SUBMITTING A PROPOSED CHARTER AMENDMENT
TO A VOTE OF THE REGISTERED ELECTORS
OF THE CITY OF FORT COLLINS
CONCERNING APPROPRIATIONS
FORBIDDEN
WHEREAS, Article IV, Section 8 of the Charter of the City of Fort Collins
provides that the Charter may be amended as provided by the laws of the State
of Colorado; and
WHEREAS, Section 31-2-210, C.R.S. , provides that Charter amendments may
be initiated by the adoption of an ordinance by the Council submitting a proposed
amendment to a vote of the registered electors of the City of Fort Collins; and
WHEREAS, the Council desires to submit certain proposed Charter amendments
to the registered voters of the City at the next regular City election to be held
on April 2, 1991 .
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS
as follows:
Section 1 . That the following proposed Charter amendment shall be
submitted to the registered voters of the City at the next regular City election
to be held on April 2, 1991:
PROPOSED CHARTER AMENDMENT NO. 2
Article V, Section 16 of the Charter of the City of Fort Collins is hereby
amended to read as follows:
Section 16. Appropriations forbidden.
No appropriation shall be made for any charitable, industrial ,
educational , or benevolent purposes to any person, corporation, or
organization not under the absolute control of the city, nor to any
denominational or sectarian institution or association. Nothing
herein shall be construed to prohibit an appropriation which is made
for a bona fide public purpose, so long as any private benefit
resulting from such appropriation is merely indirect or incidental .
Section 2. The following ballot language is hereby adopted for submitting
Proposed Charter Amendment No. 2 to the voters at said election:
PROPOSED CHARTER AMENDMENT NO. 2
AN AMENDMENT TO ARTICLE V, SECTION 16 OF THE CHARTER CREATING AN
EXCEPTION TO THE GENERAL RULE THAT APPROPRIATIONS FOR CHARITABLE,
INDUSTRIAL, EDUCATIONAL OR BENEVOLENT PURPOSES MUST BE MADE TO
PERSONS, CORPORATIONS OR ORGANIZATIONS UNDER THE ABSOLUTE CONTROL
OF THE CITY, SO THAT APPROPRIATIONS FOR SUCH PURPOSES COULD BE MADE
TO PERSONS, CORPORATIONS OR ORGANIZATIONS NOT UNDER THE ABSOLUTE
CONTROL OF THE CITY IF THEY WERE MADE FOR A BONA FIDE PUBLIC
PURPOSE.

AGAINST THE AMENDMENT
Introduced, considered favorably on first reading, and ordered published
this 5th day of February, A.D. 1991, and to be presented for final passage on
the 19th day of February, A.D. 1991 .
