HomeMy WebLinkAbout008 - 02/05/1991 - AMENDING CITY CODE REGARDING WASTEWATER PLANT INVESTMENT FEES ORDINANCE NO. 8, 1991 OF THE COUNCIL OF THE CITY OF FORT COLLINS AMENDING SECTION 26-283 AND SECTION 26-284 OF THE CODE REGARDING WASTEWATER PLANT INVESTMENT FEES WHEREAS, on October 17, 1989, the City Council adopted Resolution 89-186 establishing the Wastewater Treatment Master Plan Committee; and WHEREAS, the purpose of said Committee was to review the improvements which were recommended in the Wastewater Master Plan and to further review funding alternatives for the construction of said improvements; and WHEREAS, on August 7, 1990, the City Council adopted Resolution 90-119 adopting the recommendations of the Wastewater Treatment Master Plan Committee, which included, among other things, a recommendation that an increase in the wastewater plant investment fees be presented to the City Council for implementation; and WHEREAS, the City Council has determined that it is in the best interests of the citizens of the City and the customers of the City's wastewater utility that the wastewater plant investment fees be adjusted to more equitably allocate wastewater plant investment fees among the various customer categories of the City' s wastewater utility and to more fully recover to the City's wastewater utility the actual cost of providing the collection and treatment system capacity that will be used by each new customer; and WHEREAS, the City Council has further determined that it is in the best interests of the City that a mechanism be established for making time payments for wastewater plant investment fees in the same manner as is provided for the payment of water plant investment fees, in accordance with policy to be subsequently established by the City Council . NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS as follows: Section 1. That Section 26-283(a) of the Code of the City of Fort Collins be amended to read as follows: (a) An applicant desiring to connect to the wastewater utility shall pay the utility a sewer plant investment fee (SPIF) as prescribed in Section 26-284 of this Article in addition to any other connection fee or charge imposed by this Article. Except where arrangements for time payment are made pursuant to policy established by the City Council , this fee shall be paid in full at the time the sewer connection permit is issued. In the case of an increase in SPIF rates between the time of application for the permit and the applicant's actual payment of sewer connection charges, the rates in effect on the date of payment shall apply. Section 2. That Section 26-284 of the Code of the City of Fort Collins is hereby amended to read as follows: Sec. 26-284. Sewer plant investment fees and surcharges established. (a) The schedule of sewer plant investment fees (not including surcharges) is as follows: Category SPIF A $1,600 B and C $1,600. (For the first dwelling unit) $1, 165. (For each additional dwelling unit) Water meter size Category (inches) Fee D,E,F 3/4 $ 2,000 1 $ 5, 100 1 1/2 $ 9, 100 2 $15, 100 G Same as equivalent category, plus any special sanitation district fees. H Negotiated. (b) Industrial and intermediate nonresidential users in categories E, F, G and H which are subject to a monthly surcharge as set forth in Section 26- 281 of this Article shall also be subject to a plant investment fee surcharge for any average concentrations of BOD and/or TSS in their discharged wastewater which exceed those average concentrations set forth in Section 26-282(b) under Category E-34. (c) Various surcharge categories based on customary commercial and industrial activities and the average concentration of BOD and TSS found in wastewater from each such category are established in Section 26-282 of this Article. Unless the user's wastewater is sampled and tested by a qualified laboratory in accordance with the techniques prescribed in 40 CFR Part 136 as amended, calculation of the user's plant investment fee shall be based on the average concentration values established for the applicable surcharge category. If sufficient information is submitted by the user to support a change from the average concentration values established for the applicable surcharge category, the Director shall thereupon effect such change. (d) The amount of the plant investment fee and surcharge for each nonresidential surcharged user, and users in category H, shall be calculated utilizing the following formula: SPIF = Flow x [Flows + (BOD x BOD$) + (TSS X TSS§)] Where: SPIF = Plant investment fee for category H users and users discharging wastewater with average concentrations of BOD and/or TSS which exceed those average concentrations which are set forth in Section 26-282(b) under Category E-34. Flow = The user's peak daily wastewater discharge measured in gallons per day. Flow$ = $2.86 per gallon (unit cost of facilities attributable to treating wastewater flow.) BOD = Average BOD concentration for user category or measured BOD concentration for the user as determined in accordance with subparagraph (c) of this Section. BOD$ _ $0.0044 per mg/l (unit cost of facilities attributable to treating BOD.) TSS = Average TSS concentration for user category or measured TSS concentration for the user as determined in accordance with subparagraph (c) of this Section. TSS$ _ $0.0029 per mg/l (unit cost of facilities attributable to treating TSS. ) (e) In no event shall the plant investment fee and surcharge for users in categories D, E, F and G, as calculated utilizing the formula set forth in subparagraph (d) of this Section, be less than the plant investment fee for the applicable water meter size set forth in subparagraph (a) of this Section, nor greater than the plant investment fee and surcharge, as calculated utilizing the average concentration of BOD and TSS values set forth in Section 26-282(b) for the applicable surcharge category.
