OF THE COUNCIL OF THE CITY OF FORT COLLINS
AUTHORIZING THE CITY MANAGER TO AMEND AN AGREEMENT OF
PURCHASE AND SALE OF REAL PROPERTY FOR TRACT A OF THE FAIRBROOKE
SID FOR THE PURPOSE OF EXTENDING THE CLOSING DATE
WHEREAS, on December 21, 1993, the Council of the City of Fort Collins
adopted Ordinance No. 167, 1993 ("Ordinance No. 167") , authorizing the City to
sell Tract A of Fairbrooke SID ("the Property") ; and
WHEREAS, Ordinance No. 167 authorized the City to sell the Property to
William L. Neal and Charlotte E. Jorgensen ("Neal/Jorgensen") pursuant to an
Agreement of Purchase and Sale of Real Property dated November 30, 1993 ("the
Agreement") ; and
WHEREAS, Neal/Jorgensen have prepared a plan for development of the
Property which needs to be changed so that such plan is in compliance with the
City' s overall master plan for the storm water basin in which the Property is
located; and
WHEREAS, the City and Neal/Jorgensen agree that it is in the best interest
of the City and of Neal/Jorgensen to extend the current closing date of the
Agreement from August 30, 1994, to September 23, 1994, to allow Neal/Jorgensen
time to resolve this stormwater issue in its plan for development of the
Property.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS
that the City Manager is hereby authorized on behalf of the City to enter into
an Addendum to the Agreement with Neal/Jorgensen to provide that the closing date
of August 30, 1994, shall be extended to September 23, 1994; and that the City
Manager is further authorized to agree to any additional extensions of the
closing date of the Agreement if the City Manager determines that such extensions
are in the best interests of the City.
Introduced, considered favorably on first reading, and published this 9th
day of August, A.D. 1994, and to be presented for final passage on the 16th day
of August, A.D. 1994.
