HomeMy WebLinkAbout020 - 02/17/1987 - AMENDING CITY CODE ADOPTING THE UNIFORM MECHANICAL CODE, 1985 EDITION ORDINANCE NO. 20 , 1987 OF THE COUNCIL OF THE CITY OF FORT COLLINS AMENDING CHAPTER 75 OF THE CODE OF THE CITY OF FORT COLLINS RELATING TO THE REGULATION AND CONTROL OF THE DESIGN, CONSTRUCTION, INSTALLATION, QUALITY OF MATERIALS, LOCATION, OPERATION AND MAINTENANCE OF HEATING, VENTILATING, COOLING, REFRIGERATION _ SYSTEMS, INCINERATORS, AND OTHER MISCELLANEOUS HEAT PRODUCING APPLIANCES IN THE CITY OF FORT COLLINS, ADOPTING BY REFERENCE HERETO THE UNIFORM MECHANICAL CODE, 1985 EDITION OF THE INTERNATIONAL ASSOCIATION OF PLUMBING AND MECHANICAL OFFICIALS AND THE INTERNATIONAL CONFERENCE OF BUILDING OFFICIALS. REPEALING ALL ORDINANCES IN CONFLICT OR INCONSISTENT HEREWITH AND PROVIDING A PENALTY FOR VIOLATION OF THE PROVISIONS OF SAID MECHANICAL CODE. BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS that Chapter 75 of the Code of the City of Fort Collins be amended as follows: Section 1. That Section 75-1 be repealed and reenacted to read as follows: Section 75-1. Adoption of Standards. Pursuant to the power and authority conferred on the City Council of the City of Fort Collins by Title 31, Article 16, Section 202, Colorado Revised Statutes, 1973, as amended, and Article II, Section 7 of the Charter of the City of Fort Collins, Colorado, there is hereby adopted as the Mechanical Code of the City of Fort Collins, by reference thereto, the Uniform Mechanical Code, 1985 Edition, including specifically Appendices A, B, and C thereof, published by the International Conference of Building Officials, 5360 South Workman Mill Road, Whittier, California, 90601, all to have the same force and effect as if though set forth herein in every particular. The subject matter of said Code includes comprehensive provisions and standards regulating and controlling the design, construction, installation, quality of materials, location, operation, and maintenance of heating, ventilating, cooling, refrigeration systems, incinerators, and other miscellaneous heat-producing appliances for the purpose of protecting public health, safety, and general welfare. Section 2. That Section 75-2 be repealed and reenacted to set out the following amendments to the provisions of the Uniform Mechanical Code: Section 75-2. Amendments and deletions to code. Said Code is hereby amended and changed in the following respects: A. Section 301 . (b) is amended by adding item no.6 to read as follows: 6. Water heaters serving one dwelling unit. B. Table No. 3-A (21) is hereby amended by adopting the fee schedule as set forth in "Table 3-A, Building Permit Fees" of the Building Code of the City of Fort Collins, except that the minimum fee for any permit regulated herein shall be fifteen dollars ($15) , and the permit fee for installation of each solid fuel appliance, residential heating appliance, and residential cooling appliance shall be fifteen dollars ($15) . C. Section 914 is amended by rewording Subsection (f) to read as follows: "f. Spark arresters. Chimneys serving solid fuel burning fireplaces, stoves and appliances shall terminate in a substantially constructed spark arrester having a mesh approved for the use. Spark arresters shall be adequately supported and secured." D. Appendix B is amended by deleting Section 2125 with existing Subsections to be renumbered appropriately. E. Section 2218 (a) is amended by deleting therefrom the first paragraph thereof and substituting therefor the following: "(a) General . Gas piping shall comply with the provisions of this Section and Section 2211 . All natural gas regulations and tables except Table 22 D are based on the use of a gas water column pressure at the outlet of the meter. Table 22 D is based on the use of natural gas having a specific gravity of 0.68 and six inch (6: ) water column as supplied in the Fort Collins area. For undiluted liquified petroleum gas, gas piping may be sized for 2500 BTU/cu. ft. at eleven inches (11:) water column and specific gravity of 1 .52. " Section 3. That Section 75-3 of the Code of the City of Fort Collins be repealed and reenacted to read as follows: Section 75-3. Definitions. A. Wherever the word "municipality" or "city" is used in the Uniform Mechanical Code, it shall be held to mean the City of Fort Collins. B. Wherever the word "Building Official " is used in the Uniform Mechanical Code, the term shall be synonymous with the Chief Building Official and Director of Building Inspection , and shall include all his or her designated representatives. Section 4. That Section 75-4 be repealed and reenacted to read as follows: Section 75-4. Violations and penalties. The following section of the Uniform Mechanical Code contains a penalty clause which is herewith set forth in full as required by §31-16-204, C.R.S. , and Article 2, Section 7, of the Charter of the City of Fort Collins: Sec. 204. It shall be unlawful for any person, firm or corporation to erect, construct, enlarge, alter, repair, move, improve, remove, convert or demolish, equip, use or maintain any mechanical systems or equipment or cause or permit the same to be done in violation of this code. Section 5. That Section 75-5 of the Code of the City of Fort Collins be repealed and reenacted to read as follows: Section 75-5. Copies on file. At least three (3) copies of the Uniform Mechanical Code, 1985 Edition, shall be on file in the Office of the City Clerk of the City of Fort Collins, Colorado, at least fifteen (15) days preceding the date set herein and may be inspected by any interested persons during normal business hours. Section 6. That Section 75-6, Repealer, of the Code of the City of Fort Collins be repealed in its entirety. Section 7. Severability. The City Council hereby declares that should any section, paragraph, sentence, word or other portion of this ordinance be declared invalid for any reason, such invalidity shall not affect any other portion of this ordinance, and the City Council hereby declares that it would have passed all other portions of this ordinance, independent of the elimination herefrom of any such portion which may be declared invalid.
