OF THE COUNCIL OF THE CITY OF FORT COLLINS
AMENDING CHAPTER 12, ARTICLE II OF THE
CODE OF THE CITY OF FORT COLLINS
RELATING TO GARBAGE AND REFUSE
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS:
Section 1 . That Chapter 12-16 of the Code of the City of Fort Collins
shall be amended by the deletion of the definitions City Manager, Recyclable
materials and Recycling agent.
Section 2. That Chapter 12-17 of the Code of the City of Fort Collins
shall be amended to read as follows:
Sec. 12-17. Purpose and policy.
The purpose of this Article is to protect the public health,
safety and welfare by regulating the accumulation, storage,
transportation and disposal of refuse and rubbish to prevent
conditions that may create fire, health or safety hazards, harbor
undesirable pests or impair the aesthetic appearance of the
neighborhood. The City Council shall use every means at its
disposal , including its police powers, for the enforcement of this
Article.
Section 3. That Chapter 12-18(c) of the Code of the City of Fort Collins
shall be amended to read as follows:
Sec. 12-18. Refuse and rubbish accumulation prohibited.
(c) No owner or occupant of any premises which are adjacent to
any portion of an open area, vacant lot, ditch, detention pond,
storm drain or watercourse shall cause the accumulation of refuse,
rubbish, or storage of any material within or upon such adjacent
areas.
Section 4. That Section 12-36 of the Code of the City of Fort Collins is
hereby amended by the deletion of subparagraph (d) and amending subparagraph (a)
to read as follows:
Sec. 12-36. Collection and disposal of refuse and rubbish.
(a) The occupant and the owner of any premises wherein any
refuse or rubbish is produced or accumulated shall be jointly and
severally responsible to provide for collection service and removal
of refuse and rubbish to the degree of service necessary to maintain
the premises in a clean and orderly condition. They shall not
contract or arrange for such collection and removal except with
solid waste collectors licenced by the city under §§ 14-411 through
15-421 . An individual may dispose of his or her own refuse and
rubbish, provided that it is properly disposed of at the Larimer
County Landfill or at any other disposal site which is approved by
the state, in conformity with all city and county regulations.
Section 5. That Section 12-37 of the Code of the City of Fort Collins is
hereby amended by the deletion of subparagraph (b) and amending the title and
subparagraph (c)- to read as follows:
Sec. 12-37. Tampering with refuse or rubbish container prohibited.
(c) No owner of any dog, cat or other pet shall permit, whether
by act or omission, that pet to damage or open any refuse container
or scatter the contents.
Introduced, considered favorably on first reading, and ordered published
this 18th day of December, A.D. 1990, and to be presented for final passage on
the 15th day of January, A.D. 1991 .
