HomeMy WebLinkAbout169 - 12/06/1994 - APPROPRIATING PRIOR YEAR RESERVES IN THE STORM DRAINAGE FUND FOR THE PURCHASE OF LAND FOR THE LOCUST ORDINANCE NO. 169, 1994 OF THE COUNCIL OF THE CITY OF FORT COLLINS APPROPRIATING PRIOR YEAR RESERVES IN THE STORM DRAINAGE FUND FOR THE PURCHASE OF LAND FOR THE LOCUST STREET OUTFALL WHEREAS, the Locust Street Outfall is a capital improvement project identified in the Old Town Master Drainageway Plan, adopted by City Council in December, 1993; and WHEREAS, design and construction of the Locust Street Outfall is currently planned to begin in 1998; and WHEREAS, the property where the channel would be located is currently for sale; and WHEREAS, the current property owners are interested in selling to the City; and WHEREAS, staff has estimated that the costs associated with this land purchase are $280,000; and WHEREAS, since funds for this proposed property acquisition have not previously been budgeted or appropriated, the entire $280,000 needs to be appropriated from prior year reserves in the Storm Drainage Fund; and WHEREAS, Article V, Section 7, of the Charter authorizes the City Council to provide by ordinance for payment of any expense from reserves accumulated in prior years, notwithstanding that such reserves were not appropriated for expenditure in the annual appropriation ordinance. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS that there is hereby appropriated for expenditure from prior year reserves in the Storm Drainage Fund the sum of TWO HUNDRED EIGHTY THOUSAND DOLLARS ($280,000) for the purchase of land for the Locust Street Outfall .
