HomeMy WebLinkAbout089 - 07/07/1987 - VACATING JANE STREET AND TWO PORTIONS OF STREET RIGHT-OF-WAY AT HORSETOOTH COMMONS PUD ORDINANCE NO. 89 , 1987 OF THE COUNCIL OF THE CITY OF FORT COLLINS VACATING JANE STREET AND TWO PORTIONS OF STREET RIGHT-OF-WAY AT HORSETOOTH COMMONS P.U.D. WHEREAS, the Council of the City of Fort Collins has been petitioned by the Developer of Horsetooth Commons P.U.D. to vacate an existing street right-of-way know as Jane Street, and two portions of right-of-way located where Richmond Drive intersects with Shields Street and Horsetooth Road, set forth in more particular below; and WHEREAS, the Developer, Jerald J. Karg, has replatted the tract of land containing said rights-of-way proposed to be vacated, and the Planning and Zoning Board approved the replat on February 23, 1987; and WHEREAS, the replat provides adequate right-of-way dedication to construct streets which meet City approved standards; and WHEREAS, the Developer has made arrangements with Public Service Company of Colorado to provide a utility easement in the Jane Street right-of-way for the existing gas service; and WHEREAS, City agencies and Utility companies have been contacted and report no problems with the vacation; and WHEREAS, there will be no costs to the City in making the proposed change in public right-of-way; and WHEREAS, the rights of the residents of the City of Fort Collins will in no way be prejudiced or injured by said vacation. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS that the rights-of-way located on the plat of Horsetooth Commons P.U.D. , recorded with the Larimer County Clerk and Recorder described more particularly as follows, to wit: Jane Street A tract of land located in Section 27, Township 7 North, Range 69, West of the 6th P.M. ; considering the East line of the SE 1/4 as bearing North and with all bearings herein relative thereto, contained within the boundary lines described as: Commencing in the Southeast corner of Section 27, Township 7 North, Range 69 West of the 6th P.M. , and run thence N 563.25 feet; thence N 89044'16" W 790.01 feet; thence S 50 feet; thence S 89°44' 16" E 790.01 feet; thence N 50 feet to the true point of beginning. Horsetooth Road/Richmond Drive Intersection A tract of land located in the Southeast quarter of Section 27, Township 7 North, Range 69 West of the 6th P.M. , City of Fort Collins, County of Larimer, State of Colorado being more particularly described as follows: Commencing at the Southeast corner of said Section 27 and considering the South line of the Southeast quarter to bear N 89°45'30" W with all bearings contained herein relative thereto; thence along said South line of Southeast quarter N 89°45'30" W, 1020.00 feet; thence N 00°00'00" E, 50.00 feet to the North right-of-way line of Horsetooth Road; thence along North right-of-way line S 89°45'30" E, 296.21 feet to the beginning of a curve concave to the Northwest having a central angle of 47°08'36" with a radius of 15.00 feet whose long chord bears N 66'40'12" E, 12.00 feet to the true point of beginning; thence continuing along the arc of said curve 6. 12 feet with a central angle of 23°23'08" whose long chord bears N 31024'20", 6.08 feet; thence N 89045'30" W, 3.15 feet; thence S 00°14'30" W, 5.20 feet to the true point of beginning. Said tract of land contains 9.45 square feet. Shields Street/Richmond Drive Intersection A tract of land located in the Southeast quarter of Section 27, Township 7 North, Range 69 West of the 6th P.M. , City of Fort Collins, County of Larimer, State of Colorado being more particularly described as follows: Commencing at the Southeast corner of said Section 27 and considering the East line of the Southeast quarter of said Section 27 to N 00000'00" E with all bearings contained herein relative thereto; thence along said line N 00°00'00" E, 663.25 feet; thence S 89044'16" E, 50.00 feet; thence S 00°00'00" E, 103.93 feet to the beginning of a curve concave to the Northwest having a central angle of 90°15'44" whose radius is 16.00 feet, whose long chord bears S 45007'52" W, 22.68 feet; thence S 00007'15" E, 68.00 feet to the true point of beginning; thence 26.05 feet along the arc of a nontangent curve concave to the Southwest whose central angle is 89044'16" and whose long chord bears S 44652'28" E, 22.58 feet; thence S 00°00'00" W, 0.30 feet; thence 25.06 feet along the arc of a curve concave to the Southwest whose central angle is 89°44'16" and whose long chord bears N 44052'28" W, 22.58 feet; thence N 00°07'15" W, 0.30 feet to the true point of beginning. Said tract of land contains 5.00 square feet. be, and the same hereby is vacated, abated and abolished. Introduced, considered favorably on first reading, and ordered published this 2nd day of June, A.D. 1987, and to be presented for final passage on the 7th day of July, A.D. 1987.
