OF THE COUNCIL OF THE CITY OF FORT COLLINS
VACATING RIGHT-OF-WAY ON THE HORSETOOTH
BUSINESS PARK BEING A REPLAT OF THE SOUTH
COLLINS TECH CENTER FIRST, SECOND, AND THIRD
FILINGS AND RESERVING THE SAME FOR
UTILITY EASEMENT PURPOSES
WHEREAS, the Council of the City of Fort Collins has received a request
from the owner of the Horsetooth Business Park to vacate right-of-way previously
dedicated by the plats of the South Collins Tech Center First, Second, and Third
Filings, more particularly described on Exhibit A, attached hereto and
incorporated herein by this reference; and
WHEREAS, City agencies and the private utility companies have been
contacted and report no objection to the proposed vacation upon the condition
that said right-of-way be reserved for utility easement purposes until such time
as the full execution and proper recording of the plat of the property has
occurred and existing utilities have been relocated; and
WHEREAS, there will be no cost to the City in making the proposed vacation
and reservation; and
WHEREAS, the rights of the residents of the City of Fort Collins will not
be prejudiced or injured by the vacation of said street rights-of-way.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS
that the street rights-of-way for Big Horn Drive, Deer Trail and portions of
Otter Drive and Elk Road, more particularly described on Exhibit A, be, and the
same hereby are, vacated, abated and abolished, reserving, however, unto the City
the said area for utility easement purposes.
Introduced, considered favorably on first reading and ordered published
this 19th day of March, A.D. 1991 , and to be presented for final passage on the
16th day of April , A.D. 1991.
