OF THE COUNCIL OF THE CITY OF FORT COLLINS
AUTHORIZING THE MAYOR TO EXECUTE A RIGHT-OF-WAY EASEMENT
IN FAVOR OF POUDRE VALLEY RURAL ELECTRIC ASSOCIATION, INC.
WHEREAS, the City of Fort Collins is the owner of that certain parcel of
real property located in Larimer County, Colorado, legally described on Exhibit
"A", attached hereto and incorporated by reference ("the Property") ; and
WHEREAS, Poudre Valley Rural Electric Association, Inc. wishes to acquire
a right-of-way easement and interest in the property to construct, operate,
maintain, repair and replace overhead or underground electric lines or systems;
and
WHEREAS, under Section 23-111 of the City Code, the City Council must find
by ordinance that any sale or other disposition of real property owned by the
City is in the best interest of the City of Fort Collins and will not materially
impair the viability of any City utility system and will be for the benefit of
the citizens of the City.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS
as follows:
1 . That the above-described sale and conveyance of an easement interest
in the Property is in the best interests of the City of Fort Collins because it
brings electrical power closer to the City's property and will not materially
impair the viability of any City utility system and will be for the benefit of
the citizens of the City.
2. That the Mayor, be and hereby is, authorized to execute a right-of-
way easement in favor of Poudre Valley Rural Electric Association, Inc. for the
purpose of constructing, operating, maintaining, repairing and replacing overhead
or underground electric lines or systems.
Introduced, considered favorably on first reading, and ordered published
this 15th day of September, 1992, and to be presented for final passage on the
6th day of October, A.D. 1992
