HomeMy WebLinkAbout173 - 11/03/1987 - AMENDING CITY CODE TO AUTHORIZE THE PLANNING AND ZONING BOARD TO ACCEPT DEDICATIONS OF STREETS, EASE ORDINANCE NO. 173, 1987 AMENDING SECTION 2-353(4) OF THE CODE OF THE CITY OF FORT COLLINS TO AUTHORIZE THE PLANNING AND ZONING BOARD TO ACCEPT DEDICATIONS OF STREETS, EASEMENTS AND OTHER RIGHTS-OF-WAY, AND TO VACATE EASEMENTS AND OTHER RIGHTS-OF-WAY WHEREAS, Section 2-353(4) of the Code of the City authorizes the Planning and Zoning Board to take final action to approve, disapprove or approve with conditions all planning items, subject to appeal to the City Council ; and WHEREAS, the past practice of the Board has been to, as a part of its final action on planning items, accept the dedication of streets, easements and other rights-of-way as laid out on plats presented to the board for approval ; and WHEREAS, it has further been the past practice of the Board to review and approve replats presented to the Board, including the vacation of easements and other rights-of-way dedicated on original plats, when the replat contains a notation of such vacation; and WHEREAS, the Council of the City of Fort Collins does hereby determine that it is in the best interests of the City that the Code be amended to expressly provide for the acceptance and vacation of such dedications. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS that Section 2-353(4) of the Code of the City be amended to read as follows: (4) The board shall have the authority to take final action to approve, disapprove or approve with conditions all planning items in accordance with this Code and Charter provided that the City Council by a majority vote of a quorum of its members shall have the power to review such decisions in accordance with the provisions of Article II, Division 3 of this Chapter. In taking such final action, the board shall have authority to accept the dedication of streets, easements and other rights-of-way as laid out on plats presented to the board for approval , and shall have the authority to vacate easements and other rights-of-way, but not to include streets and alleys, by resolution or by approval of replats containing notation of such vacation.
