HomeMy WebLinkAbout128 - 12/04/1990 - AMENDING CITY CODE RELATING TO THE BUILDING REVIEW BOARD ORDINANCE NO. 128, 1990 OF THE COUNCIL OF THE CITY OF FORT COLLINS AMENDING THE CODE OF THE CITY OF FORT COLLINS RELATING TO THE BUILDING REVIEW BOARD WHEREAS, on July 3, 1990, the City Council adopted Resolution 90-100 establishing a policy for the elimination of alternate positions on boards and commissions; and WHEREAS, Resolution 90-100 provides that the Council liaison assigned to each board or commission which currently has alternate positions shall make a recommendation for changes in the composition of the board or commission to which he or she is assigned, in order to achieve the eventual elimination of alternate positions; and WHEREAS, the Council liaison to the Building Review Board is recommending that the two (2) alternate positions on the Building Review Board be eliminated at this time. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS as follows: Section 1 . That Section 2-102 of the Code relating to the Building Review Board be amended to read as follows: Sec. 2-102. Membership; term. (a) The board shall consist of seven (7) members appointed by the City Council , three (3) of whom shall be qualified by experience and/or training to knowledgeably consider technical matters related to building construction. Appointments shall specify the term of office of each member in order to achieve overlapping tenure. (b) Each member shall serve a term of (4) years without compensation. All members shall be subject to removal by the City Council . If a vacancy occurs on the board, it shall be filled by the City Council for the remaining unexpired portion of the term. Section 2. That Section 5-27(1) (a) and (b) of the Code of the City of Fort Collins be amended to read as follows: Sec. 5-27. Amendments and deletions to code. (1) " (a) In order to determine the suitability of alternate materials or alternate methods of construction and to provide for reasonable interpretations of the provisions of this code, there shall be and is hereby created a Building Review Board consisting of seven (7) members, three (3) of whom are qualified by experience and training to pass upon matters pertaining to building construction. In addition to such members, the Building Permits and Inspections Administrator and the Chief of the Fire Prevention Bureau shall be ex officio members of the board without vote. The administrator shall act as secretary of the board. " "(b) The seven (7) members of the Building Review Board shall be appointed by the City Council and shall serve for terms of four (4) years at the pleasure of the City Council . Members shall serve without pay. The appointment of any member may be terminated for no duties and for a cause. " Section 3. That Section 5-82(1) of the Code of the City of Fort Collins be amended to read as follows: Sec. 5-82. Amendments to code adopted. (1) Section 203, Board of Appeals, is amended to read as follows: "In order to determine the suitability of alternate materials and methods of installation and to provide for reasonable interpretations of this code and appeal any decisions of the Building Official pertaining to the electrical code adopted herein, the Building Review Board as set forth in section 204 of the Building Code of the City of Fort Collins shall make such determinations as provided therein. Upon request of the appellant and under its own authority, the board shall augment its membership with two (2) licensed and duly registered master electricians. " Introduced, considered favorably on first reading, and ordered published this 20th day of November, A.D. , 1990, and to be presented for final passage on the 4th day of December, A.D. , 1990.
