OF THE COUNCIL OF THE CITY OF FORT COLLINS
AMENDING SECTION 7-103 OF THE CODE OF
THE CITY OF FORT COLLINS RELATING
TO WRITE-IN CANDIDATES FOR
CITY COUNCIL OFFICE
WHEREAS, Sec. 7-103 of the Code of the City of Fort Collins provides that
no write-in vote for a candidate for City Council office shall be counted unless
the person whose name appears as the write-in vote has filed an affidavit of
intent with the City Clerk, no later than the close of business five (5) days
before the election, indicating that such person desires and is qualified for
the office; and
WHEREAS, the Colorado Municipal Election Code (CRS Section 31-10-306) has
recently been amended to provide that the governing body of the municipality may
provide by ordinance that no write-in vote for any municipal office shall be
counted unless an affidavit of intent has been filed with the clerk by the person
whose name is written in prior to twenty (20) days before the day of the election
indicating that such person desires the office and is qualified to assume the
duties of that office if elected; and
WHEREAS, the Council of the City of Fort Collins wishes to amend the Code
of the City of Fort Collins so it is consistent with the provisions of the
Colorado Municipal Election Code.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS
that Sec. 7-103 of the Code of the City of Fort Collins is hereby amended to read
as follows:
Sec. 7-103. Write-in candidates.
No write-in vote for a candidate for City Council office shall be
counted unless the person whose name appears as the write-in vote
has filed an affidavit of intent with the City Clerk, no later than
the close of business twenty (20) days before the election,
indicating that such person desires and is qualified for the office.
Introduced, considered favorably on first reading, and ordered published
this 4th day of June, A.D. 1991, and to be presented for final passage on the
2nd day of July, A.D. 1991.
