HomeMy WebLinkAbout142 - 10/06/1987 - AMENDING CITY CODE TO ALLOW FOR GREATER FLEXIBILITY WITH REGARD TO THE NUMBER OF UNRELATED PERSONS W ORDINANCE NO. 142, 1987 OF THE COUNCIL OF THE CITY OF FORT COLLINS BEING AN ORDINANCE AMENDING SECTION 118-83(E) OF THE CODE OF THE CITY OF FORT COLLINS TO ALLOW FOR GREATER FLEXIBILITY WITH REGARD TO THE NUMBER OF UNRELATED PERSONS WHO MAY RESIDE IN A DWELLING UNIT IN MULTIPLE-FAMILY DWELLINGS WHEREAS, Section 118-11 of the Code of the City contains the definition of "family" which, among other things, provides that a family shall not be composed of more than three (3) unrelated persons living together; and WHEREAS, the Council has determined that it is in the best interests of the City that, with respect to planned unit developments processed and approved in accordance with Section 118-83 of the Code, the Planning and Zoning Board should be empowered to increase the number of unrelated persons who may reside in an individual dwelling unit, provided that such individual dwelling unit is a part of a multiple-family dwelling. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS that Section 118-83(E) be amended by the addition of a new subparagraph (6) , to provide as follows: 118-83(E) (6) . All residential developments approved pursuant to this section shall conform to the definition of "family" as established in Section 118-11 of the Code, provided, however, that, with respect to multiple-family dwellings only, the Planning and Zoning Board may, upon receipt of written request of the developer and upon a finding that all applicable criteria of this section have been satisfied, increase the number of unrelated persons who may reside in individual dwelling units. Further, the Planning and Zoning Board shall not increase said number unless it is satisfied that the developer has provided such additional open space, recreational areas, parking spaces and public facilities as are necessary to adequately serve the occupants of the development and to protect the adjacent neighborhood.
