HomeMy WebLinkAbout122 - 12/04/1990 - AMENDING CITY CODE TO COMPLY WITH THE WATER METERING ACT OF COLORADO ORDINANCE NO. 122, 1990 OF THE COUNCIL OF THE CITY OF FORT COLLINS AMENDING SECTIONS 26-97 AND 26-98 TO COMPLY WITH THE WATER METERING ACT OF COLORADO WHEREAS, on April 5, 1990, the Governor of the State of Colorado approved House Bill No. 90-1106 concerning the mandatory use of metered water delivery in the State of Colorado; and WHEREAS, said House Bill No. 90-1106 requires that the City provide a metered water delivery system for any new construction serviced by the City, commencing July 1, 1990; and WHEREAS, in order to bring the City into conformance with the purpose and intent of said House Bill No. 90-1106, the Council has determined that Sections 26-97 and 26-98 of the Code of the City should be amended. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS as follows: Section 1 . That Section 26-97(e) of the Code of the City of Fort Collins is hereby amended to read as follows: Sec. 26-97. Water service lines; general regulations. (e) Meter settings. A meter set shall be installed in the service line for all connections made to the water utility. The meter set shall be installed in accordance with the rules, regulations, policies and procedures of the utility, and be readily accessible to utility personnel . Section 2. That Section 26-98 of the Code of the City of Fort Collins is hereby amended to read as follows, with the subsequent relettering of the last subparagraph: Sec. 26-98. Water meters; requirements and installation. (a) Water meters shall be required for the following services: (1) All residential services connected to the utility pursuant to a permit issued on or after July 1, 1990; (2) All service to nonresidential customers; (3) All services outside the corporate city limits. (b) A residential customer who is receiving unmetered water service may have a meter installed by and at the expense of the utility, upon application to the utility for such installation. Any unmetered residential customer who has had a water meter installed after July 1, 1990, and has paid a fee or charge to the utility for such meter installation shall be entitled to a refund of the full amount paid to the utility. (c) If, during the installation of an exterior meter for a customer who has required metered service it is determined that the water service line does not conform to the provisions of Section 26-97(a) , the entire cost of repairing or replacing such water service line shall be borne by the customer. (d) All water meters and setting devices shall be of a type, size and design approved by the Director and furnished by the utility. Each meter shall be inspected and properly adjusted by the utility prior to installation.
