OF THE COUNCIL OF THE CITY OF FORT COLLINS
REQUESTING TERMINATION OF THE
FORT COLLINS-LOVELAND AIRPORT AUTHORITY
WHEREAS, The City of Loveland, Colorado, and the City of Fort Collins,
Colorado ("Cities") , acting pursuant to the Public Airport Authority Act,
Title 41, Article 3, C.R.S. , created the Fort Collins-Loveland Airport
Authority by Ordinance No. 74, 1983, of the City of Fort Collins and
Ordinance No. 2092 of the City of Loveland, which ordinances were
subsequently amended by Ordinance No. 110, 1986 of the City of Fort Collins
and Ordinance No. 3314 of the City of Loveland; and
WHEREAS, Cities have leased the Fort Collins-Loveland Airport to the
Fort Collins-Loveland Airport Authority ("Authority") , which arrangement
the Authority has terminated by giving notice under the current lease to
the Cities; and
WHEREAS, as a result of such notice and further discussions with the
Authority, the Cities have concluded that the purposes for which the
Authority were created no longer exist; and
WHEREAS, the Cities desire to terminate the Authority by passage of
this ordinance as authorized in Article 3 of Title 41, C.R.S.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT
COLLINS:
Section 1 . That the City of Fort Collins, Colorado, hereby requests
the termination of the Fort Collins-Loveland Airport Authority as
authorized in Section 41-3-104(6) , C.R.S.
Section 2. That there are no outstanding bonds of the Fort
Collins-Loveland Airport Authority.
Section 3 . That the City of Fort Collins , Colorado hereby
acknowledges receipt of notice from the Fort Collins-Loveland Airport
Authority sufficient to terminate, as of June 9, 1990, that certain
INTERGOVERNMENTAL LEASE AGREEMENT which was effective January 1, 1990 by
and between the City of Fort Collins, The City of Loveland and the Fort
Collins-Loveland Airport Authority, which lease encompassed the property
commonly known as the Fort Collins-Loveland Municipal Airport.
Section 4. That the Fort Collins-Loveland Airport Authority shall
cease to exist upon the filing with the Director of the Division of Local
Government of the State of Colorado of a certified copy of this ordinance,
together with a certified copy of an ordinance duly adopted by the City of
Loveland, Colorado, requesting the termination of the Authority.
Introduced, considered favorably on first reading, and ordered
published this 5th day of June, A.D. 1990, and to be presented for final
passage on the 3rd day of July, A.D. 1990.
