OF THE COUNCIL OF THE CITY OF FORT COLLINS
VACATING TWO UTILITY AND ACCESS EASEMENTS AND
A PORTION OF THE EMIGH DITCH EASEMENT IN
RIVERSIDE SHOPPING CENTER FILING II
WHEREAS, the Council of the City of Fort Collins has been petitioned
to vacate two utility and access easements and a portion of the Emigh Ditch
easement in Riverside Shopping Center Subdivision, Filing II, set forth in
more particular below; and
WHEREAS, these vacations would accommodate the developer' s current
site plan; and
WHEREAS, replacement easements are being dedicated for the City' s
acceptance to compensate for those easements vacated; and
WHEREAS, all utilities have been notified of the proposed vacations
and have indicated no problems with the request; and
WHEREAS, the rights of the residents of the City of Fort Collins will
in no way be prejudiced or injured by said vacation.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT
COLLINS that those two utility and access easements and a portion of the
Emigh Ditch easement in Riverside Shopping Center Subdivision, Filing II ,
set out more particularly as follows, to wit:
VACATION "A"
A tract of land located in the Northeast Quarter of Section 13,
Township 7 North, Range 69 West of the Sixth P.M. , City of Fort
Collins, County of Larimer, State of Colorado, being more par-
ticularly described as follows: Considering the East line of the
said Northeast Quarter as bearing N 00°25' E and with all
bearings contained herein, relative thereto: Beginning at the
East 1/4 Corner of said Section 13; thence N 00°25' E, 350.00
feet; thence N 89024'24" W, 543.92 feet; thence N 00°35'36" E,
26.00 feet, said point being the Point of Beginning. Thence N
89024124" W, 24 .00 feet ; thence N 00°35' 36" E , 164 .02 feet;
thence N 89024'24" W, 61.00 feet; thence N 00°35' 36" E , 24.00
feet; thence S 89024' 24" E, 70.00 feet; thence N 00°35' 36" E,
8.00 feet; thence 4.57 feet along the arc of a curve concave to
the East, whose central angle is 17°27' 27", radius of 15.00 feet,
and whose long chord bears N 09°28' 20" E, 4.55 feet; thence S
89024124" E , 14.31 feet; thence S 00°35'36" W, 200.52 feet to
the Point of Beginning. The above described tract contains 0.142
acres, more or less.
VACATION "B"
A tract of land, located in the Northeast Quarter of Section 13,
Township 7 North, Range 69 West of the Sixth P.M. , City of Fort
Collins, County of Larimer, State of Colorado, being more par-
ticularly described as follows: Considering the East line of the
said Northeast Quarter as bearing N 00025' E and with all
bearings contained herein, relative thereto: Beginning at the
East 1/4 Corner of said Section 13; thence N 00025' E, 350.00
feet; thence N 89°24'24" W, 193.92 feet said point being the
Point of Beginning. Thence N 89°24' 24" W, 30.00 feet; thence N
00035136" E , 237 .02 feet ; thence S 89°24' 24" E , 30 .00 feet ;
thence S 00035' 36" W, 237.02 feet to the Point of Beginning.
The above described tract contains 0.163 acres, more or less.
VACATION "C"
A tract of land located in the Northeast Quarter of Section 13,
Township 7 North, Range 69 West of the Sixth P.M. , City of Fort
Collins, County of Larimer, State of Colorado, being more par-
ticularly described as follows: Considering the East line of the
said Northeast Quarter as bearing N 00°25' E and with all
bearings contained herein, relative thereto: Beginning at the
East 1/4 Corner of said Section 13; thence N 00°25' E, 350.00
feet; thence N 89°24' 24" W, 208.92 feet said point being the
Point of Beginning. Thence N 89°24' 24" W, 114.00 feet; thence N
59039142" W, 40 .31 feet ; thence S 89024' 24" E , 149 .00 feet ;
thence S 00°35'36" W, 20.00 feet to the Point of Beginning. The
above described tract contains 0.060 acres, more or less.
be, and the same hereby are, vacated, abated and abolished.
