OF THE COUNCIL OF THE CITY OF FORT COLLINS
AUTHORIZING THE MAYOR TO EXECUTE A CONSENT FOR RIGHT
OF ENTRY AUTHORIZING THE STATE OF COLORADO, DEPARTMENT
OF NATURAL RESOURCES, DIVISION OF MINERALS AND GEOLOGY,
TO ENTER UPON THE CITY'S MEADOW SPRINGS RANCH PROPERTY FOR THE PURPOSE
OF REMEDIATION AND RECLAMATION ACTIVITIES OF ABANDONED MINE SITES
WHEREAS, the City of Fort Collins is currently the owner of that certain
real property commonly known as the Meadow Springs Ranch ("the Ranch") ; and
WHEREAS, there are currently located on the Ranch three small inactive coal
mine sites which are in need of remediation and reclamation in order to protect
the public health and safety; and
WHEREAS, the Colorado Division of Minerals and Geology has offered to
reclaim these three inactive mine sites at no cost to the City, subject to the
City granting to the State of Colorado a Consent for Right of Entry; and
WHEREAS, Section 23-111 of the Code of the City of Fort Collins authorizes
the City Council to sell , convey or otherwise dispose of any and all interest in
real property owned in the name of the City, provided that the Council first
finds that such sale or other disposition is in the best interests of the City.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS
as follows:
Section 1. That the granting of the Consent for Right of Entry by the City
of Fort Collins to the State of Colorado is in the best interests of the City.
Section 2. That the Mayor be, and hereby is, authorized to execute a
Consent for Right of Entry in a form approved by the City Attorney, as is
necessary for the City to grant to the State of Colorado the right to enter upon
the Ranch for the purpose of remediating and reclaiming the three (3) inactive
coal mine sites on the Ranch.
