HomeMy WebLinkAbout014 - 02/15/1994 - APPROPRIATING STORM DRAINAGE FUND PRIOR YEAR RESERVES ORDINANCE NO. 14, 1994 OF THE COUNCIL OF THE CITY OF FORT COLLINS APPROPRIATING STORM DRAINAGE FUND PRIOR YEAR RESERVES WHEREAS, storm drainage fees are collected in the Old Town Basin to fund the construction of master plan basin improvements as well as minor capital improvements; and WHEREAS, the Council of the City of Fort Collins has adopted the Old Town Master Drainage Plan; and WHEREAS, the Old Town Master Drainage Plan includes the construction of wetlands along the Poudre River for the purpose of cleaning stormwater before discharge into the Poudre River; and WHEREAS, the Willow Run Partnership is the owner of approximately 25 acres of land bordering the Poudre River and has offered to sell the property to the City; and WHEREAS, Article V, Section 4, of the Charter of the City of Fort Collins (the "Charter") requires that capital projects be itemized in the budget by individual project; and WHEREAS, the result of such itemization is that each individual capital project in the budget is treated as a separate fund; and WHEREAS, appropriations in the Old Town Drainage Basin are insufficient to cover the $55,746 cost of this acquisition or to cover the $14,254 needed for environmental assessment, clean-up and restoration of the Property; and WHEREAS, Article V, Section 7, of the Charter authorizes the City Council to provide by ordinance for payment of any expense from reserves accumulated in prior years, notwithstanding that such reserves were not appropriated for expenditures in the annual appropriation ordinance; and WHEREAS, funds to cover this expenditure are available from prior year reserves in the Storm Drainage fund. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS that there is hereby appropriated from prior year reserves in the Storm Drainage fund the sum of Seventy Thousand Dollars ($70,000) for expenditure from the Old Town Basin Improvements capital project, to be used for the acquisition of real property along the Poudre River (described on the attached Exhibit "A, " which is incorporated herein by this reference) for a wetland project, and for environmental assessment, cleanup, restoration and related costs. Introduced, considered favorable on first reading, and ordered published this 1st day of February, A.D. 1994, and to be presented for final passage on the 15th day of February, A.D. 1994.
