OF THE COUNCIL OF THE CITY OF FORT COLLINS
AUTHORIZING THE CITY MANAGER TO ENTER INTO
AN AGREEMENT REGARDING THE OPERATION OF
THE BATTING CAGE CONCESSION IN CITY PARK
WHEREAS, the City of Fort Collins provides City Park for the use and
enjoyment of its residents; and
WHEREAS, in connection with the operation of City Park, the City of
Fort Collins has allowed various concession facilities in City Park; and
WHEREAS, the City has agreed to grant a concession for the operation
of the batting cage in City Park; and
WHEREAS, Article V, Section 34 of the Charter of the City of Fort
Collins provides that, "No contract for service shall be made by the City
for a longer period than two years, unless authorized by ordinance, . . .";
and
WHEREAS, the proposed agreement with Glen Werth for the operation of
the batting cage concession in City Park is for a two year period with
renewal provisions for three additional one year periods.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT
COLLINS that the City Manager be, and he hereby is, authorized to enter
into an agreement with Glen Werth for the purpose of operating the batting
cage concession in City Park for a period of two years with renewal
provisions for three additional oneyear periods.
Introduced, considered favorably on first reading, and ordered
published this 20th day of January, A.D. 1987, and to be presented for
final passage on the 3rd day of February, A.D. 198 .
