HomeMy WebLinkAbout099 - 09/18/1990 - AUTHORIZING THE EXCHANGE OF REAL PROPERTIES BETWEEN THE CITY AND FAITH EVANGELICAL FREE CHURCH ORDINANCE NO. 99, 1990 OF THE COUNCIL OF THE CITY OF FORT COLLINS AUTHORIZING THE EXCHANGE OF REAL PROPERTIES BETWEEN THE CITY AND FAITH EVANGELICAL FREE CHURCH WHEREAS, the City of Fort Collins ("the City") and the Faith Evangelical Free Church ("the Church") have entered into an Agreement of Exchange of Real Property dated August _, 1990, ("the Agreement") ; and WHEREAS, pursuant to the Agreement the City has agreed to deed to the Church .27 acres of the City's real property located in the Ross Open Space ("the City Property") ; and WHEREAS, in return the Church has agreed to deed to the City .27 acres of the Church's real property that is located adjacent to the Ross Open Space ("the Church Property") ; and WHEREAS, i�, addition, the Church has agreed to deed .07 acres of its real property to the City for a bicycle/pedestrian trail to provide access from Drake Road to the Ross Open Space ("the Trail Property") but reserving to the Church an easement across the Trail Property to provide the Church with access from Drake Road to its future parking lot; and WHEREAS, the City has also agreed to grant to the Church an easement for drainage over, across and under that certain real property described on Exhibit "A" attached hereto and incorporated herein by reference ("the Drainage Easement") ; and WHEREAS, the Agreement is contingent upon City Council 's approval of the Agreement on or before September 18, 1990; and WHEREAS, the Council finds, in accordance with Section 23-111 of the Code of the City of Fort Collins, that the conveyance of the City Property and the Drainage Easement in exchange for the Church Property and the Trail Property is in the best interests of the City of Fort Collins. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS as follows: Section 1 . That the conveyance of the City Property and the Drainage Easement in exchange for the Church Property and the Trail Property is in the best interests of the City of Fort Collins. Section 2. That the Agreement is hereby approved. Section 3. That the Mayor be, and hereby is, authorized to execute deeds conveying the City Property and the Drainage Easement to the Church, pursuant to the terms and subject to the contingencies contained in the Agreement. Introduced, considered favorably on first reading, and ordered published this 4th day of September, A.D. 1990, and to be presented for final passage on the 18th day of September, A.D. 1990.
