HomeMy WebLinkAbout083 - 07/16/1991 - AMENDING CITY CODE RELATING TO COMPETITIVE BIDS OR PROPOSALS ORDINANCE NO. 83, 1991 OF THE COUNCIL OF THE CITY OF FORT COLLINS AMENDING CHAPTER 8, ARTICLE IV OF THE CODE OF THE CITY OF FORT COLLINS WHEREAS, Article V, Section 30, of the Charter of the City of Fort Collins was amended by the approval of Proposed Charter Amendment No. 3 by the voters of the regular 'City election held on April 2, 1991; and WHEREAS, the amended Article V, Section 30, of the Charter provides that City improvements that are to be constructed by an independent contractor may be submitted to a competitive proposal process, as well as to a competitive bidding process; and WHEREAS, the amended Article V, Section 30, of the Charter also provides that the Council may, by ordinance, authorize the Purchasing Agent to exempt certain improvements from the competitive bidding and competitive proposal processes; and WHEREAS, the Council desires to implement these Charter amendments through changes to the Code of the City of Fort Collins. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS as follows: Section 1 . That Section 8-156, subparagraph (2) , of the Code of the City of Fort Collins is hereby amended to read as follows: Sec. 8-156. Methods of source selection. (2) Section 8-160 concerning exemptions to the use of competitive bids or proposals. Section 2. That Section 8-158, subparagraph (a) of the Code of the City of Fort Collins is hereby amended by the addition of a new subparagraph (3) to read as follows: Sec. 8-158. Competitive sealed proposals. (a) Procurements for the following are eligible for award by competitive sealed proposals: (1) For materials and services when the Purchasing Agent determines in writing that the use of competitive sealed bidding is either not practicable or not advantageous to the city; (2) For professional services; and (3) For city improvements. Section 3. That Section 8-160, subparagraph (c) , of the Code of the City of Fort Collins is hereby amended to read as follows: Sec. 8-160. Exemptions to use of competitive bid or proposal . (c) Construction change orders. (1) One (1) or more change orders to an existing construction contract which do not exceed a cumulative cost of fifteen (15) percent of the original contract awarded pursuant to an invitation for bids or request for proposals may be executed without competition. (2) Any construction change order which authorizes a new improvement under a construction contract may be executed without competition when: a. the new im; ovement is required for the completion of an improvement which is currently under construction pursuant to a competitive bidding or competitive proposal process; b. the new improvement results from the discovery of differing or unforeseen physical conditions at the site of the improvement under construction and is required for the completion of the improvement under construction; and C. an administrative finding has been made by the Purchasing Agent that it would be in the city's best interest to negotiate with the on-site contractor for the construction of the new improvement.
