HomeMy WebLinkAbout015 - 02/20/1990 - AMENDING CITY CODE ADOPTING THE UNIFORM FIRE CODE ORDINANCE NO. 15, 1990 OF THE COUNCIL OF THE CITY OF FORT COLLINS BEING AN ORDINANCE AMENDING CHAPTER 9 OF THE CODE OF THE CITY OF FORT COLLINS AND ADOPTING A FIRE PREVENTION CODE; NAMELY THE UNIFORM FIRE CODE PROMULGATED BY THE WESTERN FIRE CHIEFS ASSOCIATION AND THE INTERNATIONAL CONFERENCE OF BUILDING OFFICIALS, 1988 EDITION, WITH AMENDMENTS BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS that the following Sections of Chapter 9 of the Code of the City of Fort Collins are hereby amended as follows: Section 1 . That Section 9-1 is repealed and readopted as follows: Section 9-1. Adoption of the Uniform fire Code, 1988 Edition. Pursuant to the authority conferred by the Charter and the laws of the state, there is hereby adopted by the city for the protection of the public health and safety from the hazards of fire and explosion the "Uniform Fire Code, " 1988 Edition, promulgated by the Western Fire Chiefs Association and the International Conference of Building Officials and including articles 1 through 87, inclusive, and appendices, except as any portion of this fire code or appendices is hereinafter deleted, modified or amended in this Chapter. Not less than three (3) copies of this fire code and appendices have been and now are on file in the office of the City Clerk and may be inspected at regular business hours and purchased by the Poudre Fire Authority at a price not to exceed twenty-two dollars ($22. ) per copy. The fire code is hereby adopted and incorporated as fully as if set out at length herein and the provisions shall be controlling within the limits of the city. Section 2. That Section 9-2 is repealed and readopted as follows: Section 9-2. Amendments and additions. The following articles, sections, divisions, subsections, appendices or parts thereof of the Uniform Fire Code, 1988 Edition, are hereby amended, except as noted, to read as follows: (1) Section 2.303 is amended to read as follows: "Sec. 2.303. Board of Appeals "In order to determine the suitability of alternate materials and type of construction and to provide for reasonable interpretations of the provisions of this Code, there shall be and hereby is created a Board of Appeals to be known as the Fire Board of Appeals. The members of the City of Fort Collins Building Review Board, as appointed from time to time, shall constitute the Fire Board of Appeals. The Fire Chief, or his designated representative, shall attend the meetings of such Board. The Board shall adopt reasonable -1- rules and regulations fnr conducting its investigations and shall render all decisions and findings in writing to the Fire Chief, with a duplicate copy to the appellant and may recommend to the executive body such new legislation as is consistent therewith." (2) Section 2.304(b) is amended to delete American Petroleum Institute 1615, "Installation of Underground Petroleum Storage Systems, 1979" , as a recognized standard and add American Petroleum Institute 1615, "Installation of Underground Petroleum Storage Systems, 1987, " American Petroleum Institute 1604, "Removal and Disposal of Used Underground Petroleum Storage Tanks, 1987" Code of Federal Regulations, Title 40, Parts 280 and 281 (Environmental Protection Agency) and National Fire Protection Association (NFPA) Standards as recognized standards. (3) Section 4. 104 is amended to add the following language at the end of the existing section: "Sec. 4. 104. Inspection required. "After a permit is issued, the Fire Chief or his authorized representative may make or require other inspections of any work performed under the permit to ascertain compliance with the provisions of this Code. " (4) Section 4. 108 (7.1), (p.1), and (t.2) are amended to read as follows: "Sec. 4. 108. Permit required. "1 . 1 . Liquefied petroleum gases. Permits are required on all LP tanks one hundred twenty-five (125) gallon water capacity or larger. A plot plan must accompany all permit requests. Permits are also required to install and operate a cylinder exchange site accessible to the public. See Article 82. "p. l . Parade floats. DELETE. "t.2. Tents, canopies and temporary membrane air-supported structures. To erect or operate a tent or air-supported temporary membrane structure having an area in excess of 400 square feet, or any canopy in excess of 400 square feet, except for structures used exclusively for camping. See Articles 12 and 32." (5) Section 9.117, Group H Occupancies is amended to read as follows: "Sec. 9. 117. Definitions "Group H Occupancies: -2- "Division 1. Storage, handling, use or sale of hazardous and highly flammable or explosive materials other than Class I , II or III-A liquids. EXCEPTION: The storage, handling, use or sale of hazardous materials or chemicals that do not exceed the quantities listed in Table No. 9-A of the Building Code are permitted in other occupancies, provided the storage, handling, use or sale of such hazardous materials or chemicals is in compliance with this code. "Division 2. Storage, handling, use or sale of Class I, Class II and Class III-A liquids, dry-cleaning plants using Class I, II or III-A liquids; paint stores with bulk handling; paint shops and spray-painting rooms and shops. EXCEPTION: The storage, handling, use or sale of liquids in quantities that do not exceed those set forth in Table No. 9-A of the Building Code are permitted in other occupancies, provided the storage, handling, use or sales is in compliance with the provisions of this code. "Division 3. Woodworking establishments, planing mills, box factories, buffing rooms for tire rebuilding plants and picking rooms; shops, factories or warehouses where loose combustible fibers or dust are manufactured, processed, generated or stored and pin refinishing rooms. "Division 4. Repair garages not classified as a Group B, Division 1 Occupancy. "Division 5. Aircraft repair hangars. "Division 6. Semiconductor fabrication facilities and comparable research and development areas when the facilities in which hazardous production materials are used are designed and constructed in accordance with Section 911 and when storage, handling and use of hazardous materials is in accordance with this code. EXCEPTION: The specified uses need not be classified as a Group H , Division 6 Occupancy when the quantities of hazardous materials do not exceed those listed in Table No. 9-A, provided the storage, handling and use are in compliance with this code. " (6) Section 10.207 (h) and (i) are amended to read as follows: "Sec. 10.207. Fire apparatus access roads -3- "(h) Turnarounds. All dead-end fire apparatus access roads shall be provided with approved provisions for the turning around of fire apparatus. (i ) Bridges. When a bridge is required to be used as access under this section, it shall be constructed and maintained in accordance with City street design standards and using designed live-loading sufficient to carry the imposed loads of fire apparatus. " (7) Section 10.302(a) and (b) are amended to read as follows: "Sec. 10.302. Maintenance "(a) General . All sprinkler systems, fire hydrant systems, standpipe systems, fire alarm systems, portable fire extinguishers, smoke and heat ventilators, smoke-removal systems and other fire-protective or extinguishing systems or appliances shall be maintained in an operative condition at all times and shall be replaced or repaired where defective. Fire-protective or extinguishing systems coverage, spacing and specifications shall be maintained in accordance with recognized standards at all times. Such systems shall be extended, altered or augmented as necessary to maintain and continue protection whenever any building so equipped is altered, remodeled or added to. All additions, repairs or alterations and servicing shall be in accordance with recognized standards. Unless otherwise required by the chief, semi -annual tests of such systems shall be conducted by qualified persons approved by the chief. EXCEPTION: Systems not required by this or any other code need not be extended, altered nor augmented. " (b) Systems in High-Rise Buildings. The building owner shall be responsible for assuring that the fire and life-safety systems required by Sections 1807 and 1907 of the Uniform Building Code shall be maintained in an operable condition at all times. Unless otherwise required by the chief, semi-annual tests of such systems shall be conducted by qualified persons approved by the chief. A written record shall be maintained and be made available to the inspection authority. " (8) Section 10.306(f) is amended to read as follows: "Sec. 10.306. Automatic fire-extinguishing systems " (f) Group H Occupancies. "I . Division 1. An automatic fire-extinguishing system shall be installed in Group H, Division 1 Occupancies larger than 1500 square feet in floor area. -4- "2. Division 2. An automatic fire-extinguishing system shall be installed in Group H, Division 2 Occupancies exceeding 1500 square feet in area. An automatic fire-extinguishing system shall be installed in rooms of Group H, Division 2 Occupancies when flammable or combustible liquids are stored or handled in excess of the quantities set forth in Table No. 9-A of the Building Code, or any combination of flammable liquids exceeds 240 gallons. An automatic fire-extinguishing system shall be installed in paint spray booths or rooms. "3. Division 3. An automatic fire-extinguishing system shall be installed in Group H, Division 3 Occupancies larger than 3000 square feet in floor area. "4. Division 4. An automatic fire-extinguishing system shall be installed in Group H, Division 4 Occupancies more than one story in height. "5. Division 6. An automatic fire-extinguishing system shall be installed throughout buildings containing Group H, Division 6 Occupancies. The design of the sprinkler system shall be not less than that required under U.B.C. Standard No. 38-1 for the occupancy hazard classifications as follows: LOCATION OCCUPANCY HAZARD CLASSIFICATION Fabrication areas Ordinary Hazard Group 3 Service corridors Ordinary Hazard Group 3 Storage rooms without dispensing Ordinary Hazard Group 3 Storage rooms with dispensing Extra Hazard Group 2 Exit Corridors Ordinary Hazard Group 31 (1) When the design area of the sprinkler system consists of a corridor protected by one row of sprinklers, the maximum number of sprinklers that need be calculated is 13." (9) Section 11.101 (a) and (b) are amended to read as follows: "Sec. 11 .101 Bonfires and outdoor rubbish fires "(a) Permit Required. No person shall kindle or maintain any open fire other than for cooking purposes contained within an enclosure or structure intended for such purpose, without having obtained a permit from the Larimer County Health Department in conformance with the laws of the State of Colorado. This permit is required to be signed by the Chief or his authorized representative before any such fire is ignited. -5- " (b) Location Restricted. No person shall kindle or maintain any bonfire or rubbish fire or authorize any such fire to be kindled or maintained on any private land unless (1) the location is not less than one hundred (100) feet from any structure and adequate provision is made to prevent fire from spreading to within one hundred (100) feet of any structure, or (2) the fire is contained in an approved waste container located safely not less than fifteen (15) feet from any structure. " (10) Section 11.105(c) is amended to read as follows: "Sec. 11 .105. Types and construction of incinerators " (c) Residential Incinerators Shall Not Be Permitted. " (11) Section 11. 107 is amended to read as follows: "Sec. 11 . 107. Incinerators in trailer camps "Any incinerators installed in a trailer camp, mobile home park, or permanent camping park shall be of a commercial type approved by the chief. Such incinerator shall be located not less than five (5) feet from any property line, building, trailer, mobile home or camp site. " (12) Section 11.112(b), exception 2 is amended to read as follows: "Sec. 11 .112. Hours of burning " (b)2. Such burning is done at a distance of more than one hundred (100) feet from any building, structure or other combustible waste matter. " (13) Section 12.104(b) is amended to read as follows: "Sec. 12.104. Doors " (b) Type lock or latch. Exit doors shall be operable from the inside without the use of a key or any special knowledge or effort. Exit doors shall not be locked, chained, bolted, barred, latched or otherwise rendered unusable. All locking devices shall be of an approved type. "EXCEPTIONS: "1 . Exit doors serving individual dwelling units need not comply with this section. "2. All exterior exit doors from buildings or portions thereof with an occupant load of ten or less and the main exit doors from Group B occupancies, may have one -6- key-operated locking bolt or an approved device that will be readily distinguishable as being locked or unlocked, provided there is a readily visible durable sign on or adjacent to the door stating "This door must remain unlocked during business hours". The sign shall be in letters not less than one inch high on a contrasting background. 3. Exit doors from buildings or rooms having an occupant load of ten or less may have a night latch dead bolt, security chain, or other security device which can be readily inactivated provided a sign conforming to exception 2 above is posted. "Manually-operated edge- or surface-mounted flush bolts and surface bolts are prohibited. When exit doors are used in pairs and approved automatic flush bolts are used, the door leaf having the automatic flush bolts shall have no doorknobs or surface-mounted hardware. The unlatching of any leaf shall not require more than one operation. "EXCEPTIONS: "l . Exit doors serving individual dwelling units may be provided with pairs of doors with one leaf having manual edge or surface bolts. "2. One leaf of a pair of exterior doors or one leaf of a pair of doors which serve as single-tenant space may be inactivated with manual edge or surface bolts, provides such doors serve only those buildings or portions thereof having an occupant load of ten (10) or fewer, or serve Group B occupancies having an occupant load of fewer than fifty (50) . In addition, the inactivated leaf shall not have any knob, handle, pushbar, or similar hardware and the leaf shall be clearly identified as not being usable for exist purposes. No door leaf that is required for exit width shall be inactivated. The use of this exception may be revoked by the building official for due cause. " (14) Section 12. 107(a) is amended to read as follows: "Sec. 12.107. Exit illumination " (a) General . Exit illumination shall be provided and maintained in accordance with the Building Code. Exits shall be illuminated when the building or structure is occupied. " Emergency power equipment shall be provided in all occupancies with an occupancy load over one hundred (100) . -7- "EXCEPTION: Group A-4 and churches with an occupant load of fewer than five hundred (500) . (15) Sec. 12.108(e) is added as follows: "Sec. 12. 108. Exit signs " (e) Elevator signs. Except at the ground level , an approved pictorial sign of a standardized design shall be posted adjacent to each elevator call station which specifies IN CASE OF FIRE, DO NOT USE ELEVATORS, USE EXIT STAIRS. " (16) Section 14.108 is amended to read as follows: "Sec. 14.108. False Alarms "In the event of temporary failure of the alarm system or an excessive number of false alarm activations, the chief may order the building owner or occupant to provide standby personnel as defined by Section 25.117 until the system is restored. "An excessive number of false alarms shall be defined as three (3) alarm activations which are not the result of an emergency fire condition within a 30 day period. In the event of an excessive number of false alarms, the chief may order the owner of the building, or party responsible for the building to take whatever actions are necessary to prevent false alarms. These actions may include: repair or replacement of faulty alarm components, addition of tamper proof devices, modification of system design, and repair of other building components which affect alarm system performance. The chief may also require the owner of the building or party responsible for the building to obtain an approved maintenance contract with a qualified fire alarm maintenance technician to provide continuous maintenance service. " (17) Section 32.101 is amended to read as follows: "Sec. 32. 101 . Scope "The provisions of this article shall apply to any tent or temporary membrane structure having an area in excess of 400 square feet, or any canopy in excess of 400 square feet. " (18) Section 35.104(a) is amended to read as follows: "Sec. 35. 104. General requirements " (a) Exit obstructions. Required widths of exit travels shall not be obstructed by the placement of any materials, temporary kiosks, display booths, concession equipment or similar objects while the covered mall building is open. -8- "1. The minimum width of a mall shall be twenty (20) feet. There shall be a minimum of ten (10) feet clear width to a height of eight (8) feet between any projection from a tenant space bordering the mall and the nearest kiosk, vending machine, bench, display or other obstruction to egress. The mall shall be sufficient to accommodate the occupant load immediately tributary thereto. "2. Malls which do not conform to the requirements of this section shall comply with the requirements of Chapter 33 of the Uniform Building Code as adopted by the City of Fort Collins. "EXCEPTION: Sidewalk sales (where the tenants are offering their goods in the common mall space) can be conducted, with the approval of the Chief, in the space immediately adjacent to the retail space. "3. Prior approval must be granted in writing for all sidewalk sales and must be obtained at least twenty-four (24) hours in advance of setting up such a sale. " (19) Section 45.207(3) and (4) are amended to read as follows and (5) and (6) are added as follows: "Sec. 45.207. Limited spraying areas "3. Positive mechanical ventilation is installed, providing a minimum of four (4) complete air changes per hour. 4. All electrical wiring within a twenty (20) foot area shall be maintained in a proper and safe condition. "5. Ignition sources such as open flames, heating torches, pilot lights, hot water heaters, or similar high-heat producing devices shall be prohibited within twenty (20) feet of any limited spray operation. "6. NO SMOKING signs shall be posted in accordance with Section 45. 103 within twenty (20) feet of any limited spray operation. " (20) Section 51.101 is amended to read as follows: "Sec. 51. 101. Scope "This article shall apply to buildings in which hazardous production materials (HPM) are used in excess of quantities shown in Table No. 9-A of the Building Code and which are classified as Group H, Division 6 occupancies. "The storage, handling, and use of hazardous production materials shall comply with the provisions of this article, as well as other -9- applicable provisions of this code. All required devices and systems shall be maintained in an operable condition. "When applied to existing buildings, facilities, and operations, provisions of this Article shall take into consideration the practical difficulties of changing existing facilities and operations. Application of this Article to existing buildings, facilities and operations shall be in accordance with inspection policies and procedures promulgated by the chief, with assistance from a hazardous production materials advisory committee. Members of this committee shall be appointed by the chief from Poudre Fire Authority, industries using hazardous production materials, and other local agencies which regulate hazardous materials." (21) Section 77.106(b) is amended to read as follows: "Sec. 77. 106 General Requirements " (b) The storage of explosives and blasting agents is prohibited within the City of Fort Collins, except for temporary storage in an approved day box with an approved blasting operation, provided however, this prohibition shall not apply to wholesale and retail stocks of small arms and munitions, explosive bolts , explosive rivets or cartridges , or explosive-actuated power tools in quantities of less than five hundred (500) pounds of explosive material . " (22) Section 77.202 is amended to read as follows: "Sec. 77.202. Gunpowder "(a) The following regulations shall apply to the display and handling of smokeless powder, black powder, and primers in commercial establishments. 1 . Not more than twenty ( 20) pounds of smokeless propellants, in containers of one pound maximum capacity, shall be displayed. 2. Display of smokeless powder shall be in original containers. "3. Smokeless powder shall not be repackaged except in original -type containers, and repackaging shall be permitted only in locations designated and approved by the Chief. 4. Not more than one (1) pound of black powder propellant shall be displayed in commercial establishments. "5. The repackaging of black sporting powder shall not be permitted. -10- 6. Small arms primers shall not be stored or displayed with smokeless powder or other explosives. "7. Not more than ten thousand (10,000) small arms ammunition primers may be displayed in commercial establishments. "(b) Commercial stocks of smokeless propellants shall be stored as follows: "1 . In quantities over twenty (20) pounds and not more than four hundred (400) pounds, they shall be stored in Class II magazines. There shall be not more than two hundred (200) pounds any one magazine. "2. Commercial stocks in excess of four hundred (400) pounds and not more than two thousand five hundred (2500) pounds may be stored in a building if the following requirements are met: "(i ) The warehouse or storage room is not accessible to unauthorized personnel . "(ii ) The smokeless propellant stocks are stored in Class II magazines having shelves with not more than a three-foot separation. "(iii ) Not more than four hundred (400) pounds is permitted in any one cabinet. "(iv) Cabinets are located only against walls of the storage room or warehouse with a minimum distance between cabinets of forty (40) feet. "(v) Separation distance between cabinets may be reduced to twenty (20) feet if barricades: "1) are attached to the wall and are at least twice the height of the cabinet. "2) are centered between cabinets and extended at least ten (10) feet beyond the wall toward the center of the room; "3) are constructed of at least two-inch thick lumber, brick or concrete block or of boiler plate at least 1/4 inch thick, or of equivalent materials, and "4) are firmly attached to the building structure at both ends. " (vi ) Smokeless propellant is separated by a fire-resistive wall one hour rating or by a distance of -11- twenty-five (25) feet from materials classified by the U.S. Department of Transportation as flammable liquids, flammable solids and oxidizing materials. "(vii) The building is equipped with an automatic sprinkler system installed in compliance with NFPA No. 13, Standard for the Installation of Sprinkler Systems. "3. Commercial stocks of smokeless propellants not stored in accordance with subsection 1 or 2 of this section, whichever applies, shall be stored in a Class I magazine. "4. If smokeless propellants are stored in the same magazine with black powder propellants, the total quantity of such propellants shall not exceed that set forth for black powder propellants. " (c) Commercial stocks of small arms ammunition primers shall be stored as follows: "1 . Quantities of black powder propellants in excess of one pound (for display purposes) and not to exceed fifty (50) pounds shall be stored in a Class II magazine. "2. Quantities of black powder propellants exceeding fifty (50) pounds shall be stored in Class I magazines. " (d) Commercial stocks of small arms ammunition primers shall be stored as follows: "1. Quantities of up to 750,000 small arms ammunition primers may be stored in a building if not more than 100,000 are stored in any pile and piles are at least fifteen (15) feet apart. 2. Quantities in excess of 750,000 small arms ammunition primers may be stored in a building if the following conditions are met: "(i ) The warehouse or storage room is not accessible to unauthorized personnel . "(ii ) The primers are stored in cabinets. "(iii) Shelves of storage cabinets do not have more than a two (2) foot vertical separation. "(iv) Not more than 200,000 primers are stored in one cabinet. "(v) Cabinets are located only against walls of the warehouse or storage room with a minimum distance between cabinets of forty (40) feet. -12- "(vi ) Separation distance between cabinets may be reduced to twenty (20) feet if barricades are attached to the wall and are at least twice the height of cabinets. Barricades are to be centered between cabinets and shall extend at least ten (10) feet beyond the wall toward the center of the room. They are to be constructed of at least two inch thick lumber, brick, concrete black or of boiler plate at least 1/4 inch thick, or of equivalent materials. Barricades shall be firmly attached to the building structure at both ends. "(vii) Small arms ammunition primers are separated by a fire-resistive wall of one-hour rating or by a distance of twenty-five (25) feet from materials classified by the U.S. Department of Transportation as flammable liquids, flammable solids, and oxidizing materials. "(viii ) The building is equipped with an automatic sprinkler system installed in compliance with NFPA No. 13 Standard for the Installation of Sprinkler Systems. "3. Commercial stocks of small arms ammunition primers not in accordance with subsection 1 or 2 of this section, whichever applies , shall be stored in a Class I magazine. " (23) Section 79.110 is amended to read as follows: "Sec. 79. 110. Operating heating, lighting and cooking appliances "Heating, lighting and cooking appliances which utilize Class I liquids shall not be operated within a building or structure. "EXCEPTION: 1 . R-3 Occupancies. "2. Alcohol burners used in experiments and research. " (24) Section 79. 113 is amended to read as follows: "Sec. 79. 113. Waste petroleum products and flammable or combustible liquids "Flammable or Combustible liquids or any waste liquid containing crude petroleum or its products shall not be discharged into or upon any street, highway, natural or man-made waterway, lake, storm drain, sewer, or the ground. " (25) Section 79. 115(d)(1)(B) is amended to add subsection (v) to read as follows: "Sec. 79. 115. Abandonment and status of tanks -13- " (d) (1) (B) (v) API 1604 (1987) shall be used as a guide for the removal of tanks and the Fire Chief may require other safeguards as deemed necessary." (26) Section 79.115(h) is added to read as follows: "Sec. 79. 115. Abandonment and status of tanks " (h) Site Assessment. If, during the course of a tank removal or abandonment, contamination is discovered that may present a fire or life safety hazard, the Chief may require a site assessment as specified in Section 79.608." (27) Section 79.201(e)2(iii) is added to read as follows: "Sec. 79.201. General " (e)2(iii) Liquids stored for such purposes shall be in original containers or safety cans. " (28) Section 79.203(a) is amended to read as follows: "Sec. 79.203. Liquid storage rooms " (a) General . Quantities of liquids exceeding those set forth in Section 79.201 shall be within a room complying with the requirements of this section. Such rooms shall be classified as a Group H, Division 2 Occupancy. "Liquids storage rooms shall be protected by automatic sprinkler systems installed in accordance with U.B.C. Standard No. 38-1 and Tables Nos. 79.200-C, 79.200-D-1 and 79.200-D-2. In-rack sprinklers shall also comply with Uniform Fire Code Standard No. 81-2. For in-rack sprinklers, alternate lines shall be staggered and multiple levels of sprinkler heads shall be provided with water shields unless separated by horizontal barriers or unless the sprinkler heads are listed for such installations. Racks with solid shelves shall be provided with in-rack sprinklers at every tier or level . "Automatic foam-water systems and automatic aqueous film-forming foam water sprinkler systems may be used when approved by the chief. "AlI liquid storage rooms shall be provided with adequate drainage. Drainage systems shall be sized and designed to carry off any anticipated spill , plus the minimum calculated fire flow of the sprinkler system to a safe location. If connected to a public drain or sewer system, it shall be approved by the authority having jurisdiction for that public drain or sewer system. -14- (29) The second paragraph of Section 79.204(b) is amended to read as follows: "Sec. 79.204. Liquid storage warehouses "All liquid storage warehouses shall be provided with adequate drainage. • Drainage systems shall be sized and designed to carry off any anticipated spill , plus the minimum calculated fire flow of the sprinkler system to a safe location. If connected to a public drain or sewer system, it shall be approved by the authority having jurisdiction for that public drain or sewer system. " (30) Section 79.501 is amended to read as follows: "Sec. 79.501 . Restricted locations "The storage of Class I and Class II liquids in aboveground tanks outside of buildings is prohibited within the City of Fort Collins . "EXCEPTIONS: 1 . Areas zoned for industrial use. Aboveground tanks in IL or IP zones must have approval from the Planning and Zoning Department. "2. Areas zoned for agricultural use. " 3 . General " (d) Leak detection. All underground storage tank systems must be provided with an approved method of continuously detecting leaks from any component of the system which normally contains product . New tank systems must be provided with such leak detection prior to use and existing systems must comply by the dates set forth in Table 79.601-A. All continuous leak detection devices and methods shall be approved by the Fire Chief. Such devices must be maintained in accordance with recognized standards and practices. Such devices shall also be inspected and tested once a year, and the test results maintained for at least one (1) year. "(h) Site assessment. Any tank system that is found to be leaking, has released product, or caused contamination shall be subject to the requirements for a site assessment as specified in Section 79.608. " (32) Section 79.602 is amended to add the following as subsection (b) and label the existing paragraph subsection (a) : "Sec. 79.602. Design and construction of tanks. " (b) Secondary containment. When, in the opinion of the Fire Chief, a proposed new installation or reinstallation of an underground storage tank system poses a significant, immediate hazard to persons or property should a leak occur, the Fire Chief may require that such systems, including tanks, piping and related components, be provided with an approved method of secondary containment." -18- (33) Section 79.605 is amended to reletter subsection (d) to (e) and add a new subsection (d) , as follows: "Sec. 79.605. Testing. " (d) Test method and operator approval . All tank tightness testing methods must be approved by the Fire Chief and the Fire Chief may require that the test be conducted in the presence of the Fire Chief or his authorized representative. Any such tightness test shall be conducted by a person who has been certified by the testing equipment. Any such certification must be current. " (34) Section 79.606 is added to read as follows: "Sec. 79.606. Inventory control . "Accurate daily inventory records shall be maintained and reconciled on all Class I, II and III-A liquid storage tanks for indication of possible leakage from tank and piping. The records shall be kept at the premises and available to the Fire Chief upon request and shall include, as a minimum, records showing, by product, daily reconciliation between sales, use, receipts and inventory on hand. If there is more than one system consisting of tanks serving separate pumps or dispensers for any product, the reconciliation shall be ascertained separately for each tank system. A consistent or accidental loss of Class I, II or III-A liquids shall be immediately reported to the Poudre Fire Authority. "EXCEPTION: Daily inventory records shall not be required when another approved means of continuous leak detection has been installed and maintained as specified in Section 79.601(d) . " (35) Section 79.607 is added to read as follows: "Sec. 79.607. Leak reporting. "Any consistent or accidental loss of Class I, II or III liquids or any other indication of a possible leak from a tank system shall be reported immediately to the Poudre Fire Authority. " (36) Section 79.608 is added to read as follows: "Sec. 79.608 Site assessment. " (a) General . At any time a leak, spill or discharge occurs, a site assessment may be required by the Fire Chief. Such site assessment shall be either a Level I or Level II assessment, as deemed appropriate by the Fire Chief. " (b) Level I site assessment. -19- "1 . A Level I site assessment may be required whenever a minor leak is indicated through monitoring or other means or when a surface spill occurs. "2. Level I site assessment components. A Level I site assessment shall include: "A. The reason that a leak or release occurred or is suspected; "B. The results of equipment tests or analysis done; "C. The estimated extent of any leak, release or spill found; and "D. Any mitigation actions taken. "A Level I site assessment must be submitted to the Poudre Fire Authority within ten days after being ordered by the Fire Chief. "(c) Level II site assessment. "1 . A Level II site assessment may be required whenever there is evidence of a large leak or spill , or when deemed appropriate after a review of a Level I site assessment. 2. Level II site assessment components. A Level II site assessment shall include: A. The type and known or estimated quantity of product leaked: "B. The geology and hydrology of the leak site and surrounding area; "C. Buildings, underground structures, utilities, and water sources which could be impacted; "D. A prediction of plume movement, speed and direction; "E. The extent and severity of current contamination. "F. Other possible sources of contamination. "G. Current and/or potential degree of fire and explosion; and "H. Mitigation plans for current and/or potential fire and explosion hazards. -20- A level II site assessment must be submitted to the Poudre Fire Authority within 60 days after being ordered by the Fire Chief. Periodic updates may be required during the time the Level II site assessment is being conducted. "3. Fees. All Level II site assessments conducted to determine current and/or potential fire and explosion hazards shall be assessed a fee, to be paid to the Poudre Fire Authority to offset any costs incurred by the Authority in reviewing, approving, or confirming such a report. " (d) Record keeping. All Level I and Level II site assessments submitted to the Poudre Fire Authority shall become the property of the Authority and shall be maintained in the Authority's files, as PUBLIC RECORDS, for such period as the Authority deems appropriate. THE AUTHORITY SHALL FORWARD COPIES OF SUCH SITE ASSESSMENTS TO THE CITY OF FORT COLLINS' NATURAL RESOURCES DEPARTMENT AND THE COUNTY HEALTH DEPARTMENT. " (37) Section 79.701 is amended to add a new subsection (c) , to read as follows: "Sec. 79.701 . Materials and design "(c) Secondary containment. When, in the opinion of the Fire Chief, a proposed new installation or reinstallation of an underground storage tank system poses a significant, immediate hazard to persons to property should a leak occur, the Fire Chief may require that such systems, including tanks, piping and related components, be provided with an approved method of secondary containment. " (38) Section 79.702 is amended to read as follows: "Sec. 79.702. Protection against corrosion and galvanic action. "All piping, related fluid-handling components and supports for both underground and aboveground applications where subject to external corrosion shall be fabricated from noncorrosive materials, coated and provided with corrosion protection as specified in Section 79.603. "Dissimilar metallic parts which promote galvanic action shall not be joined together. " (39) Section 79.709 is added to read as follows: "Sec. 79.709. Site assessment. -21- "Any tank system that is found to be leaking, has released product, or caused contamination shall be subject to the requirements of a site assessment, as specified in Section 79.608. " (40) Section 79.802(e) is amended to read as follows: "Sec. 79.802. Inside operations " (e) Control of spills or connection to sewers. Provisions shall be made to prevent flammable or combustible liquids or any waste liquid containing crude oil or its products which may be spilled at the loading or unloading points, from entering public sewer or drainage systems, natural or man-made waterways, or lakes. Connections to such sewers, drains, waterways or lakes by which flammable or combustible liquids might enter shall be provided with separator boxes or other approved means whereby such entry is precluded. Crankcase drainings and other flammable or combustible liquids shall not be dumped into sewers, storm or combustible liquids shall not be dumped into sewers, storm drains, natural or man-made waterways, lakes, upon the ground or any roadway, but shall be stored in tanks or liquid tight drums outside of any buildings until removed from the premises. The authority having jurisdiction over the public drain, sewer system, waterway, or lake shall approve any connections. " (41) Section 79.803(a) is amended to read as follows: "Sec. 79.803. Container-filling facilities " (a) Manual Operations. Class I liquids shall not be run into conductive containers unless the nozzle and containers are electrically interconnected. The provisions of this section shall be deemed to have been complied with where the metallic floor plates on which the container stands while filling are electrically connected to the fill stem or where the fill stem is bonded to the container during filling by means of a bond wire. " (42) Section 79.902(e) is amended to add exceptions, to read as follows: "Sec. 79.902. Storage "(e) Dispensing "EXCEPTIONS: "1 . Dispensing to motor vehicles from aboveground storage tanks is allowed in industrial , tourist, agricultural , commercial and highway business zones and in all other zones when allowed as a condition of a planned unit development as defined, processed and approved according to city and county land use ordinances when approved by -22- the Chief and when such installation conforms to the requirements of Table 79.902. All such dispensing shall be an auxiliary use to the business and shall not include sales to the public. Dispensing uses allowed under this exception for existing non-conforming land uses shall be approved by city and county land use agencies through an expansion of an existing non-conforming use process conforming to city and county land use ordinances. "2. Dispensing to motor vehicles from aboveground tanks is allowed at farms, construction sites and similar occupancies as defined in Article 79, Division X. Any such exception must be in compliance with Article 79, Division X. All leak-testing devices shall be tested annually by the owner or occupant of the property on which they are located. All test results shall be maintained and available to the chief upon request. " (44) Section 79.902(g) is amended to add an exception, to read as follows: "Sec. 79.902. Storage " (g) Inventory control . "EXCEPTION: Daily inventory records are not required when an approved means of continuous leak detection has been installed and maintained as specified in Section 79.601(d) . " (45) In Section 79.903(b), exception, (3) is amended to read as follows and (4) , (5), (6), (7), and (8) are added as follows: "Sec. 79.903. Dispensing services " (b) Supervision "EXCEPTION: "3. Dispensing equipment complies with both of the following: "(i ) The amount of fuel dispensed is limited in quantity by a preprogrammed card, or dispensing devices shall be programmed or set to limit uninterrupted fuel delivery to twenty-five (25) gallons and shall require a manual action to resume continued delivery. (ii ) Product delivery hoses are equipped with a listed emergency breakaway device designed to retain liquid on both sides of the breakaway point. Such devices shall be installed and maintained in accordance with manufacturer's instructions. 4. Emergency shutoff must be available to the public and conspicuously marked. 5. A telephone or manual alarm tied to a central station must be readily available for emergency use. 6. Poudre Fire Authority must approve any training materials and contacts which oil companies have applicant sign. -27- "7. A 2A-20BC fire extinguisher must be available and located within seventy-five (75) feet of pumps. "8. All other requirements of this Division IX shall apply unless specifically altered under this exception. " (46) Section 79. 1504(b) is amended to read as follows: "Sec. 79. 1504. Drainage. " (b) Connection to Sewers. Emergency drainage systems, if connected to public sewers or discharged into public waterways, shall be equipped with traps or separators. Any such connection or discharge shall be approved by the authority having jurisdiction of the public sewer or waterway. " (47) Article 80 is amended in its entirety to read as follows: "ARTICLE 80 HAZARDOUS MATERIALS "Sec. 80. 101 . Scope "This article shall apply to materials not otherwise covered in this code which are highly flammable, or which may react to cause fires or explosions, or which by their presence create or augment a fire or explosion hazard, or which because of the toxicity, flammability or liability to explosion render fire fighting abnormally dangerous or difficult; also to flammable or combustible liquids which are chemically unstable and which may spontaneously form explosive compounds or undergo spontaneous reactions of explosive violence or with sufficient evolution of heat to be a fire hazard. Hazardous materials shall include such materials as flammable solids, corrosive liquids, poisonous gases or highly toxic, radioactive, oxidizing, unstable or reactive, hypergolic or pyrophoric as defined in Article 9. Also, any substance or mixture of substances which is an irritant, a strong sensitizer, or which generates pressure through exposure to heat, decomposition or other means. "Sec. 80.102. Permits "For a permit to store, transport on site or use corrosive liquids, oxidizing materials, organic peroxides, nitromethane, ammonium nitrate, ammonium nitrate fertilizers and fertilizer mixtures, highly toxic materials, pyrophoric materials, hypergolic materials, cryogenic materials, poisonous gases or hazardous materials, see Section 4. 101 . "For a permit to store, handle or use radioactive materials, see Section 4. 101 . -28- "All hazardous materials, permits shall be posted in a conspicuous location on the premises. "Sec. 80. 103. General Requirements " (a) The manufacture, storage, on-site transportation or use of hazardous materials shall be safeguarded with such protective facilities as public safety requires. " (b) The chief may require the following: "1 . The separation or isolation of any materials that in combination with other substances may bring about a fire or explosion or may liberate a flammable or poisonous gas. "2. The separation of occupancies or buildings from other storage when the quantity stored constitutes a fire or life hazard. " (c) Defective containers which permit leakage or spillage shall be disposed of or repaired in accordance with recognized safe practices; no spilled materials shall be allowed to accumulate on floors or shelves. " (d) Where kept for retail sale in containers or packages usual to the retail trade, storage shall be neat and orderly and shelves shall be of substantial construction. "(e) Where specific requirements are not otherwise established, storage, transportation or use of hazardous materials shall be in accordance with nationally recognized standards or good practices. "(f) Visible hazard identification signs as specified in U.F.C. Standard No. 79-3 shall be placed at all entrances to and in locations where hazardous materials are stored, handled or used in quantities requiring a permit. " (g) Satisfactory provisions shall be made for containing or neutralizing spills or leakage of hazardous materials which may occur during storage, handling, transportation or use. " (h) Materials safety data sheets shall be readily available for all hazardous materials on the premises. " (i ) For storage cabinet, transportation and storage tank requirements, see Sections 80. 109, 80.110 and 80.111 . "Sec. 80. 104. Oxidizing Materials -29- " (a) Oxidizing materials shall be stored in cool , ventilated, dry locations and separated from organic materials. Bulk oxidizing materials shall not be stored on or against combustible surfaces. " (b) Oxidizing materials shall be stored separately from flammable liquids, flammable solids, combustible materials, hazardous chemicals, corrosive liquids and such other noncompatible materials as may be determined by the chief. "Sec. 80.105. Radioactive Materials " (a) Durable, clearly visible signs of warning of radiation dangers shall be placed at all entrances to areas or rooms where radioactive materials are used or stored. In addition, each container in which radioactive materials are used, stored or transported shall bear a durable, clearly visible, appropriate warning sign. Such signs shall bear the three-bladed radiation symbol in magenta or purple on a yellow background in accordance with nationally recognized good practice. "(b) Signs are not required for storage of manufactured articles other than liquids, such as instruments or electronic tubes or apparatus of which radioactive materials are a component part, and luminous compounds, when securely packed in strong containers, provided the gamma radiation at any surface of the package is less than 10 milliroentgens in 24 hours. " (c) When not in use, radioactive materials shall be kept in adequately shielded fire-resistant containers of such design that the gamma radiation will not exceed 200 milliroentgens per hour of equivalent at any point of readily accessible surface. "Sec. 80. 106. Reactive and Unstable Materials " (a) General . Reactive and unstable materials shall be kept apart from open flames, excessive heat and other potential ignition sources. Storage shall be controlled to prevent excessive temperatures and pressures and to prevent contamination. Uncontaminated content of broken or cracked bags, packages or other containers shall be transferred to new and clean containers before storing. Other spilled materials and discarded containers shall be promptly gathered up and destroyed in an approved manner. Internal combustion motor vehicles or lift trucks shall not be parked or stored in a room or compartment where such materials are located. Electrical equipment shall conform to the requirements of the Electrical Code. " (b) Organic Peroxides. A detached, well -isolated, ventilated and unheated storage building with walls having not less than a -30- two-hour fire-resistive rating constructed in accordance with the Building Code, a noncombustible floor and lightweight insulated roof shall be provided for the storage of 50 pounds or more of organic peroxides. If not adequately protected by a fast-acting deluge-type automatic sprinkler system, the storage building shall be located the following minimum distances from flammable or combustible liquid storage, combustible materials in the open and from any other building or highway. Care shall be taken to avoid rough handling or contamination of these chemicals. Readily legible warning signs and placards shall be prominently placed in the storage and processing areas. " (c) Nitromethane. A suitable isolated outdoor storage area shall be provided for nitromethane. Hazardous processing shall not be permitted in the vicinity of this storage area . Nitromethane shall be stored in the drums in in which it is received or in an underground tank with suitable corrosion protection and a minimum of 2 feet of earth over the tank or in barricaded tanks aboveground. All flooring in storage and handling area shall be of noncombustible material and shall be without drains, traps, pits or pockets into which any molten ammonium nitrate could flow and be confined in case of fire. "2. Each storage pile of bags or other authorized packages and containers of such materials shall not exceed 12 feet in height, 12 feet in width and 30 feet in length. Such pile units shall be separated by a clear space of not less than 36 inches in width from the base to the top of the piles, serving as cross aisles. At least one service or main aisle in the storage area shall be not less than 4 feet in width. A clearance of not less than 30 inches shall be maintained from building walls and partitions and of not less than 36 inches from ceilings or roof structural members with a minimum of 18 inches from sprinklers. "3. Ammonium nitrate storage areas shall be separated by a space of 30 feet or by a tight noncombustible partition from storage of organic chemicals, corrosive liquids, compressed gases, flammable and combustible materials or other contaminating substances such as sulphur, coal , flour and metallic powders such as zinc, copper and magnesium where storage of such materials is permitted with ammonium nitrate. 4. Quantities of ammonium nitrate or ammonium nitrate fertilizer having no organic coating, in the form of crystals, flakes, grains or pills, including fertilizer grade, dynamite grade, nitrous oxide grade and technical grade ammonium nitrate and ammonium nitrate phosphate (containing 60 percent or more ammonium nitrate by weight) of more than 50 tons total weight shall be stored in a well -ventilated building. Such building shall be of one-hour fire-resistive or noncombustible construction as specified in the Building Code or shall 1 be equipped with an approved automatic sprinkler system. In populated areas, quantities of 2500 tons or more shall be stored in well - ventilated buildings of one - hour fire-resistive or noncombustible construction as specified in the Building Code, equipped with an approved automatic sprinkler system. No combustible materials or ammonium nitrate sensitizing contaminants shall be stored in this building. "5. Storage of ammonium nitrate, coated or mixed with organic anticaking materials, except compounded blasting agents, shall not be permitted in populated and congested areas . Outside such areas, quantities of 500 tons or less may be -32- stored in well -ventilated buildings of one- hour fire-resistive or noncombustible construction as specified in the Building Code, equipped with an approved automatic sprinkler system. "Sec. 80. 107. Highly Toxic Materials " (a) Highly toxic materials shall be segregated from c`her chemicals and combustible and flammable substances by storage out of doors or in a room or compartment separated from other areas by a one-hour occupancy separation constructed as specified in the Building Code. The storage room shall be provided with adequate drainage facilities and natural or mechanical ventilation to the outside atmosphere constructed as specified in the Mechanical Code. "EXCEPTION: Approved storage cabinets for hazardous materials be used for limited amounts approved by the chief. "(b) Legible warning signs and placards stating the nature and location of the highly toxic materials shall be posted at all entrances to areas where such materials are stored or used. "Sec. 80. 108. Poisonous Gases "(a) Storage of poisonous gases within buildings shall be in rooms of at least one-hour fire-resistive construction as specified in the Building Code and having natural or mechanical ventilation adequate to remove leaking gas. Such ventilation shall not discharge to a point where the gases may endanger any person, domestic animal or wildlife. "EXCEPTION: Poisonous gases may be stored or used in a room without one-hour fire-resistive construction and mechanical ventilation, provided: "1 . Two approved self-contained breathing apparatus units are provided in the immediate area. "2. Atmosphere is monitored and an audible and visual alarm is activated when the maximum safe level for long-term exposure is reached. "3. Excess flow control is provided at the bulk source. "4. Emergency shutdown controls are provided internal and external to the area of use. -33- "5. Approved gas cylinder cabinets which provide adequate ventilation and fire protection are utilized. " (b) Legible warning signs stating the nature of hazard shall be placed at all entrances to locations where poisonous gases are stored or used. "Sec. 80. 109. Storage Cabinets for Hazardous Materials " (a) General . When provisions of this code require that hazardous materials be stored in storage cabinets, such cabinets shall be in accordance with this section. Cabinets shall be conspicuously labeled in red letters on contrasting background HAZARDOUS - KEEP FIRE AWAY. " (b) Construction. Cabinets may be constructed of wood or metal . Cabinets shall be listed or constructed in accordance with the following: "A. Unlisted metal cabinets. Metal cabinets shall be of steel having a thickness of not less than 0.0043 inch. Doors shall be well fitted, self-closing and equipped with a latching device. Joints shall be riveted or welded and shall be tight fitting. The bottom of a cabinet designed for the containment of liquids shall be liquid tight to a height of at least two inches. "B. Wooded cabinets. Wooden cabinets, including the doors, shall be of not less than one inch exterior grade plywood, or equivalent, which is compatible with the material being stored. Doors shall be well fitted, self-closing and equipped with a latch. The bottom of a cabinet designed for the containment of liquid shall be liquid tight to a height of at least two inches. Cabinets shall be painted with an intumescent-type paint. "Sec. 80. 110. Designation of Cargo "No person shall operate any vehicle transporting any hazardous materials unless at the time of such transportation there are affixed to both sides, the front and the rear of the vehicle placards and identification numbers in conformity with Title 49, Code of Federal Regulations, 1981. "Sec. 80. 111 . Identification of Aboveground Tanks and Vessels " (a) All aboveground storage tanks, pressure vessels and containers over 100 gallons (water capacity) permanently installed, mounted or affixed and used for the storage of flammable and combustible liquids, compressed gases, or hazardous chemicals -34- regulated by this article, shall be identified in accordance with U.F.C. Standard No.79-3. "EXCEPTION: Portable tanks not permanently mounted, temporary tanks used on construction sites, drum storage and packaged materials in containers of 55-gallon or less capacity. "Labels shall conform with U.F.C. Standard No. 79-3 for size and color and shall be affixed to tank, vessel or container so as to be conspicuously visible at all times. " (b) When any tank covered in this section is housed within a building , the building shall have the same hazard identification label in a conspicuous location on the exterior of the building." (48) Section 82.102(a) is amended to read as follows: "Sec. 82.102. Permits and reports of installations "(a) Permit. For a permit to install or maintain an LP-Gas container or operate LP-Gas vehicles see Section 4. 108. A permit shall also be required to install and operate a cylinder exchange site at a location normally accessible to the public. See Section 4. 108. " (49) Section 82.104(b) is amended to read as follows: "Sec. 82. 104. Location of containers " (b) Maximum Capacity Within Established Limits. Within the limits established by law restricting the storage of liquefied petroleum gas for the protection of heavily populated or congested commercial areas, the aggregate capacity of any one installation shall not exceed 2,000 gallons water capacity. "EXCEPTION: This capacity limitation may be altered at the discretion of the chief after consideration of special features such as topographical conditions, nature of occupancy and proximity to buildings, capacity of proposed tanks, degree of private fire protection to be provided and facilities of the local fire department. The storage of liquefied petroleum gas shall conform to the provisions of the local zoning ordinance. " (50) The exception in Section 87. 102 is hereby deleted. (51 ) Section 87. 103(a) shall be amended to read as follows: "Sec. 87. 103. Fire safety during construction -35- "(a) General . Buildings under construction shall comply with the provisions of this Article. The extent of the fire safety precautions required by this section shall be in relation to the degree of hazard presented by the construction to the project in question, adjacent buildings and surrounding wildland area. " (52) Section 87.103(o) shall be amended to read as follows: "Sec. 87.103. Fire safety during construction " (o) Emergency Communications. When required by the chief, adequate means of emergency communication with emergency services shall be provided within reasonable distance of the construction site. Construction site address and name shall be posed at the site. " (53) Section 87.105(a) is amended to read as follows: "Sec. 87. 105. Fire safety during demolition " (a) General . Demolition of buildings shall comply with the provision this section and, where applicable, Sections 87. 103 and 87. 104. A demolition plan shall be approved by the chief before a permit is issued by the Building Inspection Department. " (54) Appendix I-A is deleted. (55) Appendix I-B is amended to read as follows: "APPENDIX I-B LIFE SAFETY REQUIREMENTS FOR EXISTING HIGH-RISE BUILDINGS "Section 1 .1 Scope "These provisions apply to existing high-rise buildings constructed prior to the adoption of this appendix and which house Group B, Division 2 offices or Group R, Division 1 Occupancies, each having floors used for human occupancy located more than seventy-five (75) feet above the lowest level of fire department vehicle access. "Section 1 .2 General " (a) Existing high-rise buildings as specified in Section 1 . 1, above, shall be modified to conform to not less than the minimum provisions specified in Table No. 1-A and as enumerated within this appendix. "(b) The provisions of this appendix shall not be construed to allow the elimination of fire protection systems or a -36- reduction in the level of fire safety provided in buildings constructed in conformance with previously adopted codes. "Section 1 .3 Compliance Data " (a) After the original adoption of this appendix, the Fire Marshal shall duly notify the owners whose buildings are subject to the provisions of this appendix. Upon receipt of such notice, the owner shall , subject to the following time limits, take necessary actions to comply with the provisions of this appendix. "(b) Plans and specifications for the necessary alterations shall be filed with the Fire Marshal within eighteen (18) months after the date of owner notification. Work on the required alterations to the building shall commence within thirty (30) months of the date of owner notification and such work shall be completed within five years from the date of owner notification. "(c) The Fire Marshal shall grant necessary extensions of time when it can be shown that the specified time periods are not physically practical or pose an undue hardship. The granting of an extension of time for compliance shall be based upon the showing of good cause and subject to the filing of an acceptable systematic progressive plan of correction with the Fire Marshal . "Section 1 .4 Authority of the Fire Marshal "For the purpose of applying the provisions of this appendix, the Fire Marshall shall have the authority to consider alternative approaches and grant necessary deviations from this appendix as follows: " (a) Allow alternative materials or methods of compliance if such alternate materials or methods of compliance will provide levels of fire and life safety equal to or greater than those specifically set forth in this appendix. " (b) Waive specific individual requirements if it can be shown that such requirements are not physically possible or practical and that a practical alternative cannot be provided. "Section 1.5 Appeals Board "Appeals of the determinations of the Fire Marshal in applying the provisions of this code may be made by an appeal directed to the Board of Appeals as established by Section 2.303 of this code. "Section 1 .6 Specific Provisions and Alternates -37- "(a) Specific Provisions. The following provisions shall apply when required by Table No. 1-A. "1 . Type of construction. Buildings classified in the Uniform Building Code as Type II-N, III-N or V-N construction shall be equipped with an approved automatic sprinkler system installed in accordance with Uniform Building Code Standard No. 38-1 . " EXCEPTION : Installation of meters or backflow preventers for the connection to the waterworks system need not be provided unless required by other regulations of the authority having jurisdiction. 2. Fire department communication system. When it is determined by test that the portable fire department communication equipment is ineffective, a communication system acceptable to the Fire Authority shall be installed within the existing high-rise building to permit emergency communication between fire-suppression personnel . "3. Single-station smoke detectors. Single-station smoke detectors conforming to Uniform Building Code Standard No. 43-6, Part II, shall be installed within all dwelling units or guest rooms in accordance with the manufacturer's installation instructions. In dwelling units, the detector shall be mounted on the ceiling or wall at a point centrally located in the corridor or area giving access to each separate sleeping area. When sleeping rooms are located on an upper level , the detector shall be installed at the center of the ceiling directly above the stairway within the unit. In efficiency dwelling units, hotel suites and in hotel guest rooms, detectors shall be located on the ceiling or wall of the main room or hotel sleeping room. When actuated, the detector shall provide an audible alarm in the sleeping area of the dwelling unit, hotel suite or guest room in which it is located. Such detectors may be battery operated. 4. Manual fire alarm system. An approved manual fire alarm system connected to a central proprietary or remote station service, or an approved manual fire alarm system which will provide an audible signal at a constantly attended location, shall be provided. Such system shall include a graphic annunciator panel in the main lobby or other location approved by the Fire Authority. "5. Occupant voice notification system. An approved occupant voice notification system shall be provided. Such system -38- shall provide communication from a location acceptable to the Fire Authority and shall permit voice notification to at least all normally occupied areas of the building. The occupant voice notification system may be combined with a fire alarm system, provided that the combined system has been approved and listed for such use. The sounding of a fire alarm signal in any given area or floor shall not prohibit voice communication to other areas or floors. Combination systems shall be designed to permit voice transmission to override the fire alarm signal , but the fire alarm shall not terminate in less than three (3) minutes. "6. Vertical shaft enclosures. Openings through two or more floors, except mezzanine floors, which contain a stairway or elevator shall be provided with vertical shaft enclosure protection as specified herein. Such floor openings, when not enclosed by existing shaft enclosure construction , shall be protected by one-hour fire-resistive-rated shaft enclosure construction. For floor openings which are enclosed by existing shaft enclosure construction having fire-resistive capabilities similar to wood lath and plaster in good condition, 1/2 inch gypsum wallboard or approved 1/4 inch thick wired glass is acceptable. Wired glass set in a steel frame may be installed in existing shaft enclosure walls but shall be rendered inoperative and be fixed in a closed position. Openings through two (2) or more floors for other than stairways or elevators, such as openings provided for piping, ducts, gas vents, dumbwaiters , and rubbish and linen chutes, shall be provided with vertical shaft enclosure protection as specified for stairways and elevators. "EXCEPTIONS: Openings for piping, ducts, gas vents, dumbwaiters and rubbish and linen chutes of copper or ferrous construction are permitted without a shaft enclosure, provided that the floor openings are effectively fire-stopped at each floor level . 7. Shaft enclosure opening protection. Openings other than those provided for elevator doors in new vertical shaft enclosures constructed of one-hour fire-resistive construction shall be equipped with approved fire assemblies s having a fire-protection rating of not less than one hour. Openings other than those provided for elevator doors in existing vertical shaft enclosure shall be equipped with approved twenty (20) minute-rated fire assemblies, 1-3/4 inch solid wood doors or the equivalent thereto. Doors shall be either self-closing or automatic closing and automatic latching. -39- "8. Manual shutoff of HVAC systems. Heating, ventilating and air conditioning systems shall be equipped with manual shutoff controls installed at an approved location when required by the Fire Authority. 9. Automatic elevator recall system. Elevators shall be equipped with an approved automatic recall system as required by Section 1807(h)2 of the Uniform Building Code. "10. Unlocked stairway doors. Exit doors into exit stairway enclosures shall be maintained unlocked from the stairway side on at least every fifth floor level . All unlocked doors shall bear a sign stating ACCESS ONTO FLOOR THIS LEVEL. Stairway doors may be locked, subject to the following conditions: "A. Stairway doors which are to be locked from the stairway side shall have the capability of being unlocked simultaneously without unlatching upon a signal from an approved location. "B. A telephone or other two-way communications system connected to an approved emergency service which operates continuously shall be provided at not less s than every fifth floor in each required stairway. "11 . Stair shaft ventilation. Stair shaft enclosures which extend to the roof shall be provided with an approved manually openable hatch to the exterior having an area not less than sixteen (16) square feet with a minimum dimension of two (20) feet. "EXCEPTIONS: 1 . Stair shaft enclosures complying with the requirements for smokeproof enclosures. 2. Stair shaft enclosures pressurized as required for mechanically operated smokeproof enclosures to a minimum of 0. 15 inch and a maximum of 0.50 inch water column. 12. Elevator shaft ventilation. Elevator shaft enclosures which extend to the roof shall be vented to the outside with vents whose area shall be not less than 3-1/2 percent of the area of the elevator shaft, with a minimum of three (3) square feet per elevator. "EXCEPTION: Where energy conservation or hoistway pressurization requires that the vents be normally closed, automatic venting by -40- actuation of an elevator lobby detector or power failure may be accepted. "13. Posting of elevators. A permanent sign shall be installed in each elevator cab adjacent to the floor status indicator and at each elevator call station on each floor reading IN FIRE EMERGENCY, DO NOT USE ELEVATOR -- USE EXIT STAIRS, or similar wording approved by the Fire Marshal . "EXCEPTION: Sign may be omitted at the main entrance floor level call station. "14. Exits. A. General . Every floor of an existing high-rise building shall have access to two separate means of egress, one of which may be an existing exterior fire escape or an exterior stairway not less than thirty (30) inches in clear width. The stairway may be constructed with an eight (8) inch maximum rise and nine (9) inch minimum run, provided the greatest riser height and largest tread run do not exceed the smallest by more than 3/8 inch. The adequacy of fire escapes shall be demonstrated to the satisfaction of the Fir- Marshal . "B. Fire escapes. Access to fire escapes may be any one of the following: "(i ) Through a room between the corridor and the fire escape if the door to the room is operable from the corridor side without the use of any key, special knowledge or effort. "(ii) By a door to a fire escape operable from the interior without the use of any key, special knowledge or effort. "(iii ) By a window operable from the interior. Such window shall have a minimum net clear dimension of twenty-nine (29) inches when open. The sill shall be not more than thirty (30) inches above the floor and landing. "C. Protection of exterior openings. When a fire escape is accepted as one of the required means of egress, openings onto the fire escape landing and openings within ten (10) feet horizontally of the landing shall be protected in a manner acceptable to the Fire Marshal . -41- "15. Exit corridor construction. Corridors serving as an exit for an occupant load of thirty (30) or more shall have walls and ceilings of not less than one- hour fire-resistive construction as required by the Uniform Building Code. Existing walls may be surfaced with wood lath and plaster in good condition or 1/2 inch gypsum wallboard for corridor walls and ceilings and occupancy separations when approved. 16. Exit corridor openings. Openings in corridor walls and ceilings shall be protected by not less than 1-3/8 inch solid bonded wood core doors, approved 1/4 inch thick wired glass, approved fire dampers conforming to Uniform Building Code Standard No. 43-7, or by equivalent protection in lieu of any of these items. Transoms shall be fixed closed and covered with 1/2 inch Type X gypsum wallboard or equivalent material installed on both sides of the opening. "17. Exit corridor door closers. Exit doors into corridors shall be equipped with self-closing devices or shall be automatic closing by actuation of a smoke detector. When spring hinges are used as the closing device, not less than two such hinges shall be installed on each door leaf. 18. Exit corridor dead-ends. The length of dead-end corridors serving an occupant load of more than thirty (30) shall not exceed twenty (20) feet. "19. Interior finish. The interior finish in exit corridors, exit stairways and extensions thereof shall conform to the provisions of Chapter 42 of the Uniform Building Code. "20. Exit stairway illumination. When the building is occupied, exit stairways shall be illuminated with lights having an intensity of not less than one (1) foot candle at the floor level . Such lighting shall be equipped with an independent alternate source of power such as a battery pack or on-site generator. "21 . Exit corridor illumination. When the building is occupied, exit corridors shall be illuminated with lights having an intensity of not less than one (1) foot candle at the floor level . Such lighting shall be equipped with an independent alternate source of power such as a battery pack or on-site generator. "22. Exit stairway exit signs. The location of exit stairways shall be clearly indicated by illuminated exit signs. Such exit signs shall be equipped with an independent alternate source of power, such as a battery pack or -42- on- site generator , or shall be of an approved self-illuminating type. "23. Exitway exit signs. Illuminated exit signs shall be provided in all exitways and located in such a manner as to clearly indicate the direction of egress. " (57) Appendix II-E is deleted. (58) Appendix III-A is amended to read as follows: "APPENDIX III-A FIRE-FLOW REQUIREMENTS FOR BUILDINGS "1 . SCOPE "This appendix is the procedure for determining fire-flow requirements for all buildings or portions of buildings hereafter constructed. This appendix is not intended to apply to structures other than buildings. The fire-flow requirement is the quantity of water in gallons per minute needed to control an anticipated fire in a building or group of buildings. The chief shall establish the minimum residual pressure and the flow duration to be used when determining fire flow. "2. DEFINITIONS "FIRE AREA is the total floor area in square feet for all floor levels within the exterior walls, or under the horizontal projection of the roof of a building. Each portion of a building separated by one or more area separation walls constructed in accordance with the Building Code may be considered as separate fire areas for the purposes of determining the required fire flow. -45- 113. MODIFICATIONS "Fire-flow requirements may be modified downward for isolated buildings or group of buildings in rural areas or small communities where the development of full fire-flow requirements is impractical . "Fire flow may be modified upward where conditions indicate an unusual susceptibility to group fires or conflagrations. An upward modification shall not be more than twice that required for the building under consideration. "4. FIRE-FLOW REQUIREMENTS FOR BUILDINGS "The minimum fire-flow requirements for one- and two-family dwellings shall be 1,000 gallons per minute. "EXCEPTION: Fire flow may be reduced 50 percent when the building is provided with an approved automatic sprinkler system. "The fire flow for buildings other than one- and two-family dwellings shall be not less than that specified in Table No. III-A-A. "EXCEPTION: The required fire flow may be reduced up to 75 percent when the building is provided with an approved automatic sprinkler system. (60) Appendix III-D is deleted and a new ppendix III-D is added as follows: "APPENDIX III-D RESIDENTIAL SPRINKLERS ALTERNATIVE DESIGN CRITERIA "Section 1.0 Purpose, scope and limitations "1 . 1 Purpose. This Appendix describes the design alternatives for fire access, fire fighting water supplies, and fire alarm systems which may be used in new residential buildings and projects when buildings and/or projects are protected by approved residential fire sprinkler systems. "1 .2 Scope. Residential fire sprinkler systems may be used in any Group R occupancy as defined by the Uniform Building Code, which are not otherwise required to be protected by a commercial fire sprinkler system. Examples of these buildings are single-family dwellings duplexes, lodging houses, apartment buildings, condominiums, townhouses, zero lot-line homes, dormitories, fraternity and sorority houses, group homes, and hotels and motels. This Appendix shall not apply to buildings of four or more stories or exceeding 55' in height, or buildings defined as Group I by the Uniform Building Code. "1 .3 Limitations. Residential fire sprinkler systems , in conjunction with other requirements of the Uniform Fire and Uniform Building Codes and their Appendices and related standards, are intended to control a fire and maintain a tenable environment within a residence. Residential fire sprinklers are not intended as a substitute for manual firefighting forces, but when used in conjunction with current Poudre Fire Authority service levels can substantially increase the probability of survival in a fire and decrease the potential for property loss and endangering neighbors. This Appendix permits the omission of sprinkler coverage in those areas of a building where life-threatening fires are unlikely to originate. "1 .4 Extent of project coverage. All buildings within a residential project, or portions of a mixed commercial -residential project, using the alternative design criteria of this Appendix, shall be equipped with approved residential or commercial fire sprinkler systems. "1 .5 Storage sheds and vehicle garages. Sprinkler coverage may be omitted in storage sheds which are used for only the storage of household goods and personal belongings; and detached vehicle garages for passenger vehicles of residents. -48- "1 .6 Detached agricultural buildings. Sprinkler coverage may be omitted in detached agricultural buildings or buildings defined as Group M by the Uniform Building Code, such as barns, stables, and similar buildings when they are directly related to the residential use and they do not constitute a fire exposure hazard to dwellings . "1 .7 Extended modifications. The design criteria detailed in this Appendix may be extended, relaxed, modified, or waived when all buildings are protected with fully conforming commercial fire sprinkler systems and when , in the opinion of the Chief , firefighting and/or rescue operations would not be impaired. "1 .8 Reference to other sections of the Fire Code. Unless specifically modified in this Appendix, all requirements of the Uniform Fire Code, as adopted and amended, and related standards and policies shall apply. "Section 2.0 Definitions. "2. 1 Building Code. The edition of the Uniform Building Code, or other building code, amended and adopted by Larimer County, Colorado and the City of Fort Collins and Town of Timnath. "2.2 Commercial fire sprinkler system. An automatic fire extinguishing system consisting of a water supply, a system of piping, and sprinkler heads designed, installed and maintained in accordance with National Fire Protection Association Standard 13, Uniform Building Code Standard 38-1, and Fire Code Sections 10.301 and 10.302. "2.3 County. Larimer County, Colorado "2.4 Dead-end fire apparatus access road. A fire apparatus access road that does not provide a direct connection to a public street or approved private drive, except at its point of origin. "2 5 Fire apparatus access road. Any public street or private drive required to be used as a point of access for firefighting or other emergency purpose. "2.6 Fire code. The edition of the Uniform Fire Code or other fire code as adopted and amended by the Poudre Valley Fire Protection District, City of Fort Collins or Town of Timnath. "2.7 Private drive. A street, alley, parking lot, or other thoroughfare owned and maintained by a private party, homeowners association, neighborhood group, or other similar party. "2.8 Public street. A dedicated public street, alley, or other thoroughfare regulated and maintained by the city, county or state. -49- 2.9 Residential fire sprinkler system. An automatic fire extinguishing system consisting of a water supply, a system of piping and sprinkler heads designed, installed, and maintained in accordance with Appendix III-E of this Code. "2. 10 Required fire flow. The quantity of water needed to control a fire in a specific building and prevent its spread to adjoining properties under normal anticipated conditions. "Required Fire Flow" shall be designated in gallons per minute (GPM) at specific residual pressures. "2. 11 Storage sheds. Buildings used for storage of household goods and personal effects of residents. Storage sheds shall not exceed 120 square feet in area nor seven feet (Y) in height and shall not be used for the storage of flammable liquids or hazardous materials . "EXCEPTION: Quantities of flammable liquids and hazardous materials used in the maintenance and operation of the residence or residential project not exceeding ten (10) gallons. "2. 12 Traffic engineer. The person lawfully empowered to regulate vehicular traffic on public or private property. "2. 13 Vehicle garages. Detached external buildings used for the storage of vehicles owned by residents. Vehicle garages shall be limited in size to that necessary for the storage of only two vehicles and shall not be used for repair work or storage of flammable liquids or hazardous materials except as allowed in Section 2. 11 . "EXCEPTION: Larger vehicle garages shall be permitted, provided each set of two parking stalls is separated by one hour fire resistive construction, as described in the Building Code. "2. 14 Water supply. The provision of water for firefighting purposes . Water supply shall be public or private water distribution systems or approved stored water sources. "Section 3.0 Fire apparatus access roads "3. 1 General . For buildings or projects provided with approved residential fire sprinkler systems, fire apparatus access roads shall be provided and maintained in accordance with the provisions of this section . Design and maintenance criteria for all other fire apparatus access roads shall be in accordance with Section 10.207 of the Fire Code and applicable Poudre Fire Authority standards and policies. "3.2 Where required. Fire apparatus access roads shall be required for every building hereafter constructed when any portion of an exterior wall of the first story is located more than three hundred -50- feet (300' ) from fire department vehicle access. Measurement of the 300' distance shall be as a hoseline would be advanced around the exterior of the building and shall not pass through the building. "3.3 Construction and surface requirements. Fire apparatus access roads shall be designed and maintained to support the imposed loads of fire apparatus and shall have a surface which provides all -weather driving capabilities. City or county design standards shall apply when designing and installing fire apparatus access roads. "3.4 Width. The minimum unobstructed width of a fire apparatus access road shall be not less than twenty (20) feet. Total public street or private drive width shall be in accordance with applicable County standards, or as determined by County traffic engineer. "EXCEPTION: Fire apparatus access road width for private drives serving detached single-family dwellings and Group M occupancies, as defined by the Building Code, may be reduced to fifteen (15) feet. "3.5 Vertical clearance. All fire apparatus access roads shall have an unobstructed vertical clearance of not less than thirteen feet, six inches (13'6") . "3.6 Turning radius. The turning point of fire apparatus access roads shall be a minimum of twenty feet (20' ) inside and forty feet (40' ) outside and all turns shall maintain the unobstructed width requirement set forth in Section 3.4 above. "3.7 Dead-end fire apparatus access roads. All dead-end fire apparatus access roads exceeding one hundred and fifty feet (150' ) in length, shall be provided with a turnaround sufficient to allow a standard fire pumper to back up and reverse direction. Deadend fire apparatus access roads exceeding three hundred feet (300' ) in length shall be provided with an eighty foot (80' ) diameter cul -de-sac, drive-around access through a parking lot with conforming turning radius, or an approved second point of access. "EXCEPTION: Private drives serving individual detached single family dwellings may be of unlimited length, without turnaround provisions. "3.8 Bridges. Bridges used as part of fire apparatus access roadways shall be designed, constructed, and maintained in a manner sufficient to carry the imposed loads of fully-loaded fire apparatus. When bridges are used, applicable County design standards shall be used. "3.9 Grade. The gradient for fire apparatus access roads shall not exceed eight percent (8%) . -51- "EXCEPTION: Private drives serving individual detached single family dwellings may exceed an 8% grade when, in the opinion of the Chief, firefighting or rescue operations would not be impaired. "3. 10 Obstruction. The required width of any fire apparatus access roadway shall not be obstructed in any manner, including parking of vehicles. When parking obstructions are anticipated, approved "NO PARKING FIRE LANE" signs shall be posted. When required, these signs shall be placed on one side of roadways twenty-eight feet (28' ) or less in width and on both sides of roadways twenty-four (24' ) or less in width. "3. 11 Second point of access. All dead-end fire apparatus access roads serving 150 dwelling units or fewer, or a dwelling unit density of 15 dwelling units per acre or fewer, shall be provided with an approved second point of access when the deadend fire apparatus access road exceeds 1,320' in length. "Dead-end fire apparatus access roads serving 150 dwelling units or a dwelling unit density of more than 15, shall be provided with an approved second point of access when the dead-end fire apparatus road exceeds 660' in length. "EXCEPTION: Extensions of deadend fire apparatus access roads serving detached single-family dwellings may be allowed when geographical conditions make a second point of access impossible, and when, in the opinion of the Chief, firefighting or rescue operations would not otherwise be impaired and adjoining dwellings and other buildings do not present a fire exposure hazard to each other. "Section 4.0 Water supply. "4. 1 General . An approved water supply capable of providing the required fire flow for fire protection, shall be provided to all premises upon which buildings or portions of building are hereafter constructed. Residential fire sprinklers shall not be considered as a substitute for approved water supplies, except as modified in this section. "4.2 Required fire flow. The required fire flow shall be determined in accordance with Appendix III -A . All water distribution systems shall be installed in accordance with applicable standards of the water purveyor having jurisdiction. "4.3 Water supply requirements. Water supply requirements within the City of Fort Collins and Poudre Valley Fire Protection District shall be in accordance with applicable City or County standards and the Fire Code. -52- "EXCEPTION: In areas where a water distribution system is fully-developed and incapable of providing the required fireflow but capable of providing the calculated sprinkler demand, approved residential fire sprinklers may be considered as satisfying the intent of the Fire Code. In area where exposure to fire hazards exist, the Chief may require additional fire hydrants. "4.4 Fire hydrant spacing. The distance from a primary fire hydrant to the most distant point of a fire apparatus access road required for fire access, shall not exceed six hundred feet (600' ) . When secondary fire hydrants are required, the distance from the most distant point of a fire apparatus access road required for fire access shall not exceed one thousand feet (1000' ) . "EXCEPTION: In rural areas where standard fire hydrant spacing is impractical due to the size of the individual lots, the Chief may allow extension of hydrant spacing distances. "Section 5.0 Fire alarm systems. "5. 1 General . Fire alarm systems shall be installed in residential buildings as detailed in this section. "5.2 Definitions. For the purpose of this section, the following words/phrases shall have the meaning indicated. "5.3 Multi -family dwellings. Multi -family dwellings three (3) stories or more in height or containing fifteen (15) or more dwelling units and with interior corridors serving as the primary exit for dwelling units. "5.2.2 Hotels, motels, and dormitories. Hotels, motels, and dormitories three (3) stories in height or containing twenty (20) or more guest rooms, and with interior corridors serving as the primary exit for guest rooms. "5.2.3 Group homes. Group living facilities such as board and care homes for the elderly, group homes for mentally, physically, and/or emotionally disabled persons, lodging houses, fraternity and sorority houses half-way houses, and similar group living facilities. "5.3 Extent of coverage. Alarm systems installed in multi-family dwellings, hotels, motels and dormitories shall include smoke detection and manual activation in corridors, intervening rooms, and other common areas. The evacuation alarm shall also be connected to the sprinkler flow switch. Group homes shall be provided ith approved, 100-volt powered, single-station smoke detection in all living areas. Such equipment shall be installed in accordance with the manufacturer's instructions. An evacuation alarm shall be provided and connected to the sprinkler flow switch. -53- "5.4 Dwelling unit smoke detectors. Nothing in this Appendix shall preempt the smoke detector requirement of Section 1210(A) of the Building Code. Individual smoke detectors shall be installed in all dwelling units in accordance with the Building Code. " (61) Appendix III-E is added as follows: "APPENDIX III-E RESIDENTIAL FIRE SPRINKLER SYSTEMS DESIGN, INSTALLATION AND MAINTENANCE STANDARDS "Section 1.0 Purpose, scope and limitations. "1 . 1 Purpose. This appendix describes automatic fire sprinkler systems which will contribute to the reduction of loss of life and injuries due to fires in residential occupancies. "1 .2 Scope. This appendix describes the requirements for the design, installation and maintenance of residential fire sprinkler systems. These systems may be installed in Group R occupancies as defined by the Uniform Building Code. This appendix shall not apply to buildings of four or more stories in height or exceeding 55' in height or buildings defined as Group I occupancies by the Uniform Building Code. "1 .3 Limitations. Residential fire sprinkler systems , in conjunction with other requirements of the Uniform Fire and Building Codes and their related appendices and standards, are intended to control a fire within a dwelling unit while maintaining a tenable environment for people within that dwelling. Residential sprinkler systems are not intended as a substitute for manual firefighting forces, but when used in conjunction with Poudre Fire Authority service levels can substantially increase the probability of survival in a fire and decrease the potential for property loss and fire exposure to neighboring dwelling units. This appendix permits omission of sprinkler coverage in building areas where life threatening fires are unlikely to originate. "1 .4 Extent of coverage. All buildings utilizing the alternative design standards of Appendix IIID and Chapter 13 of the Uniform Building Code shall be equipped with approved residential sprinkler systems, approved commercial sprinkler systems or approved combined sprinkler systems. "EXCEPTION 1 . Sprinkler coverage may be omitted in detached storage buildings and detached vehicle garages as defined in Sections 2. 11 and 2. 13 of Appendix IIID. "EXCEPTION 2. Sprinkler coverage may be omitted in detached agricultural buildings as defined in the Uniform Building Code when directly related to the residential use and where they do not constitute a fire exposure hazard to residential buildings. -54- "Section 2.0 - REFERENCE TO NATIONAL FIRE PROTECTION ASSOCIATION (NFPA) STANDARDS FOR ONE AND TWO FAMILY DWELLINGS AND MOBILE HOMES. "2. 1 Residential Fire Sprinkler Systems installed in one and two family dwellings and mobile homes shall be designed, installed and maintained in accordance with NFPA 13D with the following modifications. "2.2 Additional Maintenance Requirements to NFPA 13D, Sec. 1-4. "1-4.1 Occupant responsibility for maintenance. It shall be the responsibility of occupants, whether owner, tenant or other ownership category, to maintain all portions of the sprinkler systems installed within the dwelling unit in an operable condition at all times. This shall include keeping heads free of paint and excessive accumulations of dirt, keeping heads free of all obstructions, maintaining all valves in the open position, and maintaining all alarm devices in operation. "1-4.2 Inspection upon change of ownership or occupant. Upon any change in ownership or occupant, it shall be the responsibility of the owner of the dwelling, or his or her authorized representative, to obtain an inspection of the sprinkler system within that dwelling. The purpose of this inspection shall be to verify that the system is in servic a and components are not damaged or impaired. Any improvements or repairs required as a result of this inspection shall be completed before the Fire Authority will issue a certificate of successful inspection. The Chief may assess an inspection fee based on the costs incurred to provide the inspection. If Poudre Fire Authority is not notified of a change in ownership or occupant, the Authority may conduct an inspection within a reasonable time after discovery of the fact that the change in ownership or occupant occurs. "1-4.3 Documentation. Development and construction documents of all dwelling units and buildings equipped with required residential fire sprinkler systems, shall have wording included to show the requirement for the sprinkler system and maintenance provisions. "1-4.4 Impairment. If a sprinkler system is impaired or removed from service for any reason, Poudre Fire Authority shall be immediately notified by the property owner and/or occupant. -55- 1-4.5 Construction changes. All construction within a building or dwelling unit equipped with a required residential fire sprinkler system shall take into consideration the impact on the sprinkler system. A certified residential fire sprinkler installer shall be contacted to make necessary repairs, additions, and/or modifications. "1-4.6 Repairs, additions, and modifications. All repairs, additions, and modifications to residential fire sprinkler systems shall be done by a certified residential sprinkler installed. Plan review and permit procedures as detailed in Section 2.3, shall apply to such work. "2.3 Additional installation requirements to NFPA 13D, Sec. 1-5. "1-5.2. 1 Installer certification. Residential fire sprinkler systems shall only be installed by contractors holding a valid residential fire sprinkler installation certificate. Contractors eligible to receive installation certificates are: "A. Fire sprinkler contractors licensed in the City of Fort Collins. "B. Master plumbers licensed in the County or State. "1-5.2.2 On site installer. At least one (1) installer on each job site shall hold a valid residential fire sprinkler installer's certificate. "1-5.2.3 Plan review. All residential fire sprinkler systems shall be approved through the Poudre Fire Authority plan review procedures before installation. At least one (1) set of approved plans shall be maintained by the installer at each installation site. "1-5.2.4 Building permit. All residential fire sprinkler systems shall be installed under a building permit separate from the general permit issued for the total building. "1-5.3 Tests. All tests required by this design standard shall be witnessed by a Poudre Fire Authority representative. The installer shall request these tests at least 24 hours in advance. Poudre Fire Authority may allow tests to be witnessed by on-site quality control inspectors or inspectors of other public agencies, at the discretion of the Chief. -56- "1-5.4 Tests required. The following tests shall be conducted on residential fire sprinkler systems. "A. Underground water service flush. "B. Piping hydrostatic test at 200 PSI before the installation of sheet rock, sprinkler heads and pressure relief device for a duration of two (2) hours. "C. A design area flow test. "D. Final hydrostatic test of 150 PSI for a duration of one (1) hour. "E. Final test of all system components. "1-5.5 System approval . The installed residential fire sprinkler system shall be approved by Poudre Fire Authority before a certificate of occupancy is issued. "1-5.6 Care of residential sprinkler heads. Residential sprinkler heads shall be handled with sufficient care to prevent pre- installation damage . Prior to installation, heads shall be stored and handled in original manufacturer's packing material . Heads shall not be installed before sheetrock or similar materials. Heads installed before final interior finishes are applied shall be protected by manufacturer supplied protective covers. Heads found damaged shall be replaced. Heads exposed to high heat prior to installation shall not be installed. "1-5.7 Installation aesthetics. All system design and installation shall take into consideration the final appearance such that the final installation presents the minimum detraction from the buildings aesthetic appearance. "2 4 Additional Water Supply Requirements to NFPA 13D, Sec. 2-2 and Sec. 2-3. "2-2.1 Water flow test. All fire sprinkler systems shall be designed to water flow tests data calculated to the maximum daily use. "2-2.2 Backflow prevention. All fire sprinkler systems connected directly to a public water supply system shall be provided with a backflow prevention device acceptable to the water purveyor having jurisdiction. -57- "2-3. 1 Lawn Irrigation. All fire sprinkler systems using multi-purpose piping systems supplying lawn irrigation systems or similar high water usage devices shall be provided with an automatic mechanism which shuts off the flow to the irrigation system or similar device when the sprinkler system is activated . "2.5 Additional Requirements to Valves and Drains, NFPA 13D, Sec. 3-1 . 3-1 .4 Pressure relief. Each residential fire sprinkler system shall be provided with a pressure relief device on the system side of the backflow prevention device. This relief valve shall be set to operate at 175 PSI and positioned so that any water released will not damage building components or contents. "2.6 Additional Requirements to Alarms, NFPA 13D, Sec. 3-6. "3-6. 1 Exterior alarm. All waterflow alarm devices shall provide an audible signal on the exterior. "3-6.2 Power connection. All electrical waterflow alarm devices must be connected to the bathroom power circuit. "2 7 Additions to Position of Sprinklers, NFPA 13D, Sec. 4-2. "4-2.4 Heat producing devices. Sprinkler heads shall be positioned so that they are not adversely affected by heating, ventilation, and air conditioning equipment. Manufacturer's specifications shall be consulted for specific design limitations. "4-2.5 Ceiling fans. When ceiling fans are used, sprinkler heads shall be located so that fan blades do not obstruct spray pattern or delay response time. Rooms exceeding nine (9' ) feet by nine (9' ) feet in size with a ceiling fan shall contain a minimum of two (2) sprinklers. "2.8 Additions to Location of Sprinklers, NFPA 13D, Sec. 4-6. "4-6 Exception No. 3: Sprinklers may be omitted from garages which have no openings into the dwelling unit, open attached porches, carports and similar structures. "4-6. 1 Hazard areas. All hazard areas, in which high heat output is produced during normal operations, shall have listed commercial sprinkler heads with a fusing temperature of 165 to 212 degrees. Single sprinklers -58- installed in these areas shall not be considered as a design sprinkler in demand calculations. "Section 3.0 - REFERENCE TO NATIONAL FIRE PROTECTION ASSOCIATIION (NFPA) STANDARDS FOR OTHER THAN ONE AND TWO FAMILY DWELLINGS AND MOBILE HOMES 3. 1 Residential Fire Sprinkler Systems installed in other than one and two family dwellings and mobile homes shall be designed, installed and maintained in accordance with NFPA 13R with the following modifications. "3.2 Additional installation requirements to NFPA 13R, Sec. 2-1 . "2-1 .4 Plan review. All residential fire sprinkler systems shall be approved through the Poudre Fire Authority plan review procedures before installation. At least one (1) set of approved plans shall be maintained by the installer at each installation site. "2-1 .5 Building permit. All residential fire sprinkler systems shall be installed under a building permit separate from the general permit issued for the total building. "2-1 .6 Tests. All tests required by this design standard shall be witnessed by a Poudre Fire Authority representative. The installer shall request these tests at least 24 hours in advance. Poudre Fire Authority may allow tests to be witnessed by on-site quality control inspectors or inspectors of other public agencies, at the discretion of the Chief. "2-1 .7 Tests required. The following tests shall be conducted on residential fire sprinkler systems. "A. Underground water service flush. "B. Piping hydrostatic test at 200 PSI before the installation of sheet rock, sprinkler heads and pressure relief device for a duration of two (2) hours. "C. A design area flow test. "D. Final hydrostatic test of 150 PSI for a duration of one (1) hour. "E. Final test of all system components. "2-1 .8 System approval . The installed residential fire sprinkler system shall be approved by Poudre Fire Authority before a certificate of occupancy is issued. -59- "3.3 Additions to Design and Installation, NFPA 13R, Sec. 2-2. "2-2.2 Certification. Residential fire sprinkler systems shall only be installed by contractors holding a valid residential fire sprinkler installation certificate. Contractors eligible to receive installation certificates are: "A. Fire sprinkler contractors licensed in the City. "B. Master plumbers licensed in the City and State. "2-2.3 On site installer. At least one (1) installer on each job site shall hold a valid residential fire sprinkler installer's certificate. "2-2.4 Care of residential sprinkler heads. Residential sprinkler heads shall be handled with sufficient care to prevent pre- installation damage . Prior to installation, heads shall be stored and handled in original manufacturer's packing material . Heads shall not be installed before sheetrock or similar materials. Heads installed before final interior finishes are applied shall be protected by manufacturer supplied protective covers. Heads found damaged shall be replaced. Heads exposed to high heat prior to installation shall not be installed. "2-2.5 Installation aesthetics. All system design and installation shall take into consideration the final appearance such that the final installation presents the minimum detraction from the building' s aesthetic appearance. "3.4 Additions to Water Supply, NFPA 13R, Sec. 2-7. "2-3.3 Water flow test. All fire sprinkler systems shall be designed to water flow tests data calculated to the maximum daily use. "2-3.4 Back flow prevention. All fire sprinkler systems connected directly to a public water supply system shall be provided with a backflow prevention device acceptable to the water purveyor having jurisdiction. "2-3.5 Lawn irrigation. All fire sprinkler systems using multi-purpose piping systems supply lawn irrigation systems or similar high water usage devices shall be provided with an automatic mechanism which shuts off the flow to the irrigation system or similar device when the sprinkler system is activated. -60- "3.5 Additional Requirements to Valves and Drains, NFPA 13L, Sec. 2-4.1 "2-4.1 .4 Pressure relief. Each residential fire sprinkler system shall be provided with a pressure relief device on the system side of the backflow prevention device. This relief valve shall be set to operate at 175 PSI and positioned so that any water released will not damage building components or contents. "2-4.1 .5 Control valve accessibility. Each control valve assembly shall be accessible to firefighters without entering a dwelling unit. If an exterior access panel or door is used, provisions shall be made to insure that the control valve assembly is protected from freezing. Access panels or doors to control valve assemblies shall be designated with an approved sign and secured in a closed and locked position. "3.6 Additions to Alarms, NFPA 13R, Sec. 2-4.6. "2-4.6.1 Alarm location. On buildings with no interior common areas, the alarm bell or horn shall be mounted on the exterior of the building facing the street from which building is addressed. Unless specifically altered by Poudre Fire Authority, the alarm bell or horn shall be positioned directly over the fire department connection. In buildings with interior common areas such as corridors, foyers, offices, recreation areas or other similar areas, an additional bell (s) or horn(s) shall be provided in these areas. Exterior alarm devices shall be positioned high enough to be seen above landscaping. "2-4.6.2 Alarm power source. All flow switches and alarm horns or bells shall be powered from a common building power circuit independent from individual dwelling units. "2-4.6.3 Remote monitoring. Residential fire sprinkler systems with over one hundred (100) sprinkler heads shall be monitored at an approved location which has 24-hour supervision in accordance with Section 10.309 of this Code. "3.7 Additions to Position of Sprinklers, NFPA 13R, Sec. 2-5. 1 .7. "2-5. 1 .7.4 Heat producing devices. Sprinkler heads shall be positioned so that they are not adversely affected by heating, ventilation, and air conditioning equipment. Manufacturer's specifications shall be -61- consulted for specific design limitations. "2-5.1.7.5 Ceiling fans. When ceiling fans are used, sprinkler heads shall be located so that fan blades do not obstruct spray pattern or delay response time. Rooms exceeding nine (9' ) feet by nine (9' ) feet in size with a ceiling fan shall contain a minimum of two (2) sprinklers. "3.8 Addition to Location of Sprinklers, NFPA 13R, Sec. 2-6. "2-6. Exception No. 2: Sprinklers may be omitted from small clothes closets where the least dimension does not exceed 3 ft (0.9m� and the area does not exceed 24 square feet (2.2m ) and the walls and ceiling are surfaced with noncombustible or limited combustible materials as defined by NFPA 220, Standard on Types of Building Construction. This exception shall not apply to closets in residential buildings where occupants may be unusually likely to cause a fire or have a history of firestarting behavior. "2-6.1 Hazard areas. All hazard areas, in which high heat output is produced during normal operations, shall have listed commercial sprinkler heads with a fusing temperature of 165 to 212 degrees. Single sprinklers installed in these areas shall not be considered as a design sprinkler in demand calculations. "3.9 Addition to Maintenance, NFPA 13R, Sec. 2-7. "2-7. 1 Occupant responsibility for maintenance. It shall be the responsibility of occupants, whether owner, tenant or other ownership category, to maintain all portions of the sprinkler systems installed within the dwelling unit in an operable condition at all times. This shall include keeping heads free of paint and excessive accumulations of dirt, keeping heads free of all obstructions, maintaining all valves in the open position, and maintaining all alarm devices in operation. "2-7.2 Inspection upon change of ownership or occupant. Upon any change in ownership or occupant, it shall be the responsibility of the owner of the dwelling, or his or her authorized representative, to obtain an inspection of the sprinkler system within that dwelling. The purpose of this inspection shall be to verify that the system is in service and components are not damaged or impaired. Any improvements or repairs required as a result of this inspection shall be completed before the Fire Authority will issue a certificate of successful inspection. The Chief may assess an -62- inspection fee based on the costs incurred to provide the inspection. If Poudre Fire Authority is not notified of a change in ownership or occupant, the Authority may conduct an inspection within a reasonable time after discovery of the fact that the change in ownership or occupant occurs. "2-7.3 Common areas. It shall be the responsibility of the building owner, homeowners' association, or other party responsible for maintenance of common and external areas to maintain in an operable condition all portions of sprinkler systems in these areas at all times. This shall include all items listed in Section 6.2, above. "2-7.4 Inspections. All sprinkler systems in multi -family buildings shall be included in Poudre Fire Authority's fire sprinkler system inspection program. In addition to inspection of sprinkler system components in the building's common area, the building management shall provide the inspector access to all unoccupied dwelling units for inspection purposes. If the inspector has cause to believe that the sprinkler systems in occupied dwelling units are impaired, inactive, or damaged, he or she shall request entry into such units. If entry is denied, the inspector shall obtain an inspection warrant, as detailed in Section 2. 107 of this Code. "2-7.5 Inspection upon change of ownership or occupant. Upon any change in ownership or occupant, it shall be the responsibility of the owner of the dwelling, or his or her authorized representative, to obtain an inspection of the sprinkler system within that dwelling. The purpose of this inspection shall be to verify that the system is in service and components are not damaged or impaired. Any improvements or repairs required as a result of this inspection shall be completed before the Fire Authority will issue a certificate of successful inspection. The Chief may assess an inspection fee based on the costs incurred to provide the inspection. "2-7.6 Documentation. Development and construction documents of all dwelling units and buildings equipped with required residential fire sprinkler systems, shall have wording included to show the requirement for the sprinkler system and maintenance provisions. -63- 2-7.7 Impairment. If a sprinkler system is impaired or removed from service for any reason, Poudre Fire Authority shall be immediately notified by the property owner and/or occupant. "2-7.8 Construction changes. All construction within a building or dwelling unit equipped with a required residential fire sprinkler system shall take into consideration the impact on the sprinkler system. A certified residential fire sprinkler installer shall be contacted to make necessary repairs, additions, and/or modifications. "2-7.9 Repairs, additions and modifications. All repairs, additions, and modifications to residential fire sprinkler systems shall be done by a certified residential sprinkler installed. Plan review and permit procedures as detailed in Section 3.2 shall apply to such work. (62) Appendix VI-A is .eleted. (63) Appendix VI-C is deleted.
