OF THE COUNCIL OF THE CITY OF FORT COLLINS
CLARIFYING THE FUNCTIONS OF THE BUILDING REVIEW
BOARD IN RELATION TO THE HANDICAPPED ACCESSIBILITY
REQUIREMENTS OF THE STATE STATUTE AND PROVIDING CRITERIA
FOR THE GRANTING OF EXCEPTIONS TO THE
STATUTORY HANDICAP ACCESSIBLE REQUIREMENTS
WHEREAS, Article 5, Title 9 of the Colorado Revised Statutes establishes
standards and specifications governing the accessibility of buildings and
facilities to the physically handicapped; and
WHEREAS, said Article authorizes the City to grant variances from those
handicapped accessibility requirements; and
WHEREAS, the Council has determined that the Building Review Board should
be charged with the responsibility of hearing all requests for variances from
the requirements of said Article; and
WHEREAS, the Council has further determined that the Code should be amended
to provide more specific criteria to govern the Building Review Board in the
granting of such variances.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS
as follows:
Section 1 . That Section 2-103 of the Code of the City of Fort Collins is
hereby amended to read as follows:
Sec. 2-103. Functions.
The board shall determine the suitability of alternate materials
or alternate methods of construction, provide for reasonable
interpretations of the provisions of the city building code, city
mechanical code, city plumbing code, city electrical code, and city
fire code, and hear all appeals made to it related to such codes.
Additionally, the board shall hear all requests for variances from
the requirements of Article 5, Title 9, C.R.S. , which establishes
standards and specifications governing the accessibility of
buildings and facilities within the city to the physically
handicapped. The board shall also review all applications for any
contractor license or certificate as outlined in §§ 15-154, 15-155,
in order to determine whether such applicants are qualified by
experience and training to perform building construction or
supervision of such in the city, and hear all matters related to the
suspension or revocation of any said certificate or license or
registration of any plumber or electrician as specified in this
Code.
Section 2. That Section 5-27(26) of the Code of the City of Fort Collins
is hereby amended to read as follows:
Sec. 5-27. Amendments and deletions to code.
(26) Section 1214 is amended by revising the first paragraph to
read as follows:
"Group R, Division 1 occupancies shall be provided with
dwelling units or guestrooms accessible to [the]
physically handicapped as specified in Section 9-5-101
et seq. , C.R.S. Such accessible units shall have the
same ratio of bedrooms and other features as other units
provided in the subject building or facility. The
Building Review Board shall consider and grant
exceptions pursuant to Section 9-5-102(1) , C.R.S. , and,
for the purpose of granting such exceptions, the
Building Review Board shall require the applicant
desiring the exception to demonstrate that the
application of a particular standard or specification
would impose an extraordinary hardship on the subject
property, due to unique conditions resulting from
terrain, topography or geology or other site conditions
not typically encountered in the city. Other kinds of
difficulties related to compliance with the statutory
standards for handicap accessibility shall not be
construed as a hardship. "
