HomeMy WebLinkAbout010 - 02/19/1991 - SUBMITTING A PROPOSED CHARTER AMENDMENT TO A VOTE OF THE REGISTERED ELECTORS CONCERNING THE BUDGET A ORDINANCE NO. 10, 1991 OF THE COUNCIL OF THE CITY OF FORT COLLINS SUBMITTING A PROPOSED CHARTER AMENDMENT TO A VOTE OF THE REGISTERED ELECTORS OF THE CITY OF FORT COLLINS CONCERNING THE BUDGET ADOPTION PROCESS AND INTERFUND TRANSFERS WHEREAS, Article IV, Section 8 of the Charter of the City of Fort Collins provides that the Charter may be amended as provided by the laws of the State of Colorado; and WHEREAS, Section 31-2-210, C.R.S. , provides that Charter amendments may be initiated by the adoption of an ordinance by the Council submitting a proposed amendment to a vote of the registered electors of the City of Fort Collins; and WHEREAS, the Council desires to submit certain proposed Charter amendments to the registered voters of the City at the next regular City election to be held on April 2, 1991 . NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS as follows: Section 1 . That the following proposed Charter amendment shall be submitted to the registered voters of the City at the next regular City election to be held on April 2, 1991 : PROPOSED CHARTER AMENDMENT NO. 1 (a) That Article V, Finance Administration, of the Charter of the City of Fort Collins is hereby amended by revising and combining Sections 4 and 5 into a new Section 4 and by renumbering the subsequent Sections, with the revised Sections 4 and 5 to read as follows: Section 4. Adoption of budget and appropriation of funds. After said public hearing and before the last day of November of each year, the Council shall adopt the budget for the ensuing fiscal year and shall appropriate such sums of money as the Council deems necessary to defray all expenditures of the city during the ensuing budget year. The adoption of the budget and appropriation of funds shall be accomplished by passage of the Annual Appropriation Ordinance. Such appropriation of funds shall be based upon the budget as approved by the Council but need not be itemized further than by fund with the exception of capital projects and federal or state grants which shall be summarized by individual project or grant. Section 5. Levy. The "Annual Appropriation Ordinance" shall also include the levy in mills, as fixed by the Council , upon each dollar of the assessed valuation of all taxable property within the city, such levy representing the amount of taxes for city purposes necessary to provide, during the ensuing budget year, for all properly authorized expenditures to be incurred by the city, including interest and principal of general obligation bonds. The Council shall thereupon cause the total levy to be certified by the City Clerk to the county consistent with applicable state statutes, which shall extend the same upon the tax list of the current year in a separate column entitled "City of Fort Collins Taxes, " and shall include said city taxes in his or her general warrant to the County Treasurer for collection. If the Council fails in any year to make said tax levy as above provided, then the rate last fixed shall be the levy fixed for the ensuing budget year and the Financial Officer shall so certify. (b) That Article V, Section 15 of the Charter of the City of Fort Collins is hereby amended to read as follows: Section 15. Appropriation of excess revenue and transfers of appropriations. At the expiration of eight (8) months of the budget year or thereafter within the budget year, if the actual revenue realized exceeds the budget estimates, the Council may, by ordinance, appropriate the excess to any purpose recommended by the City Manager for expenditure during the budget year. During the budget year, the City Manager may transfer any unused budgeted amount or portion thereof from one (1) budget category to any other budget category within the same fund. During the budget year, the Council may, by ordinance, upon the recommendation of the City Manager, transfer any unexpended appropriated amount or portion thereof from one (1) fund to another provided that the purpose for which the transferred funds are to be expended remains unchanged or the purpose for which the funds were initially appropriated no longer exists. At any time during the budget year, the Council , by ordinance, may appropriate revenues which were not anticipated at the time of adoption of the annual budget and which are a result of rate or fee increases or new revenue sources. Section 2. The following ballot language is hereby adopted for submitting Proposed Charter Amendment No. 1 to the voters at said election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ntroduced, considered favorably on first reading, and ordered published this 5th day of February, A.D. 1991, and to be presented for final passage on the 19th day of February, A.D. 1991 .
