HomeMy WebLinkAbout098 - 09/04/1990 - AMENDING CITY CODE RELATING TO BOARDS AND COMMISSIONS AND CREATING A COMMUNITY DEVELOPMENT BLOCK GRA ORDINANCE NO. 98 , 1990 OF THE COUNCIL OF THE CITY OF FORT COLLINS AMENDING CHAPTER 2 OF THE CODE OF THE CITY OF FORT COLLINS RELATING TO BOARDS AND COMMISSIONS AND CREATING A COMMUNITY DEVELOPMENT BLOCK GRANT COMMISSION WHEREAS, the City Council has determined that it is in the best interest of the City to improve citizen participation in the City's Community Development Block Grant (CDBG) Program; and WHEREAS, the Council has determined to resolve certain issues related to the CDBG Citizens Steering Committee (CSC) , including concerns about the appointment of members, the length of service an individual member may have, and the question of which boards and commissions rules and regulations apply to the CSC; and WHEREAS, the Council desires to establish a framework which meets minimum Department of Housing and Urban Development regulations for low- and moderate-income neighborhood resident participation within the CDBG Program. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS that Chapter 2 of the Code be amended as follows: Section 1 . That Division 10 "Commission on Disability" be renumbered , as Division 9 and Sections 2-166 through 2-170 be renumbered as Sections 2-151 through 2-155. Section 2. That Division 11 " Commission on the Status of Women" be renumbered as Division 10 and Sections 2-181 through 2-185 be renumbered as Sections 2-166 through 2-170. Section 3. That a new Division 11 be added to read as follows: DIVISION 11 . COMMUNITY DEVELOPMENT BLOCK GRANT COMMISSION Sec. 2-181. Creation. There shall be and is hereby created a Community Development Block Grant Commission, hereafter referred to in this Division as the commission. Sec. 2-182. Membership; term. (a) The commission shall consist of thirteen (13) members appointed by the City Council , including persons of low- and moderate-income who are residents of slum and blight areas and/or are residents of the low- and moderate-income neighborhood strategy areas that have been identified by the City . Appointments shall specify the term of office of each individual in order to achieve overlapping tenure. (b) Each member shall serve a term of four (4) years without compensation. All members shall be subject to removal by the City Council . If a vacancy occurs on the commission, it shall be filled by the City Council for the remaining unexpired portion of the term. Sec. 2-183. Functions. The duties and functions of the commission shall be: (1) To advise the City Council on matters pertaining to the Department of Housing and Urban Development's Community Development Block Grant (CDBG) Program; (2) To promote the CDBG Program within the city with special attention to the three low- and moderate- income neighborhood strategy areas of Holy Family, Laurel School , and Buckingham, Alta Vista, and Andersonville (B.A.V.A.) ; (3) To assess the community development needs of low- and moderate-income individuals and families and suggest programs to meet those needs; (4) To provide recommendations to the City Council concerning the expenditure of CDBG funds received from the Department of Housing and Urban Development; (5) To perform such other duties and functions and have such other powers as may be provided by ordinance of the City Council . Sec. 2-184. Officers; bylaws. The commission shall elect annually from its membership a chairperson and such other officers as may be required. Bylaws may be adopted by the commission, which bylaws shall not be inconsistent with the Charter, the Code, and Department of Housing and Urban Development rules and regulations. A copy of the bylaws shall be filed with the City Clerk for the use of the City Council immediately after adoption by the commission and they may be subject to the approval of the City Council . Sec. 2-185. Minutes; annual report; work plan. It is required that minutes be kept for each commission meeting and that such minutes be filed with the City Clerk prior to the next regular meeting of the commission. On or before October 31 of each year, the commission shall file a report with the City Clerk setting forth the activities of the commission for the previous CDBG fiscal year. On or before August 31 of each year, the commission shall file a work plan with the City Clerk for the following CDBG fiscal year.
