OF THE COUNCIL OF THE CITY OF FORT COLLINS
VACATING A PORTION OF A DRAINAGE EASEMENT
IN TRACT B, BROWN FARM, THIRD FILING
WHEREAS, the Council of the City of Fort Collins has been petitioned
to vacate a portion of an existing drainage easement located in Tract
B , Brown Farm, Third Filing , set forth in more particular below; and
WHEREAS, said vacation would accommodate the construction of a gas
station; and
WHEREAS, the developer has dedicated an additional drainage easement
to the detention pond to replace the easement lost by this vacation; ana
WHEREAS , all utilities have been notified and have indicated no
problem with this vacation request; and
WHEREAS, the rights of the residents of the City of Fort Collins will
in no way be prejudiced or injured by said vacation.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT
COLLINS that a portion of an existing drainage easement located in Tract B,
Brown Farm, Third Filing, set out more particularly as follows, to wit:
A portion of Tract "B" , Brown Farm Third Filing according
to the recorded plat thereof , City of Fort Collins , Larimer
County, Colorado being described as follows: Beginning at the
Southwest corner of said Tract "B" thence Northerly along the
Westerly line of said Tract "B" North 00°09'00" East, 564.32 feet
to the True Point of Beginning of this description ; thence
continuing Northerly along said Westerly line North 00°09'00"
East , 70 .00 feet ; thence departing said Westerly line South
89°51'00" East, 12.00 feet; thence South 00°09'00 West, 70.00
feet; thence North 89051'00" West, 12.00 feet to the true point
of beginning of this description. The above described tract
contains 840 square feet, more or less.
be, and the same hereby is, vacated, abated, and abolished.
Introduced, considered favorably on first reading, and ordered pub-
lished this 5th day of February , A .D . 1985 , and to be presented for
final passage on the 19th day of February, A.D. 1985.
