OF THE COUNCIL OF THE CITY OF FORT COLLINS
VACATING A PORTION OF A UTILITY EASEMENT
LOCATED IN COURTNEY PARK P.U.D.
WHEREAS, the Council of the City of Fort Collins has been petitioned
to vacate a portion of a utility easement located in Courtney Park P.U.D.
set forth in particular below; and
WHEREAS, on November 19, 1984, the Planning and Zoning Board approved
the development plan for Courtney Park P.U.D. , which plan included Building
No. 5 as it is now situated on the property; and
WHEREAS, Building No. 5 encroaches 2.65 feet into the dedicated
utility easement and it is necessary to vacate a portion of the easement to
accommodate the encroachment; and
WHEREAS, all utility companies have been contacted and have no
objections to the vacation of a portion of the dedicated easement; and
WHEREAS, the rights of the residents of the City of Fort Collins will
in no way be prejudiced or injured by said vacation.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT
COLLINS that a portion of the utility easement located on the plat of
Courtney Park P.U.D. set out more particularly as follows, to wit:
Legal description for a portion of a 20.00 foot utility easement
to be vacated described as follows: Beginning at the Southeast
Corner of Courtney Park, a Planned Unit Development to the City
of Fort Collins, County of Larimer, State of Colorado, thence
North 00022'37" East 80.00 feet; thence North 89037'23" West
418.53 feet to the Southeast Corner of a 20.00 foot utility
easement; thence along the East line of said easement North
00°22'37" East 62.24 feet to the True Point of Beginning, thence
continuing along the Northeasterly line North 42°52'37" East
48.90 feet thence North 47°07'23" West 3.00 feet; thence South
42°52'37" West 45.63 feet; thence South 00°22'37" West 4.44 feet
to the True Point of Beginning.
be, and the same hereby is, vacated, abated and abolished.
Introduced, considered favorably on first reading, and ordered
published this 3rd day of February A.D. 1987, and to be presented for final
passage on the 17th day of February, A.D. 1987.
