HomeMy WebLinkAbout050 - 05/20/1986 - ANNEXING STUTE #3 ANNEXATION ORDINANCE NO. 50 , 1986 OF THE COUNCIL OF THE CITY OF FORT COLLINS ANNEXING PROPERTY KNOWN AS THE STUTE #3 ANNEXATION TO THE CITY OF FORT COLLINS, COLORADO WHEREAS, Article II, Section 30 of the Constitution of the State of Colorado requires that one of the following conditions be met before an unincorporated area be annexed to a municipality: 1 . The question of annexation be submitted to a vote of the landowners and registered electors of the area to be annexed and the majority of such persons voting, vote in favor of annexation; or 2. The annexing municipality receive a petition for annexation signed by more than 50% of the landowners in the area who own more than 50% of the land; or 3. The area to be annexed be entirely surrounded by or be solely owned by the annexing municipality; and WHEREAS, 100% of the landowners in the Stute #3 Annexation area have signed a petition for annexation; and WHEREAS, not less than one-sixth (1/6th) of the perimeter of the area to be annexed is contiguous with the City of Fort Collins and a community of interest exists between the territory to be annexed and the City of Fort Collins; and the territory to be annexed is urban or will be urbanized in the near future; and such territory is integrated or is capable of being integrated with the City of Fort Collins; and WHEREAS, no election is required and no additional terms and conditions are to be imposed in connection with this annexation; and WHEREAS, the Council has found and determined and does hereby find and determine that said petition is in substantial compliance with the annexation laws of the State of Colorado and that the territory is eligible for annexation, and the City Council desires to annex the same to the City of Fort Collins; and NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS: Section 1 . That the following described property A tract of land situate in the County of Larimer, State of Colorado, to-wit: BEING a portion of the NE 1/4 of Section 4, T6N, R68W and a portion of the SE 1/4 of Section 33, T7N, R68W of the 6th P.M. , Larimer County, Colorado, and further described as follows: Considering the North line of the NE 1/4 of Section 4, T6N, R68W, 6th P.M. as bearing West, and with all bearings herein relative thereto. Beginning at a point on the Northerly right of way line of Colorado State Highway No. 68 from which the North 1/4 Corner of said Section 4 bears the following six (6) courses and distances: N 90000'00" E 1,485.94 feet; N 18'17'24" W 175.88 feet; N 84017'22" E 130.74 feet; N 90°00'00" E 400.00 feet; S 84°17'22" E 201 .00 feet; S 88°46'45" E 419.34 feet; said point also being on the East line of Stute Annexation No. 2 to the City of Fort Collins and the TRUE POINT OF BEGINNING; thence along said Northerly right of way line S 88°46'45" E 50.06 feet to a point on the Easterly line of the SE 1/4 of said Section 33; thence departing said Northerly right of way line along said Easterly line of the SE 1/4 of Section 33 S 00'23'00" E 150.01 feet to the NE Corner of said Section 4; thence along the Easterly line of the NE 1/4 of said Section 4 S 02017'30" E 2,597.80 feet; thence departing said Easterly line of the NE 1/4 of Section 4 N 24006'00" W 134.59 feet to a point on the Easterly line of Stute Annexation No. 2; thence along said Easterly line of Stute Annexation No. 2 the following two (2) courses and distances: N 02°17'30" W 2,474.85 feet and N 00°23'00" W 151 .07 feet to the TRUE POINT OF BEGINNING, containing 3.08 acres more or less. be, and it hereby is, annexed to the City of Fort Collins and made a part of said City, to be known as the Stute #3 Annexation. Section 2. That in annexing said territory to the City of Fort Collins, the City of Fort Collins does not assume any obligation respecting the construction of water mains, sewer lines, gas mains, electric service lines, streets or any other services or utilities in connection with the territory hereby annexed except as may be provided by the ordinances of the City of Fort Collins. Section 3. That within ninety (90) days from the date this Ordinance becomes effective, no building permit shall be issued for any of the lands herein described unless said lands have been zoned under the zoning ordinances of the City. -2- Introduced, considered favorably on first reading, and ordered published this 6th day of May, A.D. 1986, and to be presented for final passage on the 20th day of May, A.D. 1986.
