HomeMy WebLinkAbout119 - 08/16/1994 - AUTHORIZING A NON-EXCLUSIVE EASEMENT FOR AN UNDERGROUND TELECOMMUNICATIONS CABLE TO U.S. WEST COMMUN ORDINANCE NO. 119, 1994 OF THE COUNCIL OF THE CITY OF FORT COLLINS AUTHORIZING THE CITY TO GRANT A NON-EXCLUSIVE EASEMENT FOR AN UNDERGROUND TELECOMMUNICATIONS CABLE TO U S WEST- COMMUNICATIONS, INC. WHEREAS, the City of Fort Collins is the owner of the Lot 7, Heinemann's Spring Creek Subdivision in Larimer County, Colorado; and WHEREAS, U S West Communications, Inc. wishes to acquire a non-exclusive easement interest in the following described property ("the Easement") : The southerly ten (10) feet of Lot 7, Heinemann's Spring Creek Subdivision, lying within the Northwest Quarter of Section 28, Township 7 North, Range 69 West of the 6th Principal Meridian, City of Fort Collins, County of Larimer, State of Colorado, recorded at the Larimer County Clerk and Recorder's Office; to construct, reconstruct, operate, maintain and remove an underground telecommunications cable; and WHEREAS, Section 23-111 of the City Code provides that the City Council is authorized to sell , convey or otherwise dispose of real property owned by the City, provided the Council first finds by ordinance that any sale or disposition of real property owned by the City is in the best interest of the City, and that the sale will not materially impair the viability of the City's Storm Water Utility. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS as follows: Section 1 . That the above-described sale and conveyance of the Easement to US West Communications, Inc. , is in the best interest of the City of Fort Collins. Section 2. That the Council finds that the sale of the Easement will not materially impair the viability of the City's Storm Water Utility system as a whole and will be for the benefit of the citizens of the City. Section 3. That the Mayor is authorized to execute an agreement conveying the Easement to U S West Communications, Inc. over, on and under the real property described above.
