HomeMy WebLinkAbout180 - 12/01/1987 - AMENDING CITY CODE REGARDING THE BURNING OF SOLID FUEL ORDINANCE NO. 180, 1987 OF THE COUNCIL OF THE CITY OF FORT COLLINS AMENDING THE CODE OF THE CITY REGARDING THE BURNING OF SOLID FUEL IN THE CITY WHEREAS, the burning of solid fuel for heating purposes in the City of Fort Collins has been determined by the Council to be a cause of air pollution problems in the City; and WHEREAS, the Council has determined that, in the interest of public health, safety and welfare, and the abatement of nuisances, regulations on the burning of solid fuel and the installation of solid fuel -burning appliances should be adopted; and WHEREAS, the Council has determined that it is in the best interests of the citizens of the City that the Code of the City be amended to regulate the burning of solid fuels and the installation of solid fuel -burning appliances. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS that the Code of the City be amended as follows: Section 1 . That Chapter 5 (Buildings and Building Regulations) , Article IV (Mechanical standards) , be amended by the addition of a new Section 110, to provide as follows: Sec. 5-110. Solid fuel -burning appliances. (a) No person shall install , modify, relocate or replace a residential solid fuel -burning appliance without having first obtained a building permit in accordance with this Chapter. No person shall install a wood stove, as defined by Colorado Air Quality Control Commission Regulation No. 4, whether free-standing or insert, unless it is certified pursuant to the provisions of the Colorado Air Quality Control Commission, Regulation No. 4, or unless it is an antique stove. For purposes of this regulation, an antique stove is a stove built prior to 1930 which has no gaskets for control of combustion air. (b) No person shall install any solid fuel -burning appliance for the purpose of burning coal for space heat. Section 2. That Chapter 20 (Nuisances) , Article I, Section 20-2, be amended by the addition of new subparagraphs (c) , (d) and (e) , to provide as follows: (c) No person shall cause or allow the emission of smoke exceeding forty (40) percent opacity from any flue or chimney, except for a single fifteen (15) minute period for cold start-up. Any emission in excess hereof is hereby declared to be a nuisance and is prohibited. (d) After October 1, 1988, no person shall cause or allow, for the purpose of residential or commercial space heating, the burning of coal in a solid fuel -burning appliance, unless that appliance is designed to burn coal , and unless it is the sole source of heat for the building. No solid fuel -burning appliance shall be considered to be the sole source of heat if the building is equipped with a permanently-installed furnace or heating system that is designed to use natural gas, fuel oil , electricity or propane, whether connected or disconnected from its energy source. (e) Except as is provided in paragraph (d) hereof, no person shall cause or allow the burning of any solid fuel in a solid fuel -burning appliance other than clean, dry, untreated wood or wood products, or other solid fuel products specially manufactured for the purpose of space heating.
