OF THE COUNCIL OF THE CITY OF FORT COLLINS
VACATING THE RIGHT-OF-WAY FOR SNOWBERRY STREET
AS DEDICATED WITH THE PLAT OF RAINTREE P.U.D.
WHEREAS, the plat of the Raintree P.U.D. was approved by the Council of the
City of Fort Collins on August 19, 1980, and included a dedication to the public
of a right-of-way for Snowberry Street; and
WHEREAS, Snowberry Street has never been constructed, and it is no longer
necessary or desirable to retain the right-of-way for said street; and
WHEREAS, the Planning and Zoning Board has approved The Preserve Apartments
P.U.D. Preliminary and Final , which, upon final approval , replats a portion of
the Raintree P.U.D. , including the Snowberry Street right-of-way; and
WHEREAS, pertinent City agencies and private utility companies have been
contacted and report no objection to the proposed vacation; and
WHEREAS, the rights of the residents of the City of Fort Collins will not
be prejudiced or injured by the vacation of said right-of-way.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS
that the street right-of-way for Snowberry Street as dedicated and described on
the plat entitled "Raintree P.U.D. " be, and the same hereby is, vacated, abated
and abolished.
Introduced, considered favorably on first reading, and ordered published
this 4th day of January A.D. 1994, and to be presented for inal passage on the
18th day of January A.D. 1994. /
