OF THE COUNCIL OF THE CITY OF FORT COLLINS
AMENDING CHAPTER 5 OF THE CODE OF THE CITY OF FORT COLLINS
PERTAINING TO THE DEFINITION OF "NONOWNER-OCCUPIED HOUSING"
WHEREAS, a substantial number of mobile home rental units exist in the
City of Fort Collins; and
WHEREAS, the promulgation of minimum standards of health and safety is
necessary in order to insure that mobile home rental units are habitable;
and
WHEREAS, it is desirable to provide minimum standards for mobile home
rental units in order to safeguard life, health, property and public
welfare; and
WHEREAS, the Nonowner-Occupied Housing Health and Safety Code of the
City does not currently pertain to mobile home rental units; and
WHEREAS, such standards are of benefit to the citizens of the City of
Fort Collins, and the City Council has determined that the NonownerOccupied
Housing, Health and Safety Code should be made applicable to mobile home
rental units; and
WHEREAS, the purpose of this ordinance is to provide minimum standards
to safeguard life or limb, health, property and public welfare by
regulating and controlling the use and occupancy, location and maintenance
of all mobile home rental units within the City.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT
COLLINS that Section 5-236 of the Code of the City of Fort Collins
pertaining only to the definition of "nonowner-occupied housing" is hereby
amended to read as follows:
Sec. 5-236. Definitions.
Nonowner-occupied housing shall mean any building or portion
thereof, including the lot, tract, or parcel of land on which the
same is located, containing any dwelling unit, guest room or
hotel ; and any mobile home as defined in Chapter 18 of this Code,
or any other similar place intended for human habitation, which
is leased, rented or otherwise occupied by a person who is not
the fee owner of record of said building, mobile home or portion
thereof.
