OF THE COUNCIL OF THE CITY OF FORT COLLINS
VACATING A PORTION OF THE RIGHT-OF-WAY
OF EVERGREEN DRIVE IN THE
REPLAT OF BOCKMAN SUBDIVISION
WHEREAS, the Council of the City of Fort Collins has been petitioned
by the owner of the Replat of Bockman Subdivision to vacate a portion of
the right-of-way of Evergreen Drive located in the Replat of Bockman
Subdivision, more particularly described below; and
WHEREAS, City agencies and utility companies have been contacted and
report no objection to the proposed vacation; and
WHEREAS, there will be no cost to the City in making the proposed
vacation; and
WHEREAS, the rights of the residents of the City of Fort Collins will
not be prejudiced or injured by said vacation.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT
COLLINS that the right-of-way of Evergreen Drive located on the Replat of
Bockman Subdivision, more particularly described as follows, to wit:
A part of Evergreen Drive dedicated on Bockman Subdivision,
situate in the Southeast 1/4 of Section 16, Township 7 North,
Range 69 West of the Sixth P.M. , City of Fort Collins, County of
Larimer, State of Colorado, which begins at the Southeast corner
of Lot 1, Bockman Subdivision and run thence along the arc of a
50.00 foot radius curve to the left a distance of 157.08 feet,
the long chord of which bears S 00°00'30" W 100.00 feet; thence
N 00°00'30" E 6.00 feet; thence along the arc of a 44.00 foot
radius curve to the right a distance of 138.23 feet, the long
chord of which bears N 00000 ' 30" E 88 . 00 feet ; thence
N 00000'30" E 6.00 feet to the point of beginning, containing 886
square feet more or less;
be, and the same hereby is, vacated, abated and abolished; provided,
however that said right-of-way as above described shall be retained for
utility and drainage purposes.
Introduced, considered favorably on first reading, and ordered
published this 19th day of April , A.D. 1988, and to be presented for final
passage on the 3rd day of May, A.D. 1988.
