OF THE COUNCIL OF THE CITY OF FORT COLLINS
AUTHORIZING THE LEASE OF 226 WEST MOUNTAIN AVENUE,
FORT COLLINS, COLORADO
WHEREAS, the City of Fort Collins, Colorado ("the City") , and the County
of Larimer, Colorado ("the County") , jointly own the property located at 226 West
Mountain Avenue, Fort Collins, Colorado ("the Property") ; and
WHEREAS, the Property is being held by the City and County for future
office space; and
WHEREAS, the Property is not presently needed for such purpose; and
WHEREAS, Moe Kamandy has proposed to lease the Property from the City and
the County for the principal purpose of operating a restaurant; and
WHEREAS, the City and County desire to enter into this lease in order to
generate revenue from the Property; and
WHEREAS, the Lease Agreement is scheduled to be considered by the County
Commissioners of the County; and
WHEREAS, Section 23-114 of the Code of the City requires as a condition of
leasing the Property that the Council find the Lease is in the best interest of
the City.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS,
as follows:
Section 1. That the lease of the Property, as described in Section 2
below, is in the best interest of the City of Fort Collins.
Section 2. That the Mayor is authorized to execute a Lease Agreement with
Moe Kamandy for the Property, subject to approval by the County, which provides
for the following:
A guaranteed rental term of one (1) year for the Property with an
option to renew for two one-year terms with a base monthly rental of
Seven Hundred Eight Dollars ($708) per month and with Moe Kamandy
obligated to pay the costs of water, sewer, gas, and property taxes
used on or assessed against the Property.
Introduced, considered favorably on first reading, and ordered published
this 19th day of July, A.D. 1994, and to be presented for final passa on the
2nd day of August, A.D. 1994.
