HomeMy WebLinkAbout021 - 02/17/1987 - AMENDING CITY CODE ADOPTING THE UNIFORM PLUMBING CODE, 1985 EDITION ORDINANCE NO. 21 , 1987 OF THE COUNCIL OF THE CITY OF FORT COLLINS AMENDING CHAPTER 86 OF THE CODE OF THE CITY OF FORT COLLINS PROVIDING FOR THE PROTECTION OF THE PUBLIC HEALTH AND SAFETY, ESTABLISHING MINIMUM REGULATIONS FOR THE INSTALLATION, ALTERATION OR REPAIR OF PLUMBING AND DRAINAGE SYSTEMS AND THE INSPECTION THEREOF, ADOPTING BY REFERENCE THERETO THE UNIFORM PLUMBING CODE OF THE INTERNATIONAL ASSOCIATION OF PLUMBING AND MECHANICAL OFFICIALS, 1985 EDITION, SETTING FORTH CERTAIN AMENDMENTS TO SAID CODE, PROVIDING FOR THE QUALIFICATION AND REGISTRATION OF PERSONS ENGAGED IN THE BUSINESS OF PLUMBING OR LABORING AT THE TRADE OF PLUMBING, REQUIRING PERMITS AND INSPECTIONS FOR THE INSTALLATION OR ALTERATION OF PLUMBING AND DRAINAGE SYSTEMS, AND REPEALING ALL ORDINANCES OF THE CITY OF FORT COLLINS IN CONFLICT OR INCONSISTENT HEREWITH BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS that Chapter 86 of the Code of the City of Fort Collins be amended as follows: Section 1. That Section 86-1 of the Code of the City of Fort Collins be repealed and reenacted as follows: Section 86-1. Adoption of standards. Pursuant to the authority conferred by Article II, Section 7 of the Charter of the City of Fort Collins, and by Title 31, Article 16, Section 202 of the Colorado Revised Statutes, 1973, as amended, there is hereby adopted by the City of Fort Collins for the purpose of providing for the protection of the public health and safety and for the purpose of regulating the installation, alteration, or repair of plumbing and drainage systems in the City of Fort Collins, Colorado, that certain Code promulgated by the International Association of Plumbing and Mechanical Officials known as the Uniform Plumbing Code, being particularly the 1985 Edition thereof, and the whole thereof, including the appendices thereto, save and except such portions as are hereafter deleted, modified or amended by Section 2 of this Ordinance, the same hereby is adopted and incorporated as fully as if set forth at length herein and from the date on which this Ordinance shall take effect, the provisions thereof shall be controlling within the limits of the City of Fort Collins. Section 2. That Section 86-2 of the Code of the City of Fort Collins be repealed and reenacted to set out the following amendments to the provisions of the Uniform Plumbing Code. Section 86-2. Amendments and deletions to code. The following sections, subsections, chapters, tables, appendices or parts thereof of the Uniform Plumbing Code are hereby amended to read as follows: (the words "no change" indicate that there has been no change from the wording of the applicable provision of the Uniform Plumbing Code; the word "deleted" indicates that the applicable provision of the Uniform Plumbing Cade has been deleted) : A. Section 102 (c) Administrative Authority - The Administrative Authority is the Building Official and Director of Building Inspections of the City of Fort Collins and his or her authorized representatives. B. Section 124. An additional definition is hereby added to this section as follows: "Water Service Pipe. The water service pipe is the pipe carrying potable water from the water main or other source of water supply to the building or other point of use or distribution on the lot or premises served. Water service pipe shall also have the same meaning as the term 'Building Supply' . " C. Section 409(a), is amended to read as follows: (a) A backwater valve shall be required where the Administrative Authority makes the determination that a sewer flooding hazard exists. D. Section 904(b) , is amended to read as follows: (b) Fixtures having concealed slip joint connections shall be provided with an access panel or utility space at least twelve (12) inches ( .3m) in its least dimension and so arranged without obstructions as to make such connections readily accessible for inspection and repair. Exception: Slip joint connections within a one or two family dwelling need not be readily accessible. A minimum of twelve (12) inch by twelve (12) inch opening shall be provided in the rough framing so that the slip joint will be accessible upon the removal of the wall or ceiling covering. E. Chapter 9 is hereby amended by the adding thereto of an additional section 912 to read as follows: "Section 912. Water Saving Devices. (a) New Construction - Interior Plumbing. All new water consuming fixtures in buildings shall meet the following requirements: (1) Water closets shall not use more than three and a half gallons per flush except that water closets and urinals with flush valves may be installed; (2) Shower heads shall contain flow control inserts, valves, devices or orifices that restrict flow to a maximum of approximately three gallons per minute; (3) Kitchen and lavatory faucets shall have aerators or laminar flow devices together with flow control inserts, valves, devices or orifices that restrict flow to a maximum of approximately two gallons per minute. (b) Existing Buildings - In existing buildings or premises in which plumbing fixtures are to be replaced, such fixtures shall comply with all Code requirements for water conservation devices. " F. Add subsection "(f)" under Section 1004 to read as follows: (f) The use of lead in pipes, fittings, and solders in potable water systems is limited to alloys containing not more than eight percent (8%) lead in pipes and fittings, and not more than two-tenths percent (0.2%) lead in solders. G. Chapter 12 - Fuel Gas Piping is deleted in its entirety. H. The chapter entitled, "Part I, Administration", of the UNIFORM PLUMBING CODE, 1985 EDITION is hereby adopted with the following amendments: 1) . The first sentence of the first paragraph of Section 20.3 is amended to read as follows: Any person, firm or corporation who shall violate any of the provisions of this Code or ordinance adopted hereby shall be subject to the penalties and conditions as set forth in Section 1-23. of the CODE OF THE CITY OF FORT COLLINS. 2) . A new paragraph to Section 20.5 is hereby added to read as follows: Permits shall not be required for replacement of fixtures and their traps, and water heaters serving one dwelling unit, when such replacement does not require additional alteration of the drainage or water supply systems. 3) . Section 20.7, "Schedule of Fees" is amended by adopting the fee schedule as set forth in "Table NO. 3-A, Building Permit Fees", of the Building Code of the City of Fort Collins, except that the minimum fee for any permit regulated herein shall not be less than fifteen dollars ($15) , and a permit for a lawn irrigation system supplied from a single dwelling unit shall be fifteen dollars ($15) . 4) . Section 20.14 is amended to read as follows: Whenever the Building Official disapproves an application or refuses to grant a permit applied for or it is claimed that the provisions of the Uniform Plumbing Code do not apply or that the true intent and meaning of the Code has been misconstrued or wrongly interpreted, the applicant or party of interest may appeal such decision of the Building Official to the Building Board of Appeals within ten (10) days from the date of receipt of the decision. The Board may augment its membership with two master plumbers registered with the City. Such appeal shall proceed under the provisions of Section 204 of the Building Code of the City of Fort Collins. 5) . Add a new section 20.15, "To Whom Permits May Be Issued", to read as follows: (a) No permit shall be issued to any person to do or to cause to be done any plumbing or drainage work regulated by this ordinance and the Code adopted hereby except to a person holding a valid master plumber's license and registration as required by this ordinance or as otherwise provided in this section. (b) Any permit required by this ordinance may be issued to any person to do any plumbing or drainage work regulated by this ordinance in a single family dwelling used exclusively for living purposes, including the usual accessory buildings and quarters in connection with such buildings in the event that any such person is the bona fide owner and occupant of any such dwelling and accessory buildings and quarters , provided that the said owner shall personally purchase all material and shall personally perform all labor in connection therewith. (c) Persons or companies who engage in, conduct or carry on the business of installing, altering or repairing building sewers and private sewage disposal systems are not required to be plumbers but may be licensed as special contractors as provided in Section 73-122 of the Code of the City of Fort Collins. Such persons shall be eligible to obtain a plumbing permit only for a new or replacement building sewer. (d) Water supply lines connected to the City's water mains which serve only fire protection systems are not water service lines or building supplies as defined in the Uniform Plumbing Code. Permits for fire protection water supply lines may be issued to a duly licensed special contractor (fire protection) . If the system is designed so that the domestic water supply is tapped from the fire line, that portion of the piping from the property line to the domestic tap is a water service line. Section 3. That Section 86-5 of the Code of the City of Fort Collins be repealed and reenacted as follows: Section 86-5. Qualifications of Plumbing Contractors A. Definitions of plumbers and contractors. As used in this Chapter, the terms "journeyman plumber", "master plumber" and "plumber's apprentice", shall have meanings given to them by the state law providing for the licensing of plumbers. B. General Provisions, Licensing and Registration. (1) No person shall engage in the trade, business, or calling of a plumber or plumbing in the City until he shall register with the Building Inspection Department of the City as a plumber. For the purpose of this section, "plumbing contractor" means any person, firm, partnership, corporation, association or combination thereof who undertakes or offers to undertake for another the planning, laying out, supervising and installing or the making of additions, alterations, and repairs to potable water supply and distribution pipes and piping, plumbing fixtures, drainage and vent pipes and building drains, including their respective joints and connections, devices, receptacles and appurtenances. A registered professional engineer who plans or designs plumbing installations shall not be classified as a plumbing contractor. (2) No person shall engage in the business of a plumbing contractor in the City without registering as a plumbing contractor with the Building Inspection Department of the City. In order to register as a plumbing contractor, the person desiring to engage in such business must do the following: (a) Be licensed as a master plumber by the State Examining Board of Plumbers or have an employee so licensed and registered. The registration as a plumbing contractor shall be valid only so long as the person registered is so licensed and registered or employs a person so licensed and registered. (b) Observe all laws relating to safety of employees and the public at all times. Every such contractor shall maintain Workman's Compensation Insurance as required by State law and public liability insurance in the minimum amounts as follows: $150,000 per person, $400,000 per accident, and $400,000 per accident involving public property. " (c) Pay a registration fee of $50 to the City of Fort Collins, valid for a period of one year from the date of payment. (d) Provide supervision and maintain licenses as required by the State Examining Board of Plumbers for all apprentice and journeyman plumbers. (3) The Building Contractors Licensing Board, established by Chapter 73 of this Code, shall conduct hearings for suspension or revocation of a plumbing contractor' s registration as set forth therein . The Building Contractors Licensing Board may, on its own motion, or, if requested by the applicant, augment its membership by not more than two (2) additional registered plumbers to conduct any hearing involving suspensions or revocation of a plumber's registration. Section 4. That Section 86-6 of the Code of the City of Fort Collins be repealed and reenacted as follows: Section 86-6. Copies on File. At least three (3) copies of the Uniform Plumbing Code, 1985 Edition, shall be on file in the Office of the City Clerk of the City of Fort Collins, Colorado, at least fifteen (15) days preceding the date set herein and may be inspected by any interested person during normal business hours. Section 5. That Section 86-7, Repealer, of the Code of the City of Fort Collins be repealed in its entirety. Section 6. Severability. The City Council hereby declares that should any section, paragraph, sentence, word or other portion of this ordinance be declared invalid for any reason, such invalidity shall not affect any other portion of this ordinance, and the City Council hereby declares that it would have passed all other portions of this ordinance, independent of the elimination herefrom of any such portion which may be declared invalid.
