HomeMy WebLinkAbout025 - 03/21/1995 - AMENDING CITY CODE TO CHANGE REFERENCES FROM DESIGN STANDARDS TO STANDARDS AND CLARIFYING THAT APPLI ORDINANCE NO. 25, 1995 OF THE COUNCIL OF THE CITY OF FORT COLLINS AMENDING SECTIONS 29-358 AND 29-359 OF THE CODE OF THE CITY OF FORT COLLINS TO CHANGE THE REFERENCES THEREIN FROM "DESIGN STANDARDS" TO "STANDARDS"; AMENDING CHAPTER 29, ARTICLE III, DIVISION 4, SUBDIVISION G, TO CLARIFY THAT "APPLICABLE STANDARDS AND GUIDELINES" WILL BE UTILIZED IN SITE PLAN SUPPLEMENTAL REVIEW PROCEDURES; AND ADDING A NEW SUBDIVISION REGARDING SPECIAL DEVELOPMENT STANDARDS WHEREAS,pursuant to Ordinance No. 187, 1994,the"Harmony Corridor Design Standards and Guidelines"were amended to include not only design provisions but also locational land use and definitional standards and guidelines; and WHEREAS, Sections 29-358 and 29-359 of the Code of the City of Fort Collins make reference to design standards in the review of proposals in the EP Employment Park Zoning District and said reference should be broadened to include not only design standards, but also the other standards that have been established pursuant to Ordinance No. 187, 1994; and WHEREAS, Chapter 29, Article III, Division 4, Subdivision G, contain regulations regarding site plan design supplemental review which should be amended to include not only design standards but such other applicable standards as may have been adopted by the City with respect to any particular region or area; and WHEREAS, the Council of the City of Fort Collins has determined that the Code should be amended to include a provision which expressly identifies the existence of Special Development standards and imposes a general obligation to comply with such standards to the extent that such standards are made applicable to specific proposed developments; and WHEREAS,the Council of the City of Fort Collins has determined that, in the interest of the public health, safety and welfare, the Code should be amended as hereinafter provided. NOW,THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS, as follows: Section 1. Said Section 29-358 be, and hereby is, amended to read as follows: See. 29-359. Siandarrds. All development in the EP District shall comply with any standards prepared and adopted by the city to the extent that such standards apply to the property proposed to be developed. Section 2. That Section 29-359 of the Code be, and the same hereby is, amended to read as follows: Sec. 29-359. Planned Unit Developments. Development of areas in the EP District as a Planned Unit Development plan as defined, processed and approved according to § 29-256 may vary the requirements of this zoning district; provided, however, that all development in the EP District shall comply with any applicable standards as provided in § 29-358. Section 3. That Chapter 29, Article Ill, Division 4, Subdivision G, Section 29-520(a) be, and the same hereby is, amended to read as follows: Subdivision G. Site Plan Supplemental Review Sec. 29-520. Applicability and submission requirements. (a) Proposals for land use or development shall be subject to site plan supplemental review if referred to such review by the requirements of a zoning district in Article III, Division 3 of this Chapter. That zoning district from which a proposal is referred for site plan supplemental review shall be known as the"referral district." Section 4. That Chapter 29, Article III, Division 4, Subdivision G, Section 29-521(4) be, and the same hereby is, amended to read as follows: Sec. 29-521. Administrative review. For those proposals qualifying for administrative site plan supplemental review pursuant to the regulations in the referral district, the following regulations shall apply: (4) In making the administrative decision, the Director of Planning shall determine whether the proposed development conforms to §29-526(d), Activity A, "All Development Criteria" of the Code, and to any other standards that have been established by the City Council by ordinance to regulate the proposed use or which are applicable to the region or area in which the proposal is located, or to any historic district or structure affected by the proposed use. If the proposed development conforms to such criteria and standards, it shall be approved; if the proposed development does not so conform, it shall be denied. 2 Section 5. That Chapter 29,Article III, Division 4, Subdivision G, Section 29-522 be, and the same hereby is, amended to read as follows: Sec. 29-522. Planning and Zoning Board Review. For those proposals requiring site plan supplemental review by the Planning and Zoning Board pursuant to the regulations in the referral district or pursuant to §29-521(5), the Board shall hold a public hearing and the following regulations shall apply: (1) The schedule and procedures for review shall follow those established for a preliminary plan pursuant to §29-526(G)(3). (2) In making the administrative decision, the Director of Planning shall determine whether the proposed development conforms to §29-526(d), Activity A, "All Development Criteria" of the Code, and to any other standards that have been established by the City Council by ordinance to regulate the proposed use or which are applicable to the region or area in which the proposal is located, or to any historic district or structure affected by the proposed use. If the proposed development conforms to such criteria and standards, it shall be approved; if the proposed development does not so conform, it shall be denied. Section 6. That Chapter 29, Article III,Division 4 be, and the same hereby is, amended by the addition of a new Subdivision I, Section 29-525 to read as follows: Subdivision L Special Development Standards. Sec. 29-525. Application of Standards. All proposals for land use or development shall conform to any additional standards adopted by the City Council by ordinance, to the extent that such standards are expressly intended to regulate such proposed land use or developments.
