HomeMy WebLinkAbout171 - 12/06/1994 - AUTHORIZING THE CITY TO CONVEY A PUBLIC RIGHT-OF-WAY AND EASEMENT FOR THE PROPOSED FOSSIL CREEK ESTA ORDINANCE NO. 171, 1994 OF THE COUNCIL OF THE CITY OF FORT COLLINS AUTHORIZING THE CITY TO CONVEY A PUBLIC RIGHT-OF-WAY AND EASEMENT FOR THE PROPOSED FOSSIL CREEK ESTATES P.U.D. WHEREAS, the City of Fort Collins is the owner of the Cathy Fromme Prairie in Larimer County, Colorado; and WHEREAS, Fossil Creek Partners has requested a public right-of-way dedication on the Cathy Fromme Prairie for the extension of Fossil Creek Drive described in Exhibit "A" and attachet hereto and incorporated herein by this reference; and WHEREAS, Fossil Creek Partners has requested an access, slope, utility, and drainage easement on the Cathy Fromme Prairie described in Exhibit "B" and attached hereto and incorporated herein by this reference; and WHEREAS, Fossil Creek Partners has agreed to compensate the City for the right-of-way and easement by conveying fee title to 3.38 acres of property adjacent to the Cathy Fromme Prairie described in Exhibit "C" and attached hereto and incorporated herein by this reference; and WHEREAS, Section 23-111 of the City Code provides that the City Council is authorized to sell , convey or otherwise dispose of real property owned by the City, provided the Council first finds by ordinance that any sale or disposition of real property owned by the City is in the best interest of the City; and WHEREAS, the right-of-way and easement will allow development of Fossil Creek Estates P.U.D. , Phase I in accordance with the plan approved by the City of Fort Collins Planning and Zoning Board; NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS as follows: Section 1. That the above described sale and conveyance of a right-of-way and easement is in the best interest of the City of Fort Collins. Section 2. That the Council finds that the sale and conveyance of the right-of-way and easement will not materially impair the viability of the Cathy Fromme Prairie as a public natural area. Section 3. That the Mayor, in exchange for the fee conveyance to the city of the 3.38 acres of property described in Exhibit "C", is authorized to dedicate or otherwise convey to Fossil Creek Partners, an easement or right-of-way for the extension of Fossil Creek Drive on the property described in Exhibit "A" and a non-exclusive, permanent access, slope, utility and drainage easement on the property described in Exhibit "B" .
