HomeMy WebLinkAbout025 - 03/19/1991 - AMENDING CITY CODE PERTAINING TO SOLID FUEL BURNING APPLIANCES ORDINANCE NO. 25, 1991 OF THE COUNCIL OF THE CITY OF FORT COLLINS AMENDING SECTION 5-110 OF THE CODE OF THE CITY OF FORT COLLINS PERTAINING TO SOLID FUEL BURNING APPLIANCES WHEREAS, the burning of solid fuel for heating or aesthetic purposes in the City of Fort Collins has been determined by the Council to be a cause of air pollution in the City; and WHEREAS, the Council has determined that, in the interest of the protection of the public i,ealth, safety and welfare and the abatement of nuisances, regulations on the installation of solid fuel burning appliances should be adopted; and WHEREAS, the Council has determined that it is in the best interests of the citizens of the City that the Code of the City be amended to regulate the installation of solid fuel burning appliances. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS as follows: Section 1 . That Section 5-110 of the Code of the City of Fort Collins is hereby amended to read as follows: Sec. 5-110. Solid fuel burning appliances. (a) No person shall install or modify a solid fuel burning appliance without first having obtained a building permit in accordance with this Chapter. (b) No person shall install or modify a solid fuel burning appliance (including, without limitation, a wood stove or a pellet stove) unless, both prior and subsequent to installation or modification, it meets the most stringent emission standards for wood stoves established by the Colorado Air Quality Control Commission as of the time of installation of the solid fuel burning appliance. (c) No person shall install or modify any solid fuel burning appliance for the purpose of burning coal for space heating or aesthetic purposes. (d) No person shall install or modify any fireplace unless it is one of the following: 1 . A gas burning appliance; 2. An electric appliance; or 3. A fireplace insert that, both prior and subsequent to installation or modification, meets the most stringent emission standards for wood stoves established by the Colorado Air Quality Control Commission as of the time of installation of the fireplace.
