HomeMy WebLinkAbout059 - 05/03/1988 - AMENDING CITY CODE RELATING TO THE FUNCTIONS OF THE PLANNING AND ZONING BOARD ORDINANCE NO. 59, 1988 OF THE COUNCIL OF THE CITY OF FORT COLLINS AMENDING SECTION 2-353(4) OF THE CODE OF THE CITY OF FORT COLLINS RELATING TO THE FUNCTIONS OF THE PLANNING AND ZONING BOARD WHEREAS, Ordinance No. 173, 1987, adopted on November 3, 1987, amended the provisions of Section 2-353(4) of the Code of the City of Fort Collins relating to the functions of the Planning and Zoning Board; and WHEREAS, Ordinance No. 4, 1988, adopted on January 19, 1988, further amended said Section; and WHEREAS, the provisions of Ordinance No. 173, 1987, were not incorporated into the amendments of Ordinance No. 4, 1988; and WHEREAS, it is necessary that the provisions of Ordinance No. 173, 1987, be included in Section 2-353(4) . NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS that Section 2-353(4) of the Code of the City of Fort Collins is hereby amended to read as follows: (4) To take final action to approve, disapprove or approve with conditions all planning items in accordance with this Code and Charter; provided, however, that the City Council , by a majority vote of a quorum of its members, shall have the power to review such decisions in accordance with the provisions of Article II, Division 3 of this Chapter. In taking such final action, the Board shall have the authority to accept the dedication of streets, easements and other rights-of-way as laid out on plats presented to the Board for approval , and shall have the authority to vacate easements and other rights-of-way, but not to include streets and alleys, by resolution or by approval of replats containing notation of such vacation. The board shall further have the authority to hear and decide appeals from, and review any order, requirement, decision or determination made by, an administrative official which pertains to any planning item previously reviewed or approved by the board if such appeals and requests for review are filed not later than fourteen (14) days after the action which is the subject of such appeal or request for review.
