HomeMy WebLinkAbout174 - 11/03/1987 - AMENDING CITY CODE TO AUTHORIZE THE PLANNING DIRECTOR TO ACCEPT CERTAIN DEDICATIONS OF STREETS, EASE ORDINANCE NO. 174, 1987 OF THE COUNCIL OF THE CITY OF FORT COLLINS AMENDING SECTION 29-644(h) OF THE CODE OF THE CITY OF FORT COLLINS TO AUTHORIZE THE PLANNING DIRECTOR TO ACCEPT CERTAIN DEDICATIONS OF STREETS, EASEMENTS AND OTHER RIGHTS-OF-WAY, AND TO VACATE CERTAIN EASEMENTS AND OTHER RIGHTS-OF-WAY WHEREAS, Section 29-644 establishes an expedited review and approval process by the Planning Director for minor subdivisions; and WHEREAS, said Section sets forth a procedure for vacation and dedication of streets, easements and other rights-of-way by the Planning Director for the resubdivision or replat of minor subdivisions; and WHEREAS, the Council of the City of Fort Collins does hereby determine that it is in the best interests of the City that said Ordinance be amended to clarify such acceptance and vacation actions. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS that Section 29-644(h) of the Code of the City of Fort Collins, be amended to read as follows: (h) Vacations and dedications of streets and easements. In the event that the minor subdivision process is used to resubdivide or replat a previously approved minor subdivision, and in the event that such resubdivision or replat shall include the vacation of streets, easements or other rights-of-way, the vacation of streets and alleys shall be accomplished by ordinance of the City Council as required by Colorado statutes. Vacation of all other easements and rights-of-way may be accomplished by approval of the resubdivision or replat by the Planning Director, provided that such resubdivision or replat contains notation of such vacation. Dedications of streets, easements and/or other rights-of-way for minor subdivisions may be accepted by the Planning Director or City Engineer on behalf of the City.
