HomeMy WebLinkAbout088 - 07/07/1987 - VACATING PORTION OF UTILITY EASEMENT IN RANGEVIEW PUD ORDINANCE NO. 88 , 1987 OF THE COUNCIL OF THE CITY OF FORT COLLINS VACATING A PORTION OF AN EXISTING UTILITY EASEMENT IN RANGEVIEW P.U.D. WHEREAS, the Council of the City of Fort Collins has been petitioned by the owner, Robart Development Co. to vacate a portion of an existing utility easement located in the Rangeview P.U.D. , set forth in a more particular below; and WHEREAS, Robart Development Co. desires to revise the location and shape of future buildings in this development which will conflict with the existing easement; and WHEREAS, the Owner has made arrangements with the Utilities to relocate the utility services currently in the existing easement to an adjacent easement to be dedicated to the City; and WHEREAS, City agencies and Utility companies have been contacted and report no problems with the proposed utility relocation; and WHEREAS, there will be no costs to the City in making the proposed relocation of the utilities; and WHEREAS, the rights of the residents of the City of Fort Collins will in no way be prejudiced or injured by said vacation. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS that the easement located on the plat of Rangeview P.U.D. recorded with the Larimer County Clerk and Recorder described more particularly as follows, to wit: A tract of land located in the Southeast Quarter of Section 35, Township 7 North, Range 69 West, of the 6th P.M. , City of Fort Collins, Larimer County, being a Replat of Mail Creek P.U.D. , which is a Replat of "Tract E" of the Larkborough Subdivision, more particularly described as follows: A 10 foot wide strip of land in the Rangeview P.U.D. which is 5 feet each side of the following described centerline: begin at a point which bears N 89*53' W 305.00 feet, and again N 44°53' W 21.21 feet, and again N 00*07' E 345.00 feet, and again N 07°06'30" W 135.82 feet, and again N 81° 29' E 55.14 feet, and again N 41007'30" E 47.92 feet, and again S 64*31' E 26.43 feet from the Southeast corner of said Rangeview P.U.D. , and run thence along said centerline S 08039' E 131 .50 feet to the end. be, and the same hereby is vacated, abated and abolished.
