIPALITIES," 1977 EDITION NOW, THEREFORE, BE 1T ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS that Section 28-17 of the Code of the City of Fort Collins hereby be amended to add or amend sections or subsections of the "Model Traffic Code for Colorado Municipalities" 1977 Edition, to read as follows: Section 1. That Model Traffic Code Section 25-5, Miscellaneous definitions, subparagraph (h), is hereby amended to read as follows: (h) Person with a disability. - A person so severely impaired that such person is unable to move from place to place without the aid of a-mechanical-device or who has-a-physical impairment- which- substantially limits that person's ability to move from place to place. Section 2. Section 28-17, subparagraph (11), is hereby amended to read as follows: Sec. 28-17. Amendments to the adopted code. (11) Section 12-3, Parking privilege for persons with disabilities, is amended as follows: (a) A vehicle with distinguishing license plates or an identifying placard issued pursuant to §42-3-121(2), C.R.S., indicating that the occupant of said vehicle is a "person with a disability," as defined in section 25-5(h) of this Code, may be parked along public streets regardless of any time limitation imposed by official signs upon parking is such area; except that such privilege shall not apply to zones in which: (1) Stopping, standing, or parking of all vehicles is prohibited at all times; (2) Only special vehicles may be parked; or (3) Parking is not allowed during specific periods of the day in order to accommodate heavy traffic. (b) A person with a disability may park in a parking space identified by an official sign as being reserved for use by persons with disabilities, whether on public property or other property available for public use. A placard or license plate issued to a person with a disability shall be displayed on the vehicle while parking in such space. (c) The owner of private property available for public use may install official signs identifying parking spaces reserved for such use by persons with disabilities. Such installation shall be at the owner's expense and in compliance with the Manual for the Uniform Control Devices. Such installation shall be a waiver of any objection the owner may assert concerning enforcement of this section. (d) It is unlawful for any person other than a person with a disability to park in a parking space on public or private property which is clearly identified by an official sign as being reserved for use by persons with disabilities unless such person is parking the vehicle for the benefit of a person with a disability. " (e) It shall be unlawful for any person to deposit, place or pile any snow, ice or litter on any parking space which is identified for use by persons with disabilities, as provided in this section, in a manner that blocks a vehicle from using the parking space. It shall also be unlawful for any person to deposit,place or pile any snow, ice or litter on the areas immediately adjacent to a parking space for persons with disabilities that are reasonably necessary for a person with a disability to safely exit or enter a motor vehicle parked in such adjacent parking space. Further, it shall be unlawful for any person who is the owner of, or has the immediate right to possession of, private property upon which a parking space has been reserved for parking by persons with disabilities, as provided in paragraph(c) of this section, to knowingly permit any person to deposit, place or pile any snow, ice or litter on any such parking space in a manner that blocks a vehicle from using the parking space or on the areas immediately adjacent to such parking space if to do so will unreasonably interfere with a person with a disability safely exiting or entering a motor vehicle parked in the adjacent parking space reserved for persons with disabilities." (f) Persons with disabilities from states other than Colorado shall be allowed to use parking spaces reserved for persons with disabilities in the city so long as such persons have valid distinguishing license plates or placards from their home state." 11 (g) It shall be unlawful for any person who is not a person with a disability to use a license plate or placard issued to a person with a disability pursuant to § 42-3-121(2), C.R.S., in order to receive the 2 benefits or privileges available to a person with a disability under this section." " (h) Any city police officer, community service officer, or authorized parking enforcement officer may check the identification of any person using a license plate or placard for persons with disabilities in order to determine whether such use is authorized."
