OF THE COUNCIL OF THE CITY OF FORT COLLINS
AUTHORIZING THE MAYOR TO EXECUTE A DEED OF EASEMENT
IN FAVOR OF US WEST COMMUNICATIONS, INC. ,
FOR THE AMOUNT OF $800
WHEREAS, the City of Fort Collins is the owner of that certain parcel of
real property located in Larimer County, Colorado, legally described as follows
(hereinafter "the Property") :
A strip of land being the Northwesterly 16.5 (sixteen and one half)
feet of the property described in Book 1894, Page 549, recorded
September 1978 of the records of the Larimer County Clerk and
Recorder, abutting the Southeasterly right-of-way of Larimer County
Road 52E for a distance of 284.7 feet more or less, and being a part
of the Southwest quarter of Section 30, Township 8 North, Range 69
West of the 6th Principal Meridian, situate in the County of
Larimer, State of Colorado; and
WHEREAS, US West Communications, Inc. , wishes to acquire an easement
interest in the Property to construct, reconstruct, operate, maintain and remove
an underground fiberoptic telecommunication cable; and
WHEREAS, under Section 23-111 of the City Code, the City Council must find
by ordinance that any sale or other disposition of real property owned by the
City is in the best interest of the City of Fort Collins.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS
as follows:
1 . That the above-described sale and conveyance of an easement interest
in the Property is in the best interests of the City of Fort Collins.
2. That the sale and conveyance of said easement interest to US West
Communications, Inc. will not materially impair the viability of the City water
utility system and is for the benefit of the citizens of the City.
3. That the Mayor be, and hereby is, authorized to execute a Deed of
Easement conveying an easement interest in the Property to US West
Communications, Inc. , pursuant to the terms of the Deed of Easement.
Introduced, considered favorably on first reading, and ordered published
this 18th day of February, A.D. 1992, and to be presented for final passage on
the 3rd day of March, A.D. 1992.
